DÚN LAOGHAIRE BOATYARD: INDEMNITY AGAINST ACCIDENTS.

With reference to the question raised at my examination before the Public Accounts Committee on 11th June, 1964, of indemnity against accidents at Dún Laoghaire Boatyard, I can find a record of only one case of an accident happening to a child on the storage ground. This accident occurred on Easter Monday, 1954, when a child’s foot was injured by a movement of the yacht turntable. A locking device on the turntable had been interfered with. A claim on behalf of the child was settled for £193 9s. 3d. including costs. An improved locking arrangement was fitted to the turntable.


Liability for injury would depend on the particular circumstances of any case. While the Commissioners provide haulage gear for use by boat owners, the owners themselves are responsible for placing and propping up their boats on the storage ground. The Harbour Master is satisfied that this is adequately done. I am advised that any indemnity clause in the agreement with boat owners would be of doubtful value.
