PROCEEDINGS OF THE JOINT COMMITTEE.

1. The Committee met at 3 p.m.


2. The following members were present:—Deputy Roddy (in the Chair), Deputies Mulvany, O’Connor, T. Hennessy, Johnson, Nagle, Thrift, Cooper, Wolfe, Doherty and M. Conlan.


3. The Committee resumed consideration of the Bill.


Section 4.


Amendment (as amended by leave) proposed (Deputy Johnson):—


“To insert, before Section 4, a new section as follows:—


‘Save as provided in this Act, nothing in this Act shall be construed to limit the effect or modify the provisions of Section 4 of the Act of 1912.”’


Amendment agreed to.


New section there inserted.


Amendment proposed (Deputy Cooper):—


“To insert, before Section 4, a new section as follows:—


‘The provisions of this Act shall only apply to such shops as employ not more than two assistants, exclusive of the employer, and members of the employer’s family.”’


Question put. The Committee divided; For, 3; Against, 7:—


For: Deputies Cooper, Wolfe, and Thrift.


Against: Deputies Doherty, T. Hennessy, Johnson, Mulvany, Nagle, M. Conlan and O’Connor.


Amendment declared negatived accordingly.


Amendment proposed (Deputy Nagle):—


“To insert, before Section 4, a new section as follows:—


‘In Section 4 of the Act of 1925, the words “twenty pounds are hereby repealed and the following words substituted therefor, that is to say, “fifty pounds or imprisonment for a term not exceeding one month.””’


Amendment agreed to.


New section there inserted.


Amendment proposed (Deputy Nagle):—


“To insert, before Section 4, a new section as follows:—


‘Anything contained in the Act of 1912 or the Act of 1925 that is inconsistent with the provisions of this Act, shall as from the commencement of this Act cease to have effect to the extent of such inconsistency:


Provided that all regulations or orders lawfully made under the provisions of the said Acts and in force at the commencement of this Act shall continue in force until amended or repealed save in so far as they are inconsistent with the provisions of this Act:


Provided also that the validity of any proceedings taken or things lawfully done or penalties imposed or incurred under the authority of the said Acts or any regulation or order made thereunder shall not be affected by this Act.”’


Amendment agreed to.


New section there inserted.


Amendment proposed (Deputy Wolfe):—


“To delete in Section 4 the word ‘January’ and to insert therefor the word ‘March’.”


Amendment agreed to.


Amendment proposed (Deputy Johnson):—


“To delete in Section 4 the words ‘for a period of five years therefrom,’ and to insert therefor the words ‘until the 15th day of July, 1930.”’


Amendment agreed to.


Section 4, as amended, agreed to.


Section 5.


Amendment proposed (Deputy Thrift):—


“To alter ‘1925’ to ‘1926.”’

“To amend the first three lines of the Schedule as follows:—

Motion made (Deputy T. Hennessy):—


“That the Schedule, as amended, stand part of the Bill.”

4. Draft Report brought in by the Chairman, read, and passed as follows:—


“The Special Committee, to whom the Shop Hours (Drapery Trades, Dublin and Districts) (Amendment) Bill, 1925, was referred, have considered the said Bill, and taken evidence thereon, which they have agreed to report to the Dáil. They have made amendments in the Bill, and the Bill, as amended, is herewith returned to the Dáil.”
