THE PROCEEDINGS OF THE COMMITTEE.

1. The Committee met at 4 p.m.


2. Members Present.


The following members were present:—


Deputy V. de Valera (in the Chair), the Minister for Defence, Deputies Brennan, Carter, Colley, Cowan, Davern, Gallagher, Hilliard, and McQuillan.


3. Consideration of Bill.


The Committee resumed consideration of the Bill.


(i) New section.


Amendment proposed (Deputy Cowan):


“Before section 14 to insert a new section as follows:—


‘14. (1) The Minister shall appoint an officer of the Permanent Defence Force to be the Military Secretary to the Minister.


(2) The Military Secretary to the Minister shall be charged with the performance of such duties as the Minister from time to time shall assign to him.”’


Amendment, by leave, withdrawn.


(ii) Section 14 agreed to.


(iii) Postponed section 11 agreed to.


(iv) Section 15.


Amendment proposed (Deputy Cowan):


“In subsection (2), line 36, to insert after the word ‘standing’ the words ‘and experienced in criminal law,’.”

Section agreed to.


(v) Section 16.


Amendment proposed (Deputy Cowan):


“In line 9, to insert after the word ‘Forces’ the words ‘the numerical establishment of which shall not exceed such number of officers, non-commissioned officers and men as may be provided for in the estimates for the Department of Defence passed by Dáil Éireann for the year’.”


Question put: the Committee divided: For, 1; Against, 7.


For:—Deputy Cowan.


Against:— Minister for Defence, Deputies Brennan, Carter, Colley, Davern, Gallagher and Hilliard.


The Question was declared negatived accordingly.


Section agreed to.


(vi) Section 17.


Amendment proposed (Deputy Cowan):


“In subsection (1), line 10, to delete the words ‘under the direction of the President, and’.”

Amendment proposed (Deputy Cowan):


“In subsection (1) to delete all the words after ‘shall be’ in line 13 to the end of the subsection and substitute the words ‘exercised through and by the Minister’.”


Amendment, by leave, withdrawn.


Amendment proposed (Deputy Cowan):


“In subsection (3), line 33, to delete the words ‘the Defence Forces or any part thereof’ and substitute the words ‘any part of the Defence Forces’.”
