PROCEEDINGS OF THE SPECIAL COMMITTEE.

1. The Committee met at 2 p.m.


2. Members Present.


The following members were present:—


Deputy Barry Desmond (in the Chair), the Attorney General, Deputies Andrews, Brosnan, de Valera, Henry P. Dockrell, Enright, Esmonde, O’Malley and Pattison.


3. Consideration of Bill.


The Committee took the Bill into consideration.


(i) Sections 1 and 2 agreed to.


(ii) Section 3.


Amendment proposed (Deputy O’Malley):


“In page 3, subsection (7), lines 11 and 12, to delete ‘or by reason of other experience or of other special qualifications or training’ and to substitute ‘or such persons as shall be recommended to the Government by the Commissioners as having suitable qualifications for such appointment’.”


Amendment, by leave, withdrawn.


Amendment proposed (Deputy O’Malley):


“In page 3, line 11, before ‘experience’ to insert ‘relevant’ and to delete ‘or of other’ and substitute ‘and’; and in line 12, after ‘training’ to insert ‘in any of the social sciences, explicitly stated in the announcement of appointment’.”


Amendment, by leave, withdrawn.


Amendment proposed (Attorney General):


“In page 3, subsection (9), line 21, to insert ‘under statute’ after ‘duties’.”


Amendment agreed to.


Amendment proposed (Deputy O’Malley):


“In page 3, subsection (9), line 22, after ‘Commission’, to insert ‘and if a person who holds judicial office is appointed, he shall be appointed as President’.”


Question put: the Committee divided: For, 2; Against, 6.


For:—Deputies Brosnan and O’Malley.


Against:—Attorney General, Deputies Barry Desmond, Henry P. Dockrell, Enright, Esmonde and Pattison.


The Question was declared negatived accordingly.


Question proposed:—“That the section, as amended, stand part of the Bill.”


Debate ensued.
