IMEACHTA AN CHO-CHOISTE.PROCEEDINGS OF THE JOINT COMMITTEE.Dé Céadaoin, 20 Eanair, 1926.Wednesday, 20th January, 1926.1. The Committee met at 11 a.m. 2. The following members were present:—Deputy Roddy (in the Chair), Deputies Wolfe, Cooper, Johuson, Nagle, O’Connor, T. Hennessy, O’Doherty, M. Conlan, Mulvany and Thrift. 3. Mr. Bernard McMullen and Mr. M. J. McNally (McNally & Co., Auditors and Accountants) was called and examined. 4. The Committee took up the consideration of the Bill. Section 1. Amendment proposed (Deputy Nagle):— “To delete the word ‘shop’ in line 21, and substitute the word ‘shops.”’ Amendment agreed to. Amendment proposed (Deputy Nagle):— “To insert, in line 22, after ‘1912,’ the words ‘hereinafter referred to as the Act of 1912.”’ Amendment agreed to. Amendment proposed (Deputy Nagle):— “To insert in line 23 after ‘(No. 39 of 1925),’ the words ‘hereinafter referred to as the Act of 1925)’.” Amendment agreed to. Amendment proposed (Deputy Nagle):— “To delete in lines 24 and 25, the word ‘these’ and substitute the word ‘those.”’ Amendment agreed to. Section 1, as amended, agreed to. Section 2. Amendment proposed (Deputy Nagle):— “To insert before Section 2, a new section as follows:— ‘Section 2 of the Act of 1925 shall be amended by the addition of the Urban District of Bray to the list of urban districts contained therein.”’ Amendment, by leave, withdrawn. Amendment proposed (Deputy Johnson):— “To insert before Section 2 a new section as follows:— ‘This Act shall apply to every shop which is situate in the areas specified in Section 2 of the Act of 1925, and in which is carried on the trade or business of draper, tailor, outfitter, hatter, hosier, glover, boot and shoe dealer, or house-furnisher and upholsterer, or any of them.”’ Question put; the Committee divided: For, 5; Against, 4:— For: Deputies Cooper, Doherty, Johnson, Nagle and Woife. Against: Deputies T. Hennessy, Mulvany, M. Conlan and O’Connor. Amendment declared carried accordingly. New section there inserted. Amendment proposed (Deputy Johnson):— “To insert before Section 2 a new section as follows:— ‘The provisions of the Act of 1925 and of this Act shall so far as they apply to sales by auction be construed to apply to every auction which at any time during the course of its business includes the sale of goods ordinarily sold in a shop to which this Act applies.”’ Question put; the Committee divided: For, 5; Against, 4:— For: Deputies Cooper, Johnson, Nagle, Wolfe and Thrift. Against: Deputies T. Hennessy, Mulvany, M. Conlan and O’Connor. Amendment declared carried accordingly. New section there inserted. Motion made (Deputy T. Hennessy):— “That Section 2 stand part of the Bill.” Question put; the Committee divided: For, 7; Against, 3:— For: Deputies Cooper, Doherty, T. Hennessy, Mulvany, Wolfe, M. Conlan and O’Connor. Against: Deputies Johnson, Nagle and Thrift. Motion declared carried accordingly. Section 3. Amendment proposed (Deputy Johnson):— “To delete the section and substitute a new section as follows:— (1) ‘Every shop to which this Act applies shall, save as otherwise in this Act provided, be closed for the serving of customers except during the hours of business specified in the Schedule to this Act: Provided that it shall be lawful for the occupier of a shop to keep his premises open for the serving of customers until ten o’clock in the evening on the Saturday next before Easter Sunday, the Saturday before Whit-Sunday, and the Saturday next before Christmas Day. (2) ‘Every person who contravenes this section shall be guilty of an offence against this Act.”’ Question, “That the said section be deleted,” put and agreed to. Motion made (Deputy Johnson). “That the proposed new section be there inserted.” Amendment proposed to the proposed new section (Deputy Cooper):— “To insert after the words ‘Schedule to this Act’ the words ‘provided that no shop in the area aforesaid in which any of the above-mentioned trades is carried on, shall remain open for the serving of customers for a longer period than 10½ hours in any one day, save …”’ Question put; the Committee divided: For, 4; Against, 4:— For: Deputies Cooper, Johnson, Nagle and Thrift. Against: Deputies T. Hennessy, Mulvany, M. Conlan and O’Connor. Casting Vote of Chairman given against. Amendment declared negatived accordingly. Amendment proposed (Deputy M. Conlan):— “To delete all words after the word ‘Whit-Sunday’ in line 38 and substitute the words ‘and the Saturday next before the First Monday in August and the ten days next before Christmas Day, and provided also that any shop having Saturday as the weekly half-holiday may remain open until 6.30 p.m. each Wednesday evening’.” Amendment, by leave withdrawn. New section there inserted. Section 3 agreed to. 5. The Committee adjourned at 2 p.m., till to-morrow at 3 p.m. |
