THE PROCEEDINGS OF THE SPECIAL COMMITTEE.

1. The Committee met at 7.30 p.m.

2. Members Present.

The following members were present:—

Deputy V. de Valera (in the Chair); the Minister for Defence, Deputies Brennan, Carter, Colley, S. Collins, Cowan, Gallagher, and Hilliard.

3. Consideration of Bill.

The Committee resumed consideration of the Bill.

(i) Section 48.

Amendment proposed (Deputy Cowan):

“To delete subsection (2).”

Amendment, by leave, withdrawn.

Amendment proposed (Deputy Cowan):

“To delete subsection (6).”

Question put: the Committee divided: For, 2; Against, 6.

For:—Deputies S. Collins and Cowan.

Against:—Minister for Defence, Deputies Brennan, Carter, Colley, Gallagher and Hilliard.

The Question was declared negatived accordingly.

Section agreed to.

(ii) Section 49.

Amendment proposed (Deputy Cowan):

“In subsection (2), line 31, to delete the words ‘may accept or refuse to’ and substitute the word ‘shall’.”

Question put: the Committee divided: Tá, 1; Níl, 6.

For:—Deputy Cowan.

Against:—Minister for Defence, Deputies Brennan, Carter, Colley, Gallagher and Hilliard.

The Question was declared negatived accordingly.

(iii) Section 50. Amendment proposed (Deputy Cowan):

“In subsection (1), line 38, to add after the word ‘officer’ the words ‘who is sentenced by a civil court to suffer death, penal servitude or imprisonment or who is absent without leave for a period exceeding three months’.”

Amendment, by leave, withdrawn.

Amendment proposed (Deputy Cowan):

“In subsection (2), lines 40 and 41, to delete the words ‘for a term exceeding six months’.”

Amendment, by leave, withdrawn.

Section agreed to.

(iv) Section 51.

Amendment proposed (Deputy Cowan):

“In subsection (1) after paragraph (e) to add a new paragraph as follows:—

‘(f) the retirement under subsection (6) of section 47 of an officer of the Permanent Defence Force’.”

Amendment, by leave, withdrawn.

Section agreed to.

(v) Section 52 agreed to.
