PROCEEDINGS OF THE COMMITTEE

1. The Committee met at 4 p.m.


2. Members Present.


The following members were present:—


Deputy Patrick Hogan (in the Chair), Deputies Barrett, Briscoe, R. Burke, E. Collins, FitzGerald, Keating, MacSharry, Nolan, Treacy and Tunney


3. Mr. E. F. Suttle (Comptroller and Auditor General) was in attendance in an advisory capacity.


4. The Committee deliberated.


5. Sitting Suspended.


The sitting was suspended at 5.35 p.m. until 7.15 p.m. today.


6. The Committee met again at 7.15 p.m.


7. Motion made (Deputy MacSharry):


“That the Committee suspend its meetings in relation to the Order of the Dáil of 1 December, 1970 until the determination of the proceedings initiated in respect of the citation to the High Court of Mr. Páraic Haughey, as the Committee considers this to be the most prudent course for it to follow at this stage.”


Question put.

8. Ordered: that the following statement be made by the Chairman at the commencement of public session today:


“Deputy Briscoe has informed me that he will not be attending meetings of the Committee in relation to the Order of the Dáil of 1 December, 1970 pending the outcome of the proceedings initiated in the High Court on 24 February, 1971.”


9. Deputy Briscoe withdrew.


10. The Committee went into public session.


11. Statement recorded at paragraph 8 was made by Chairman.


12. Witnesses Examined.


Deputy Charles J. Haughey, was sworn and examined (accompanied by Mr. P. O’Connor, Solicitor).


13. Deputy Haughey withdrew.


14. The Committee went into private session.


15. The Committee consulted with Mr. C. Mac an Ailí, solicitor for Mr. John Kelly. Mr. Mac an Ailí informed the Committee that Mr. Kelly was prepared to attend but was not prepared to give evidence in view of the High Court proceedings.


16. Adjournment.


The Committee adjourned at 8.55 p.m. until 10 a.m. tomorrow.
