Chairman's Foreword

This is the first full annual report of the Joint Committee on Foreign Affairs. It covers the period from its establishment in November 2002, to the end of 2003. I was elected as Chairman of the Joint Committee on 12 November 2002 and Deputy Pat Carey was elected as Vice-Chairman on the same day.

Meetings of the Joint Committee

The Joint Committee is a very active committee, meeting in public either in its full form or at sub-committee level, approximately once every week. In addition to these meetings the Chairman, alone or sometimes accompanied by some other members, meets privately with foreign dignitaries or representatives of international organisations who visit the Oireachtas outside normal committee meeting times.

Visits Abroad

The Joint Committee undertakes visits abroad, to gather information on specific subjects, to gain a better understanding of the countries visited, to familiarise members with issues which were unfolding in the country or international organisation visited, and as part of the normal inter-committee exchanges between parliaments or to attend conferences and meetings. In the reporting period, visits ranged over a wide expanse of geographical locations and encompassed a variety of subjects. Since November 2002 the following are some of the visits made by delegations from this Joint Committee; a) the UN in New York during Ireland's membership of the Security Council where they met with the heads of UN programmes and agencies (including UNMOVIC and the Iraq Oil for Food Programme), b) Iraq just before the war began, c) Geneva in relation to human rights, d) visits to European parliaments to meet with other Foreign Affairs Committees, including visits to some of the acceding countries e) Zambia and South Africa to assess Ireland's official programme of development assistance to these countries and to meet with Ministers and counterparts in both countries and f) visits of the Chairman to a number of conferences, including the conference of Chairmen of Foreign Affairs Committees of EU parliaments.

Focus of the Joint Committee

The work of the Joint Committee is driven primarily by international events and this fact is normally reflected in its agenda. Countries in conflict and issues of human rights are constant themes. This year the Middle East, including the situation in Iraq, the Israeli/Palestinian conflict, the crises in Africa including famine in Ethiopia and the war and humanitarian crisis in the Democratic Republic of the Congo are the primary topics discussed. However, other issues some with an Irish flavour such the “Columbia 3”or others such as Kashmir, Iran, South Africa, Zimbabwe, Tibet, HIV/AIDS in Africa and the political situation in Cyprus are also high on the list of items discussed. The Joint Committee, in general reflects the views and concerns of the Irish public. Broadly, the main issues for the Joint Committee are: - the immediate cause and consequence of particular events; how Ireland, the EU or the UN can help; the human rights abuses which might have occurred; whether humanitarian assistance is needed and is forthcoming; the relationship of the particular country to Ireland; and the question of strengthening and enlarging our economic and political ties with the country concerned.

The topics are selected from major international political events, requests from other Joint Committee members or from the public, particularly from NGOs. They also arise through the opportunities offered by visits to Ireland of foreign political dignitaries.

The major items, which continually appear on the agenda of the Joint Committee are countries and regions in conflict and crisis, breaches of human rights, humanitarian disasters and development cooperation, issues pertaining to the EU, the UN and Northern Ireland.

Human Rights

The issue of human rights is one of the central themes of the Joint Committee. This is a principal focus for Members in their examination of many of the countries that come up for discussion. Questions on human rights always arise in respect of countries and regions in conflict or in crisis. In addition, the issue is always addressed when our delegations visit, or incoming delegations arrive from countries which are known to have breached human rights norms.

In recognition of this, a sub-committee chaired by Senator Paul Bradford, has again been established to deal solely with this subject. The Sub-Committee on Human Rights meets regularly.

Development Cooperation

Development Cooperation has been a central plank of Ireland's foreign policy for a considerable amount of time. It is an area where the Irish public continues to show enormous interest and support. In recognition of this public support, the Government has committed itself to increasing Ireland's contribution to development cooperation to reach the UN target of 0.7% of GDP by 2007. The Joint Committee strongly approves of this decision and strongly believes that the best way forward for world peace and stability is through a policy of trade and development cooperation. In this respect, the Joint Committee strongly supports the work of Development Cooperation Ireland, Ireland's official support for effective and enhanced EU development assistance, and its increased involvement in pushing for more effective and coordinated UN humanitarian and development assistance. It encourages the Government to expand its priority programmes and is pleased with the addition of East Timor as a priority country. We welcome the reform of EU aid of which the Cotonou EU/ACP (African, Caribbean and Pacific) Partnership Agreement is a blueprint for development assistance incorporating as it does political dialogue and trade assistance. The Joint Committee believes that the populations in those countries, which are amongst the poorest in the world, will only be in a position to achieve sustainable development if these countries are democratic, respect the rule of law and human rights and are free from conflict and government corruption. However, it also believes that developed nations and international organisations must in their turn do everything possible to build capacity in these countries so that they will be in a position to take advantage of the opportunities offered by world trade.

In this respect, the Joint Committee undertook a survey of the most vulnerable country in the world, Ethiopia, and the report which issued carries recommendations along the foregoing lines. The Joint Committee is committed to continuing its concentration on similar vulnerable countries with a view to highlighting the great need to focus attention on these sometimes forgotten tragedies.

Because of the importance of this area of Joint Committee work, it too has been given a separate sub-committee under the Chairmanship of Senator Michael Kitt and met at regular intervals during the period.

The EU

The Joint Committee regularly deals with EU issues, which come within its remit (ie Common Foreign and Security Policy and European Security and Defence Policy) either directly, when for instance it is discussing Cyprus, or indirectly on most other issues (eg the EU policy on the Roadmap for the Middle East or its intended involvement in Iraq). The Joint Committee is also mindful of the negative result in the June 2001 referendum on the Nice Treaty and members are of the view that the EU's involvement in external issues should be a matter of interest for the Oireachtas and the Irish Public. The Joint Committee on Foreign Affairs is an enthusiastic supporter of the accession of the Central and Eastern European States and Cyprus and Malta to the EU and it believes that, in addition to the benefits for the countries concerned as well as the member States, this enlargement will greatly strengthen Europe democratically, culturally, economically and in terms of security.

The UN

The UN also features in many of the debates at Joint Committee meetings. Reflecting Ireland's traditional interest, particularly in the area of international peacekeeping and development assistance, the Joint Committee pays special attention to the role of the UN in humanitarian crisis areas and conflict situations. The Committee supports UN reform, welcomes major UN reports such as the April 1998 Secretary General's report on the Causes of Conflict and the Promotion of Durable Peace and Sustainable Development in Africa, the Brahimi report on UN Peace Operations in August 2000, the UN Millennium Development Goals and recognises the important co-ordinating role which the UN should continue to play in international affairs. The Joint Committee recognises that the rapid response made by the UN in the aftermath of the 11 September terrorist atrocities was vital to world political and economic security in the face of a threat to the stability of democracy and the rule of law. It was deeply concerned at the inability of the UN Security Council members to agree on a common approach to Iraq. The Joint Committee is strongly of the view that the UN should remain the central organisation through which matters of international peace and security would be addressed and acted upon.

The Committee very much welcomed its discussions with senior UN executives in November 2002, on issues such as the political and humanitarian situation in areas of crisis particularly in Iraq, and Africa. The Joint Committee would see this source of information as invaluable to its work and would intend to keep in touch, including visits, with the UN on a regular basis during its term of office.

In relation to the visit to the UN the Joint Committee, as indeed in other areas of its work, acknowledges the personal cooperation of the Minister for Foreign Affairs Mr. Brian Cowen T.D. and the assistance of the Department of Foreign Affairs.

Northern Ireland

Northern Ireland has the greatest resonance for the members of the Joint Committee and there is an ongoing desire to be kept informed of developments in relation to political progress there. However, because of the political sensitivities, the Joint Committee refrains from engaging in public debate on the issue while negotiations are ongoing between the two governments and the political parties in Northern Ireland. The Joint Committee, nevertheless, meets on occasions to discuss certain aspects of Northern Ireland with a view to being helpful to the continuing peace process. In this context, the Joint Committee was pleased to hold discussions with and host the UK Select Committee on Northern Ireland when it visited the Oireachtas.

Conclusion

The Joint Committee on Foreign Affairs comprises both Government and Opposition members. It provides therefore, a broad and independent Oireachtas view on the key issues, which arise in Ireland's international relations and foreign affairs. It has come under enormous pressure in recent years because of Ireland's greatly increased role in international affairs. Our historic involvement in Africa through our missionaries, NGOs, business, sporting and cultural interests and Departmental staffs has given us a special position from which to support and participate in economic and social developments in African states. This is true also in many other parts of the world. People see how Ireland has developed rapidly to rank among the wealthiest nations in the world and they want to emulate this achievement. We want to assist them in their own development.

Ireland's Presidency of the EU, at a time when 10 new member states are about to join, three more are official candidates and others are actively involved in preparations for membership, brings its own very welcome pressures.

While we greatly appreciate the excellent and highly professional support provided to the Committee by the Minister for Foreign Affairs, Mr. Brian Cowen T.D., his Minister of State for Development Cooperation, Mr. Tom Kitt T.D., and the Secretary General, Mr. Dermot Gallagher and his staff in the Department of Foreign Affairs, it is clear that the Committee needs more staff to meet its work load, and to make its full contribution. We also acknowledge the hard work and dedication throughout the year, of our own staff in the Secretariat to the Committee.

The Joint Committee is focussing its work on priority areas. We have included Africa and the UN among those. In the course of the last year, apart from the numerous ongoing reports of the Joint Committee, we also published three substantial reports on:

(1) A visit to the UN and discussion of the major current issues exercising that body, (2) A study of Ethiopia's development needs, and (3) A report on the visit to South Africa and Zambia by a delegation from the Joint Committee.

Members of the Joint Committee

1. Content and Format of Report

This report has been prepared pursuant to Standing Order 84 (3), (4), (5) and (6) (Dáil Éireann) and Standing Order 69 (3), (4), (5) and (6) (Seanad Éireann) which provide for the Joint Committee to-

• make an annual report to both Houses
• prepare an annual work programme
• lay minutes of its proceedings before both Houses
• undertake a review of its procedure and its role generally

At its meeting on 2^nd March 2004, the Joint Committee agreed that all these items should be included in this annual report.

2. Establishment and Functions

The Dáil Select Committee was established by Order of Dáil Éireann of 16 October 2002 to consider Bills, Estimates for Public Services and the terms of any international agreement involving a charge on public funds which come within the aegis of the Department of Foreign Affairs .

The Dáil Select Committee under the same Order was enjoined with a Select Committee of Seanad Éireann, established by Order of Seanad Éireann of 17 October 2002, to form the Joint Committee on Foreign Affairs. Among the principal functions of the Joint Committee are to consider –

• public affairs administered by the Department of Foreign Affairs
• matters of policy for which the Minister for Foreign Affairs is responsible
• legislative and expenditure proposals of the Department
• scrutiny of EU legislative proposals
• certain matters relating to bodies under the aegis of the Department
• such aspects of Ireland's international relations as it may select

The Orders of Reference of the Dáil Select Committee and the Joint Committee are set out at Appendix 1.

3. Chairman, Vice-Chairman, Convenors and Membership

Deputy Michael Woods was elected as Chairman of the Joint Committee on 12 November 2002. Deputy Pat Carey was elected as Vice-Chairman of the Joint Committee on 12 November 2002. The Chairman of the Joint Committee is also Chairman of the Dáil Select Committee.

Deputies Tony Dempsey and Michael D. Higgins are the Convenors of the Committee whose function it is to ensure the availability and attendance of Members or their substitutes for meetings of the Committee and other Committee activities and, in particular, to ensure Members' availability for divisions.

The Members of the Joint Committee are set out at Appendix 2.

4. Establishment of Sub-Committees

Standing Order 81(3) (Dáil) and Standing Order 65(3) (Seanad) confer on Committees the power to appoint sub-Committees and to refer to such sub-Committees any matter covered by its orders of reference and to delegate any of its powers to such sub-Committees, including power to report directly to the Dáil and Seanad.

1. The Joint Committee agreed at its meeting on 18 December 2002 to create a sub-Committee on Development Co-operation to consider such aspects of
   
   1. Ireland's relations with developing countries in the field of development co-operation, trade and debt;
   2. the Government's official Development Assistance Programme; and
   3. the role of the United Nations in the field of development co-operation

   as the sub-Committee may select or as may be referred to it by the Joint Committee on Foreign Affairs.

   
   

   It was also agreed that the Sub-Committee would consist of 7 Members (5 Dáil and 2 Seanad). The Orders of Reference of the sub-Committee are set out in Appendix 1.1. The Members of the sub-Committee are set out in Appendix 2.1.

   
   

   At its first meeting on 13 February 2003 the Sub-Committee elected Senator Michéal P. Kitt as Chairman.

   
   
2. The Joint Committee agreed at its meeting on 18 December 2002 to create a sub-Committee on Human Rights to consider such aspects of international human rights, including the role of the United nations in this field, as the sub-Committee may select or as may be referred to it by the Joint Committee on Foreign Affairs.

The sub-Committee has 7 Members, 4 from Dáil Éireann and 3 from Seanad Éireann. The Members of the sub-Committee are set out in Appendix 2.2. The Orders of Reference of the sub-Committee are set out in Appendix 1.2.

At its first meeting on 27 February 2003 the Sub-Committee elected Senator Paul Bradford as Chairman and Senator Paschal Mooney as Vice-Chairman.

5. Meetings, Attendance and Recording

Meetings of the Joint Committee, Select Committee and sub-Committee(s) took place in the Committee rooms in Leinster House 2000. Meetings were in public unless otherwise ordered by the Committee.

Televised coverage of public meetings of the Committee were broadcast live within the Leinster House complex and was available for subsequent public broadcasting by RTE , TV3 and other networks.

6. Number and Duration of Meetings

The Joint Committee met on 29 occasions in the year under report. The number of hours discussion involved in these meetings was in excess of 50 hours. The date and subject matter of each meeting is set out at Appendix 3.

The Sub-Committee on Development Co-operation met on 9 occasions during the year and the number of hours discussion involved in these meetings was in excess of 8 hours. The date and subject matter of each meeting is set out in Appendix 3.1.

The Sub-Committee on Human Rights met on 8 occasions during the year and the number of hours discussion involved in these meetings was in excess of 9 hours. The date and subject matter of each meeting is set out in Appendix 3.2.

The Dáil Select Committee met on 3 occasions in the year under report and the number of hours discussion involved in these meetings was in excess of 4 hours. The date and subject matter of each meeting is set out in Appendix 4.

7.2 Dáil Select Committee

On the 3 occasions the Dáil Select Committee met, it dealt with the following matters:

• Revised Estimates for the Department of Foreign Affairs, Votes 38 and 39
• The Convention on the Marking of Plastic Explosives for the Purposes of Detection
• Terms of the Agreement establishing the Agency for International Trade Information and Co-operation as an Intergovernmental Organisation
• Terms of the Agreement establishing an Association between the European Community and the Republic of Chile.

7.3 Sub-Committee on Development Co-operation

On the 9 occasions that it met, the Sub-Committee on Development Co-operation dealt with the following matters:-

• Election of Chairman
• Ireland's debt policy and Ireland's involvement in the IMF's lending programme to low income countries
• international coffee crisis and the effect of the collapse of world coffee prices on the developing world
• The Ireland Aid Programme
• Development issues in Colombia
• Development aspects of Ireland's trade policy
• level of resources allocated for Official Development Assistance and the issue of progression towards the UN target of 0.7% of GNP.
• Ireland's trade and development policies post Cancun.

In addition to the formal meetings of the Joint Committee, the Chairman also had a series of meetings [over 40] on behalf of the Committee during the year, including meetings with Ambassadors and other distinguished visitors, incoming delegations and individuals. Details are set out on Appendix 6.

9. 9.1 Joint Committee Reports

During the year under report, the Joint Committee published the following reports:

• Report of the visit of the delegation of the Joint Committee to South Africa and Zambia.
• Work Programme 2003

9.2 Work in Progress

• The Committee has been examining Ireland's current and ongoing role in UN Peacekeeping. A report on this subject will be published during 2004.
• The Committee has also agreed to undertake a report on Uganda. It is hoped to publish ‘Project Uganda’ during 2004.

10. Travel

The Joint Committee travelled abroad on fact finding missions and to attend international conferences in accordance with its Orders of Reference in connection with its work programme. Details of this travel are set out in Appendix 7.

11. Functions and Powers

The Joint Committee is currently satisfied with its present procedures and role. It has no plans to request changes to its Orders of Reference in 2004.

Appendix 1

COMMITTEE ON FOREIGN AFFAIRS

ORDERS OF REFERENCE

Dáil Éireann on 16^th October 2002 ordered:

1. 1. That a Select Committee, which shall be called the Select Committee on Foreign Affairs consisting of 11 members of Dáil Éireann (of whom 4 shall constitute a quorum), be appointed to consider such -
      
      1. Bills the statute law in respect of which is dealt with by the Department of Foreign Affairs;
      2. Estimates for Public Services within the aegis of the Department of Foreign Affairs; and
      3. Proposals contained in any motion, including any motion within the meaning of Standing Order 157 concerning the approval by the Dáil of international agreements involving a charge on public funds,

      as shall be referred to it by Dáil Éireann from time to time.

      
      
   2. For the purpose of its consideration of Bills and proposals under paragraphs (1)(a)(i) and (iii), the Select Committee shall have the powers defined in Standing Order 81(1), (2) and (3).
   3. For the avoidance of doubt, by virtue of his or her ex officio membership of the Select Committee in accordance with Standing Order 90(1), the Minister for Foreign Affairs (or a Minister or Minister of State nominated in his or her stead) shall be entitled to vote.
2. 1. The Select Committee shall be joined with a Select Committee to be appointed by Seanad Éireann to form the Joint Committee on Foreign Affairs to consider -
      
      1. such public affairs administered by the Department Foreign Affairs as it may select, including, in respect of Government policy, bodies under the aegis of that Department;
      2. such matters of policy for which the Minister for Foreign Affairs is officially responsible as it may select;
      3. such related policy issues as it may select concerning bodies which are partly or wholly funded by the State or which are established or appointed by Members of the Government or by the Oireachtas;
      4. such Statutory Instruments made by the Minister for Foreign Affairs and laid before both Houses of the Oireachtas as it may select;
      5. such proposals for EU legislation and related policy issues as may be referred to it from time to time, in accordance with Standing Order 81(4);
      6. the strategy statement laid before each House of the Oireachtas by the Minister for Foreign Affairs pursuant to section 5(2) of the Public Service Management Act, 1997, and the Joint Committee shall be so authorised for the purposes of section 10 of that Act;
      7. such annual reports or annual reports and accounts, required by law and laid before both Houses of the Oireachtas, of bodies specified in paragraphs 2(a)(i) and (iii), and the overall operational results, statements of strategy and corporate plans of these bodies, as it may select;

      Provided that the Joint Committee shall not, at any time, consider any matter relating to such a body which is, which has been, or which is, at that time, proposed to be considered by the Committee of Public Accounts pursuant to the Orders of Reference of that Committee and/or the Comptroller and Auditor General (Amendment) Act, 1993;

      
      

      Provided further that the Joint Committee shall refrain from inquiring into in public session, or publishing confidential information regarding, any such matter if so requested either by the body concerned or by the Minister for Foreign Affairs;

      
      
      8. such aspects of Ireland's international relations as it may select; and
      9. such other matters as may be jointly referred to it from time to time by both Houses of the Oireachtas,

      and shall report thereon to both Houses of the Oireachtas,

      
      

   Provided that any consideration by the Joint Committee, or a sub-Committee, of security issues relating to Northern Ireland shall be in private session and the provisions of Standing Order 91 shall apply.

   
   
   2. The quorum of the Joint Committee shall be five, of whom at least one shall be a member of Dáil Éireann and one a member of Seanad Éireann.
   3. The Joint Committee shall have the powers defined in Standing Order 81(1) to (9) inclusive.
   4. The following persons may attend meetings of the Joint Committee and of its sub-committees and may take part in proceedings without having a right to vote or to move motions and amendments:
      
      1. Members of the European Parliament elected from constituencies in Ireland (including Northern Ireland);
      2. members of the Irish delegation to the Parliamentary Assembly of the Council of Europe; and
      3. at the invitation of the Joint Committee or of a sub-Committee, as appropriate, other Members of the European Parliament.

      5. such proposals for EU legislation and related policy issues as may be referred to it from time to time, in accordance with Standing Order 65(4);
      6. the strategy statement laid before each House of the Oireachtas by the Minister for Foreign Affairs pursuant to section 5(2) of the Public Service Management Act, 1997, and the Joint Committee shall be so authorised for the purposes of section 10 of that Act;
      7. such annual reports or annual reports and accounts, required by law and laid before both Houses of the Oireachtas, of bodies specified in paragraphs 1(a)(i) and (iii), and the overall operational results, statements of strategy and corporate plans of these bodies, as it may select;

      Provided that the Joint Committee shall not, at any time, consider any matter relating to such a body which is, which has been, or which is, at that time, proposed to be considered by the Committee of Public Accounts pursuant to the Orders of Reference of that Committee and/or the Comptroller and Auditor General (Amendment) Act, 1993;

3. Election of Chairman

Nominations for the position of Chairman were sought by the Clerk. Deputy Michael Woods was nominated by Deputy Pat Carey and seconded by Deputy Liz O'Donnell. Deputy Michael D. Higgins was nominated by Senator David Norris and seconded by Deputy Tony Gregory.

The Question “That Deputy Michael Woods be elected Chairperson of the Joint Committee” was put by the Clerk and agreed to. Deputy Woods took the Chair.

4.Election of Vice-Chairman

Nominations for the position of Vice-Chairman were sought by the Chairman and Deputy Pat Carey was nominated by Deputy Dan Wallace and seconded by Deputy Liz O'Donnell. As there were no other nominations, Deputy Carey was elected Vice-Chairman.

Senator Mooney expressed concern that no Senator had been elected to the position of Vice–Chairman of an Oireachtas Committee and advocated an approach which would allow Senators to hold the position of ‘Joint’ Vice Chairman.

5.Work Programme

The Chairman advised the meeting that Standing Orders required the Committee to publish a work programme. A draft work programme had been prepared by the Secretariat to facilitate the Committee. During the exchange of views that took place on the work programme, various issues were raised including the following:-

• The need to prioritise items on the work programme and to have a sharp focus on a number of key issues;
• The Iraq situation and the urgent need for the Committee to be fully briefed and for the Minister to come before the Committee to discuss the matter;
• The need to monitor the Overseas Development Aid budget and the expansion of the Ireland Aid programme;
• Aid/Trade/Debt and the least developed countries;
• Reform of the UN – procedures, membership, the veto, roles of the Security Council and the General Assembly;
• A review of Irelands performance on the UN Security Council;
• The establishment of sub-Committees to considers matters relating to human rights and development cooperation, and the role of the UN in these areas;
• International law and international legal instruments;
• The human rights situation in Columbia with particular regard to the trial of 3 Irish people;
• The extent to which the Committee should consider EU related matters;
• The extent to which the Committee should consider Northern Ireland matters;
• A timetable for future Committee meetings, to include topics to be addressed at each meeting;
• Media coverage of Committee activities.

It was agreed that the Clerk would amend the draft work programme to take account of members views, and the revised document would be brought before the Committee for discussion and agreement at the next meeting. Members were invited to submit items for inclusion in the work programme by communicating with the Clerk.

Matters arising

The Committee briefly discussed the extent to which EU related matters would be considered. It was recognized that while some overlap between the work of the European Affairs Committee and the Foreign Affairs Committee would occur, this should be kept to a minimum.

The Committee agreed that the food crisis in the Horn of Africa and Southern Africa was an immediate priority for the Committee. Also mentioned for early discussion was the situation in Iraq

5. Presentation by ABColumbia Group

The Committee heard a presentation from Ms. Madeline Church, Co-ordinator of the ABColumbia Group and Ms. Patty Abozaglo, Trocaire, on human rights issues in Columbia. The ABColumbia Group is based in London and is the platform that gathers together six British and two Irish agencies (including Trocaire) working in Columbia. It focuses on lobbying on Columbian issues in Europe especially regarding human rights, peace building and development.

The presentation was followed by a question and answer session.

In a brief discussion which followed the departure of the witnesses, it was agreed to seek additional briefing from the Department of Foreign Affairs regarding “Plan Columbia” and to locate and circulate to members a copy of the memorandum laid before the US Congress by US Secretary of State Colin Powell certifying that the Columbian Armed Forces were meeting the human rights conditions required under the relevant US Appropriation Acts.

6. Any Other Business

It was agreed that the Committee would meet with the Foreign Affairs Committee of the Croatian Parliament in early February 2003 and the Northern Ireland Committee of the House of Commons in late February.

4. Correspondence

The Chairman referred to several items of correspondence which had been circulated with the agenda –

• A letter written on behalf of the families of the 3 Irish citizens currently on trial in Columbia, in which they declined to meet with the Committee on foot of legal advice. It was agreed to discuss the matters raised in the letter at the next meeting.
• Requests from Burma Action Ireland and the Latin American Solidarity Center to meet with the Committee. It was agreed to incorporate presentations with these groups into the Committees meeting schedule.

5. Presentation by MEI/RELSA

The Committee heard a presentation from Ms. Rosemary Quinn and Mr. Pat Short from Marketing English in Ireland/Recognised English Language Schools Association on the implications of visa processing procedures in China for Chinese students which has resulted in the virtual closure of “English as a foreign language” market to Irish schools.

The presentation was followed by a question and answer session.

The Committee agreed to raise the matters raised in the presentation with the Departments of Justice, Education and Foreign Affairs.

6. Presentation by Concern

The Committee heard a presentation from Concern on the growing food crisis in Africa, in particular in the Horn of Africa and Southern Africa. The Committee heard a presentation from Christian Aid Ireland regarding their report entitled “Losing Ground: Israel, Poverty and the Palestinians”. The delegation comprised Oisin Coghlan, Policy Officer, Christian Aid Ireland, Judeh Abdullah, Deputy Director, Palestinian Agricultural Relief Committees (PARC), Rev. Robert Herron, President of the Irish Council of Churches and Constantine Dabbagh, Director of the Gaza Strip Programme, Middle Eastern Council of Churches.

The presentation was followed by a question and answer session.

Following debate, the Committee agreed to invite the Minister for Foreign Affairs to meet with the Committee at a mutually convenient time to discuss the current Middle East situation. It was agreed nem. con. that among the issues which members of the Committee would wish to raise with the Minster are the recommendations made in the Christian Aid report on the occupied territories, including the examination of the EU provisions relating to human rights contained in bilateral agreements with Israel.

It was agreed to publish the transcript of the meeting, when available, and forward it to the Minister for his information.

The Committee concurred with the recommendation of the Sub-Committee that no further scrutiny of this proposal was necessary.

5. Presentation by the East Timor Solidarity Campaign

The Committee heard a presentation from Mr. Tom Hyland of the East Timor Solidarity Campaign regarding the current situation in East Timor. The presentation was followed by a question and answer session.

Arising from the presentation, the Committee agreed to recommend to the Minister for Foreign Affairs that Ireland support East Timor in achieving a satisfactory solution to their dispute with Australia regarding maritime boundaries, rights to oil resources and oil exploration. This could involve sponsoring a legal case taken under the law of the sea, or by calling for an international commission to adjudicate in the case. The Committee also agreed to consider inviting in the Australian ambassador to discuss the matter. It was further agreed that the Committee would recommend to the Minister that internships should be offered to East Timorese officials in the Department of Foreign Affairs and other Departments.

Arising from a query from Senator Mooney, the Chairman advised the meeting that he intended to raise the issue of the publication of members expenses with the Working Group of Committee Chairmen when it next meets, and would report back to the Committee at that stage.

4. Correspondence

The Committee noted correspondence from the Chairmen of the Foreign Affairs Committees of the Croatian Parliament and of the Parliament of the Czech Republic, formally inviting the Committee to visit their respective countries.

The Committee also considered correspondence from the Sub-Committee on European Scrutiny regarding a proposal [COM(2002) 775 ] examined falling within the remit of the Department of Foreign Affairs. The Committee concurred with the recommendation of the Sub-Committee that no further scrutiny of this proposal was necessary.

5. Presentations by NGOs regarding the food crisis in Ethiopia

The Committee heard presentations regarding the food crisis facing Ethiopia from a number of NGOs actively involved in the region. The presentations were followed by a question and answer session.

In this context it was agreed to call before the Committee additional witnesses such as the Ethiopian Ambassador and the Minister of State with responsibility for Development Cooperation. It was also agreed that the Committee should engage a Consultant to assist it in the preparation of a report to the Houses.

6. Any Other Business

The Committee agreed in principle that a delegation from the Sub-Committee on Human Rights should attend the Commission on Human Rights which takes place in Geneva during March and April.

4. Presentation by Sierra Leone Ireland Partnership

The Committee heard a presentation from the Sierra Leone Ireland Partnership regarding the current situation in Sierra Leone. Representing the Partnership were Mr. Joe Manning, Chairman, Sr. Hilary Lyons, President, and Mr. Martin Rowan. The delegation was accompanied by His Excellency Mr. Ahmed Tejan-Jalloh, Sierra Leone High Commissioner to London and Mr. Sorie Fofang, Information Attaché. The presentation was followed by a question and answer session.

Arising from the presentation, the Committee agreed to make a strong recommendation to the Minister in favour of the addition of Sierra Leone to the priority country programme of Ireland Aid.

The Committee heard presentations from Goal and Concern regarding the humanitarian needs of the population in Iraq. Representing Goal was its Chief Executive, Mr. John O'Shea and Mr. Colin Lee. 3. Current Humanitarian Situation in Iraq

The Committee had a wide ranging debate on the current humanitarian situation in Iraq.

Before the commencement of the debate, the Chairman advised the meeting that the motion tabled by Deputy Higgins had been withdrawn in favour of the following motion in the names of Deputy Michael D. Higgins, Deputy Pat Carey and Deputy Gay Mitchell–

“The Joint Committee on Foreign Affairs:

• Noting with concern the reports of residual disorder in Baghdad and other cities in Iraq in which Iraqi civilians are losing their lives;
• Noting also the urgent need for supplies of drugs, medicines and essential hospital equipment;
• Aware of the overwhelming need for clean water, sanitation and food supplies;
• Recognising that over one million children in Iraq were already chronically malnourished before the war began;
• Regretting that disorder and looting have inflicted considerable damage to hospitals in Baghdad;
  
  • Calls on the International Committee of the Red Cross, in the discharge of its specific and unique responsibilities under the Geneva Conventions, to continue to cater for the needs of the citizens of Iraq in this time of conflict;
  • Calls on the Government and the European Union to support the International Red Cross in carrying out this work;
  • Calls for the UN to take the lead in the provision of humanitarian aid and assistance as quickly as they can access the areas where conflict has ceased;
  • Calls for the establishment of appropriate and accountable local structures for the distribution of foodstuffs and medicine to Iraqi citizens in need;
  • Calls on the UN Security Council for an immediate removal of sanctions;
  • Supports the Government's efforts to ensure that the United Nations is at the heart of Iraqi national recovery and reconstruction;
  • Calls for the immediate re-establishment of power and water supplies;
  • Calls for all parties to the conflict in Iraq to operate in line with their obligations under the Geneva Conventions, and notes that efforts have now begun to take action to curb looting and to protect vital establishments, particularly the hospitals;
  • Welcomes the initiative to bring about a return to work of vital workers in power supply, policing, public service and medical services;
  • Endorses the statement made by UNICEF on the establishment of power supplies in Baghdad, the delivery of life-saving humanitarian aid and the protection of children in danger, including the problem of landmines and unexploded ordnances; and
  • Welcomes the commitment to secure the heritage sites and artefacts and work with the European Union, the cultural arm of the United Nations, UNESCO, and others in work of restoration.

The Joint Committee wishes to be kept informed of the progress being made in these matters.”

The motion was agreed unanimously by the Committee.

The Committee heard presentations regarding the humanitarian crisis facing Ethiopia from a number of religious orders actively involved in the region. The Committee heard a presentation from Mr. Tyrone Fernando, Minister of Foreign Affairs, Sri Lanka regarding the prevailing situation in Sri Lanka. Mr. Fernando was accompanied by the Honorary Consul for Sri Lanka in Ireland, Dr. Aelred Samarakoon and the Ambassador Designate to Ireland, His Excellency Mr. Faisz Musthapha.

The presentation was followed by a question and answer session.

The meeting was suspended at 11.46am and resumed at 11.53pm.

6. Humanitarian Situation in Iraq - Presentation by the Irish Red Cross

A delegation from the Irish Red Cross addressed the Committee regarding the current humanitarian situation in Iraq. The delegation comprised of Mr. David Andrews, Chairman, Carmel Dunne, Secretary General and Aoife Mac Eoin, National Communications Officer.

The presentation was followed by a question and answer session.

Following the presentation, the following motion, tabled by Senator David Norris and seconded by Deputy Michael D. Higgins, was agreed by the Committee.

“That this Committee calls on the Minister for Foreign Affairs to use his good offices to try to ensure that the United States and the United Kingdom Governments meet their absolute moral obligation as well as their legal obligation under the 4^th Geneva Convention to provide the finest medical care and rehabilitative treatment for all the civilian casualties of their recent war in Iraq as a matter of the greatest urgency.”

The Committee also agreed the following motion on the humanitarian situation in Iraq in the name of the Chairman –

“The Joint Committee on Foreign Affairs, recalling its resolution of 16^th April 2003 and concerned about the humanitarian situation in Iraq calls on the occupying powers in Iraq -

to increase their efforts to provide adequate water and power for the population;

to provide proper medical facilities at least in line with the requirements of the fourth Geneva Convention so that optimum medical care can be given to the citizens of Iraq who have been injured in the recent war;

to work with the United Nations and the International Red Cross to ensure that all possible humanitarian assistance is given to those in need in the population;

to provide proper security for hospitals and other vital public infrastructures and for the staff who work in these places;

and to ensure that an efficient interim leadership and administration is put in place to secure the well-being of the people of Iraq.”

The Committee heard a presentation on the current situation in Zimbabwe from Mr. Roy Bennett MP, a member of the main opposition party of the Zimbabwean National Parliament, the Movement for Democratic Change. Mr. Bennett was accompanied by Mr. Monty Hunter. A question and answer session followed the presentation.

Arising from the presentation, it was agreed that the Chairman and the Secretariat would draft a motion in support of the opposition groups in Zimbabwe, to be conveyed to the Zimbabwean Embassy in London.

5. Current situation in Iraq – presentations by UNICEF Ireland and the Department of Foreign Affairs

The Committee heard presentations regarding the current situation in Iraq from Mr. David Donoghue and Ms. Aine Hearns from the Development Co-operation Division of the Department of Foreign Affairs and Ms. Maura Quinn and Ms. Julianne Savage from UNICEF Ireland. At the outset the Chairman advised the meeting that the Departments presentation would address the humanitarian situation in Iraq only, as both the Political Director and the Middle East Director from the Department were unable to attend the meeting due to prior commitments. The Department officials present undertook to take note of issues raised at the meeting regarding the political situation in Iraq (such as the current administrative arrangements and the absence of weapons of mass destruction) and bring these to the attention of the Minister.

The Committee had an exchange of views with Dr. Sein Win, Prime Minister of Burma (in exile) regarding the current situation in Burma. Dr. Win was accompanied by Dr. Thaung Htun (Dr Win's special representative on UN affairs) and Mr. Hugh Baxter, Mr. Martin Lacey and Mr. John Copley from Burma Action Ireland.

The Committee agreed to bring the issues raised during the discussion to the attention of the Minister, in particular the need for an early EU Troika mission to Burma, the advancing of the Burma issue at the UN Security Council and the adoption by the EU of further targeted sanctions against the regime. The Committee also expressed concern about the ongoing detention of Burma's opposition leader Ms. Aung San Suu Kyi. In view of the report given to the Committee by Dr. Win that Ms. Aung San Suu Kyi has now been hospitalised and isolated by the Army, the Committee agreed to call on the Red Cross to intervene again.

5. EU Scrutiny

Presentation by the Department of Foreign Affairs

The Committee heard a presentation from officials of the Department of Foreign Affairs regarding CFSP (2003) 651 – a Council Common Position of 12 September 2003 on the application of specific measures to combat terrorism – and in particular the decision to designate the political wing of Hammas as a terrorist organisation. Appearing before the Committee were Ms. Patricia O'Grady from the Departments International Terrorism Section and Mr. Tony Mannix from the Departments Middle East Section.

The presentation was followed by a question and answer session. Arising from the presentation, the officials agreed to provide the Committee with a full written briefing on this particular EU measure and the procedures surrounding it.

Correspondence from the Sub-Committee on European Scrutiny

The Committee considered correspondence from the Sub-Committee on European Scrutiny regarding two proposals examined falling within the remit of the Department of Foreign Affairs - COM (2003)581 repealing a previous regulation preventing the supply of certain goods to Libya and COM (2003)626 concerning certain restrictive measures in respect of Liberia. The Committee agreed with the recommendation of the Sub-Committee that no further scrutiny of these proposals was necessary. The Committee also noted a CFSP measure – CFSP(2003)735 – a Council Common Position concerning restrictive measures on Iraq.

4. Exchange of views with the Dalai Lama's Representative

The Committee had an exchange of views with Mrs. Kesang Takla, the Dalai Lama's London based representative for the UK, Ireland and Scandanavia. Mrs.Takla was accompanied by Neil Steedman and Anthony O'Brien from the Tibet Ireland Support Group. The discussion centred on the current situation in Tibet and on the present status of contacts between the Tibetan and Chinese governments, with particular reference to the two visits by envoys of the Dalai Lama to China and Tibet in the last year.

Arising from the discussion, the Committee expressed its unanimous support for the solution to the Tibetan problem proposed by the Dalai Lama – the ‘Middle way Approach’ - which does not call for the independence of Tibet or its separation from China, but would provide genuine autonomy for the Tibetan people. The Committee also agreed to -–

• invite the Department of Foreign Affairs to come before the Committee to clarify Ireland's position on Tibet;
• write to the Minister for Foreign Affairs to state the Committee's support for the appointment of an EU Special Representative for Tibet, and urging him to use Irelands Presidency of the EU to achieve this goal;
• invite the Chinese Ambassador to discuss the current situation in Tibet with the Committee;
• write to the Chinese Ambassador to inquire about the status and well-being of the political prisoners referred to during the presentation, and the location and well-being of the Panchen Lama and his parents.

5. EU Scrutiny

The Committee considered correspondence from the Sub-Committee on European Scrutiny regarding one proposal examined falling within the remit of the Department of Foreign Affairs – COM (2003) 627 - a Proposal for a Regulation of the European Parliament and of the Council on development cooperation with South Africa.

The Committee agreed with the recommendation of the Sub-Committee that no further scrutiny of these proposals was necessary. The Committee also noted a CFSP measure – CFSP (2003) 805 - Common Position on the Universalisation and Reinforcement of Multilateral Agreements in the Field of Non-proliferation of Weapons of Mass Destruction and Means of Delivery

It was agreed that the Sub-Committee would meet once every four weeks, with exceptions if required, on weeks that the Joint Committee is not scheduled for a meeting. Members expressed a preference for the 12 noon slot on Thursdays.

It was agreed that the Chairman would have informal discussions with the Chairman of the Joint Committee and the sub-Committee on Human Rights with a view to putting proposals before the Committee on a work programme for the sub-Committee without duplicating the work of the Joint Committee or the other sub-Committee. The Committee noted Deputy O'Donnell's proposal that the Sub-Committee should monitor and encourage the Department of Foreign Affairs in the implementation of the aid programme as it expands to meet the UN target in 2007.

The Sub-Committee heard a presentation from a group of Columbian Development NGOs, who were undertaking an exposure visit to Ireland , organised by Trócaire and co-funded by Ireland Aid. The presentation addressed rural development policies, the impact of Plan Columbia in rural communities and peacebuilding efforts from civil society. Mr. Jose Giron, Institute of Popular Education, Columbia made the presentation on behalf of the delegation. Ms Patty Abozalgo, Latin American Programme Officer from Trocaire, acted as interpreter.

The presentation was followed by a question and answer session.

The Sub-Committee heard a presentation from Dóchas regarding the level of resources allocated for Official Development Assistance and the issue of progression towards the UN target of 0.7% of GNP. Appearing before the Committee were Mr. Colin Roche and Mr. Oisin Coughlan.

Arising from the presentation and on foot of a proposal by Deputy Higgins unanimously supported by the Sub-Committee, it was agreed that the Sub-Committee should call the Government to make a commitment in the next budget to annual incremental increases in Official Development Assistance to ensure that Ireland can meet its commitment to achieve the UN target of 0.7% of GNP by 2007 and also recommending that the ODA programme should be separated from the yearly budgetary/estimates process and a ring-fenced multi-annual budget put in place to ensure that Ireland can meet its commitment to achieve the UN target by 2007.

4. Correspondence

The Chairman referred to correspondence from Minister Tom Kitt acknowledging the Sub-Committee's recommendations for a commitment to annual incremental increases in ODA and a multi annual budget approach.

5. Presentation by Trade Matters Group

The Sub-Committee heard a presentation from a delegation from the Trade Matters Group. The Group were concerned about the implications for Ireland's trade and development policies following a disappointing outcome from the Cancun WTO meeting. Appearing before the Committee were Colin Roche (Oxfam Ireland), Oisin Coghlan (Christian Aid Ireland), and Conall O'Caoimh (Cohmhlamh).

Arising from the presentation, the Sub-Committee agreed the following resolution –

“In the light of the failure of the Cancun Ministerial of the World Trade Organisation to advance the Doha Development Agenda the Sub-Committee on Development Cooperation –

• Requests the Minister for Overseas Development, Mr Tom Kitt TD, set out a strengthened mechanism for coherence, bringing together on a regular basis the departments relevant to Irelands trade policy which shall operate for the duration of the ‘Development Round’ of trade negotiations and outline how the necessary resources will be put in place to ensure its functioning;
• Shall consider the draft national Trade Policy Statement before its finalisation and request Development Cooperation Ireland information on its input to the Statement;
• Recommends to the relevant Ministers that Ireland supports the removal of the Singapore Issues from the table in order to reinvigorate talks and return them to the agreed priorities of the Doha Development Round such as Agriculture, Implementation, Special and Different Treatment, Trade Related Intellectual Property Rights, and other such priorities”.

The Committee also undertook to seek clarification on the operation and transparency of decision-making in the EU Committee 133.

It was noted that there was an UMTAD meeting taking place during the Irish Presidency of the EU in June 2004, and the Sub-Committee undertook to debate the UMTAD reports before then.

5. Presentation by COMHLÁMH

The Committee heard a presentation from Mr. John Slattery, Comhlámh and Mr. Paul Goodison, European Research Office, Brussels on international agricultural trade and food security policies and their impact on the majority World.

The presentation was followed by a question and answer session.

It was then agreed that the Committee would invite the three Government Ministers who attended the Cancun World Trade Summit to come before the Committee to discuss decisions made regarding trade with developing countries.

Deputy Michael Noonan proposed that the recommendations drawn up by the European Research Office on behalf of Comhlámh, and circulated to the Committee members, be endorsed fully and sent to the Minister for Foreign Affairs with a recommendation from the Committee that they be acted on. The proposal was seconded by Deputy Michael D. Higgins and adapted unanimously by the Committee.

The Clerk sought nominations for the position of Chairperson. Senator Paul Bradford was nominated by Deputy Davern and seconded by Senator Mooney. Senator Bradford's election was unanimous and he took the Chair.

The Chairman advised that he anticipated the Sub-Committee meeting every four weeks (with exceptions if required). A timeslot was available at 12pm on the Thursdays when the Joint Committee and the other Sub-Committee were not meeting. A start-time of 10am was requested for such Thursdays, and the Chair undertook to send the request to the Working Group of Committee Chairmen.

Senator Mooney requested that the Sub-Committee's precedent regarding travel to the Human Rights Commission in Geneva be maintained. Deputy Higgins suggested that the Sub-Committee focus its efforts on a particular theme of Human Rights (eg Child Soldiers or the Protection of Children in Wartime), and pursue this theme with any travel to Geneva. The Chair advised that the finances available for travel were extremely constrained, but undertook to bring the request to the Chair of the Joint Committee.

Deputy Davern proposed Senator Mooney as Vice-Chair (Deputy O'Connor seconded), and the Sub-Committee agreed to his election.

3. Presentation by Mr Billy Colbert and Support Group (on behalf of Mr Roger Collins, who is a Death Row Prisoner in Georgia, USA).

The Sub-Committee heard a presentation from Mr Billy Colbert in support of Mr Roger Collins. Representing the Support Group were Mr Aidan O'Leary and Mr Alan Smith. The presentation was followed by a question and answer session.

Arising from the presentation, the Sub-Committee agreed to write to the Governor for Georgia, requesting that clemency be exercised in this case (in view of Mr Collins' mental retardation issues, his 24 years already spent on Death Row, and in respect of the allegedly poor standards of legal representation in his case).

4. Proposed UN Convention on the Rights of Persons with Disabilities

The Committee heard presentations from Professor Gerard Quinn (Irish Human Rights Commission), Dr Kirsten Young (Landmine Survivors Network), and Mr Stefan Tromel (European Disability Forum) regarding the drafting of a UN Treaty on the Rights of the Disabled. The presentations were followed by a question and answer session.

Arising from the presentation, it appeared that elements within the Department of Justice, Equality, Defence & Womens' Rights opposed Ireland's participation in a common EU position on this UN Convention. Kirsten Young pointed out that whereas Ireland historically had always sponsored Resolutions on Disabilities at the UN Commission in Human Rights in Geneva, this year we had not. Deputy Higgins noted that whereas briefing material on this subject was made available to the Sub-Committee from Department of Foreign Affairs, none appeared available from Department of Justice, Equality, Defence & Womens' Rights.

The Sub-Committee agreed to act promptly, and invite the Minister for Justice, Equality, Defence & Womens' Rights, together with Minister Kitt, to attend the next meeting of the Sub-Committee to clarify the Government's position. The Sub-Committee also agreed to send the following motion to the main Joint Committee on Foreign Affairs, viz.

“The Sub-Committee on Human Rights supports the adoption of the United Nations Convention on Disabilities, and recommends the Irish Government, in accordance with its opening position, play a lead role at EU level to achieving a common EU position toward the achievement of a United Nations Treaty on the Human Rights of Persons with Disabilities.”

4. Proposed UN Convention on the Rights of Persons with Disabilities

The Chairman conveyed apologies received for the non-attendance of Ministers Kitt and McDowell. Deputy Higgins objected strongly to the very late notification to the Sub-Committee of Minister McDowell's absence. As time is of the essence with this disability issue, he viewed the Minister's offer to attend at another occasion as poor consolation. Both Deputies Carey and Neville also voiced disappointment at the Minister's absence.

As both Ministers had sent representatives to the meeting, the Sub-Committee heard presentations from the Human Rights Division⁹ of the Department of Foreign Affairs. They also heard from the Disability Equality Unit¹⁰ in the Department of Justice, Equality and Law Reform. Both presentations were followed by a question and answer session.

The Sub-Committee noted that the issues involved were highly political, and it was not satisfied that Officials be sent to answer on political matters. It agreed to re-invite Minister McDowell to its next meeting, preferably before the UN Ad Hoc Committee meets again from 16^th to 26^th June.

5. Foreign Travel

The Sub-Committee agreed the contents of the Draft Report on the visit to Geneva.

6. Any other business

The Sub-Committee noted that presentations from Burma Ireland and The West Papua Support Group now needed re-scheduling, and it was agreed to invite them to present at the next available date.

4. Proposed UN Convention on the Rights of Persons with Disabilities

The Minister for Justice, Equality and Law Reform attended the meeting, and outlined the Government's position on this issue. His presentation was followed by a question and answer session.

5. Presentation by Burma Action Ireland

The Sub-Committee heard a presentation regarding the current situation in Burma. The presentation was followed by a question and answer session.

Arising from the presentation, the Sub-Committee passed the following resolution.

“The Sub-Committee on Human Rights urges the Minister for Foreign Affairs to-

• Call upon the ruling military regime in Burma to release Daw Aung San Suu Kyi at once and begin substantial talks as soon as possible;
• Call on the UN to upgrade its role in bringing about a smooth and orderly political transition in Burma which will include the scrutiny by the Security Council of the obstacles standing in the way of a peaceful resolution of the protracted conflict in Burma, and their removal thereon;
• Call upon the UN, the USA, the EU, and members of the international community to seriously focus on the establishment of an effective political mechanism and a roadmap that will move the dialogue process forward, leading to an orderly and peaceful democratic transition and regime-change in Burma, as aspired to by the people, and which the regime also claims to be committed to;
• Call upon the EU and other governments and leaders to send the military junta a very clear message as the USA has recently done via a ban on imports from Burma;
• Call upon the governments of the EU to urge Burma's neighbours at joint EU-ASEAN consultations and at every opportunity available to work closely with the international community and to firmly persuade a member government – Burma's military junta – to contribute constructively to Burma's transition to democracy, as agreed upon and aspired to by all stakeholders in Burma.”

It was agreed to send this motion to the Department of Foreign Affairs, to the EU General Council Of Ministers for Foreign Affairs, and to the UN Commission for Human Rights. It was also agreed to press Ireland Aid for increased funding for the cause of Burma.

5. Presentation by the West Papua Support Group

The Sub-Committee heard a presentation regarding the current situation in West Papua. The Chairman read a letter from West Papua Action, who sought to clarify that they are a separate group from the West Papua Support Group. The presentation was followed by a question and answer session.

Arising from the presentation, the Sub-Committee passed the following resolution.

“The Sub-Committee on Human Rights urges the Minister for Foreign Affairs to -

• Request that the UN Secretary General instigate a review of the UN's conduct in relation to the 1969 ‘Act of Free Choice’;
• Call on the Indonesian authorities to immediately withdraw military forces from the highland region of West Papua and allow human rights workers and humanitarian aid into the area;
• Call on the UNHCR and the governments of Papua New Guinea, Australia and Indonesia to treat all West Papuan Border Crossers as legitimate Asylum Seekers, and give them the full rights of refugees as laid out in the UNHCR 1951 Convention relating to the Status of Refugees and the 1967 protocol;
• Request that the Irish Government support the call for military sanctions, and put pressure through the UN and EU for other governments to implement military sanctions;
• Urge the Indonesian authorities to conduct credible investigations into crimes against humanity, according to international standards of justice and fairness;
• Consider that Ireland looks favourably on Papuans seeking asylum in Ireland.”

It was agreed to send this motion to the Department of Foreign Affairs and to the Decolonisation Committee of the UN. It was also agreed to apply to the Joint Committee on Foreign Affairs for funding to send a delegation to visit West Papua.

Matters arising

The Chairman advised the meeting that he had spoken with the Chairman of the Joint Committee regarding a fact-finding mission to West Papua and had been advised that no funds were available for such a visit. Senator Mooney expressed concern that the lack of funds available for Committee travel was restricting the Work Programme of the Sub-Committee and in particular that the Sub-Committee had not been allocated a share of the travel budget of the Joint Committee. The Chairman agreed to raise this issue with the Chairman of the Joint Committee.

4. Presentation by the Ethiopian National Congress

The Sub-Committee heard a presentation from the Ethiopian National Congress (ENC) regarding the current human rights situation in Ethiopia. Appearing on behalf of the ENC were Ms. Tsehai Berhane-Selassie and Mr. Peter Esmonde. The presentation was followed by a question and answer session.

The Committee agreed to bring the issues raised during the presentation to the attention of the Joint Committee, which had made Ethiopia a priority in their Work Programme.

1. Taking close note of the high rates of voter abstention in the referendum and the results of the municipal and departmental elections of 25 and 26 October 2003, which signify an important change in the Colombian political environment,
2. Expressing hope that the election results will contribute to the strengthening of and respect for formal democratic structures in Colombia,
3. Sharing the concern expressed in 2003 by Mary Robinson in her role as United Nations High Commissioner for Human Rights, for the continued blurring of the principle of distinction between combatants and non-combatants in Colombia and for the security policies that aim to involve the civilian population in the hostilities through the creation of networks of informers and peasant soldiers,
4. Considering the observations of the Office of the United Nations High Commissioner for Human Rights (UNHCHR) which indicate the contradictions with international human rights treaties contained within the Bill which grants judicial police powers to the Armed Forces and restricts several constitutional guarantees, and in the Bill “which pronounces provision to reincorporate members of the armed groups which may contribute in an real manner to national peace”,
5. Condemning vigorously the deliberate attacks by all the actors in the internal armed conflict against the civilian population, especially acts of terrorism, murders, forced disappearances, forced displacement and kidnapping,
6. Condemning firmly any kind of public declaration or pronouncement which seeks to discredit and threaten the work of human rights NGOs, creating a climate of hostility which exposes human rights defenders to greater risks,

the Sub-Committee recommends that the Government -

1. Express its most emphatic condemnation of the murder of Esperanza Amaris Miranda, member of the NGO the Popular Women's Organisation (Organización Femenina Popular), at the hands of paramilitaries in the city of Barrancabermeja, seat of the Peace Laboratory supported by the European Union,
2. Remind the Government of Colombia of its obligation to dismantle paramilitary groups, penalize those responsible for committing crimes and sever the links between these groups and civil servants, as has been reiterated by the United Nations,
3. Express its support for the legitimate work of human rights NGOs, reiterating the conclusions of the Council of Ministers of the European Union of December 2002 and requesting that the Government of Colombia respect and support human rights defenders, investigating and penalizing those responsible – including civil servants – for threats and attacks against NGOs,
4. Urge the FARC-EP and the ELN to immediately and unconditionally free all hostages as a demonstration of goodwill towards a search for a negotiated solution to the conflict,
5. Urge the Colombian Government to revise the Bills that the United Nations considers incompatible with international human rights norms,
6. Request that the European Union continue to support the search for a political negotiated solution in Colombia, taking into account that any demobilisation process respect the principles of truth, justice and reparation which protect the victims and society in general,
7. Reaffirm its support to the business of the United Nations in Colombia and renew its support to the Office of the United Nations High Commissioner for Human Rights,
8. Ask that the European Union follow up the commitments signed by the Government of Colombia before the international community in the Declaration of the London Meeting on International Support for Colombia on 10 July 2003: the search for a negotiated solution, the early implementation of the recommendations of the United Nations and the effective protection of human rights NGOS, social leaders and trade unionists,
9. Request that the Member States of the European Union recommend to the next United Nations Human Rights Commission that the report on Colombia be presented to the General Assembly of the United Nations in 2004,
10. Pass on this Resolution to the Members States of the European Union, candidate countries and to the Government of Colombia.

It was agreed that the resolution should be forwarded to the Minister for Foreign Affairs, with a request that the proposals set out in the resolution be given priority during the Irish EU Presidency and requesting that the Department of Foreign Affairs provide the Sub-Committee with regular reports on human rights breaches in Colombia, and in particular regarding the killing and intimidation of trade union and human rights activists.

Proceedings of the Sub-Committee - Thursday 4^th December 2003

1. The Sub-Committee met at 10a.m. in Committee Room 2, Leinster House 2000.

2. Attendance

The following Members were present:

3. Minutes

The minutes of the meeting held on 5^th November 2003 were agreed.

4. Presentation by Pavee Point Travellers Centre and the Irish Centre for Human Rights

The Sub-Committee heard presentations from the Pavee Point Travellers Centre and the Irish Centre for Human Rights of NUI Galway regarding the apparent de-recognition of Travellers as an ethnic group, as stated in the Governments First National Report to the UN Convention on the Elimination of All Forms of Racial Discrimination. Appearing before the Committee were Brid O'Brien from the Pavee Point Travellers Centre, David Joyce from the Irish Traveller Movement and Dr. Joshua Castellino and David Keane from the Irish Centre for Human Rights

The presentation was followed by a question and answer session. Arising from the presentations, it was agreed to bring the views expressed at the meeting to the attention of the Minister for Justice and to the request the Minister of his officials to attend the next meeting of the Committee.

5. Correspondence

The Committee noted correspondence from the Inter Parliamentary Union regarding individual human rights cases involving members of parliament.

WORK PROGRAMME 2004

Introduction

The Joint Committee on Foreign Affairs was established following an order of the Dáil on 16^th October 2002 and of the Seanad on 17^th October 2002. Standing Orders of both Houses require that

“As soon as may be following its appointment and thereafter at annual interval, each Select Committee shall prepare a work programme and shall lay such programme before Dáil (Seanad) Éireann” (S.O. 84(4) [Dáil] and S.O. 67(4)[Seanad]).

Number and Frequency of Meetings

Taking account of the resources and facilities available to the Joint Committee on Foreign Affairs and the commitments of members, it is anticipated that the Joint Committee will be in a position to hold some 20 meetings (meeting fortnightly) in the course of 2004. The Sub-Committees on Development Co-operation and Human Rights expect to hold 10 meetings each during the course of the year.

In view of the specific functions of the Select Committee on Foreign Affairs, it is not possible to anticipate the number of meetings required over the coming 12 months. It is likely that a minimum of 2 meetings will be required to consider Estimates for the Public Service relating to the Department of Foreign Affairs.

Orders of Reference of the Joint Committee on Foreign Affairs

Paragraph (2) (a) of the Order of Dáil Éireann of 16^th October 2002 and paragraph (1) (a) of the Order of Seanad Éireann of 17^th November 2002, empowers the Joint Committee to consider—

1. such public affairs administered by the Department Foreign Affairs as it may select, including, in respect of Government policy, bodies under the aegis of that Department;
2. such matters of policy for which the Minister for Foreign Affairs is officially responsible as it may select;
3. such related policy issues as it may select concerning bodies which are partly or wholly funded by the State or which are established or appointed by Members of the Government or by the Oireachtas;
4. such Statutory Instruments made by the Minister for Foreign Affairs and laid before both Houses of the Oireachtas as it may select;
5. such proposals for EU legislation and related policy issues as may be referred to it from time to time, in accordance with Standing Order 81(4);
6. the strategy statement laid before each House of the Oireachtas by the Minister for Foreign Affairs pursuant to section 5(2) of the Public Service Management Act, 1997, and the Joint Committee shall be so authorised for the purposes of section 10 of that Act;
7. such annual reports or annual reports and accounts, required by law and laid before either or both Houses of the Oireachtas, of bodies specified in paragraphs 2(a)(i) and (iii), and the overall operational results, statements of strategy and corporate plans of these bodies, as it may select;

Provided that the Joint Committee shall not, at any time, consider any matter relating to such a body which is, which has been, or which is, at that time, proposed to be considered by the Committee of Public Accounts pursuant to the Orders of Reference of that Committee and/or the Comptroller and Auditor General (Amendment) Act, 1993;




Provided further that the Joint Committee shall refrain from inquiring into in public session, or publishing confidential information regarding, any such matter if so requested either by the body or by the Minister for Foreign Affairs;



8. such aspects of Ireland's international relations as it may select; and
9. such other matters as may be jointly referred to it from time to time by both Houses of the Oireachtas, and shall report thereon to both Houses of the Oireachtas,

Provided that any consideration by the Joint Committee, or a sub-Committee, of security issues relating to Northern Ireland shall be in private session and the provisions of Standing Order 91 shall apply.”

Accordingly, the items listed in this Work Programme will be considered by the Joint Committee within the parameters defined by the Orders of Reference of the Joint Committee, as amended from time to time.

Order of Consideration of items and Amendment of Work Programme of Joint Committee on Foreign Affairs

The items listed for consideration in this Work Programme are not in any order of priority. The Joint Committee is of the opinion that to accord a strict priority and agree a timetable for consideration of the various items would impose a rigid structure that would not enable the Joint Committee to respond to events that may or may not occur in the course of the year. As the Committee could not be required to anticipate all developments in the areas falling within its remit, it has agreed that, in response to a particular event, it shall, if it deems it necessary to do so, amend this Work Programme to include further items or delete or revise existing items for consideration. Any such amendment of this Work Programme shall be laid before both Houses of the Oireachtas as soon as may be following such amendment.

However, insofar as it is possible, the Joint Committee, in conjunction with the Sub-Committees on Development Co-operation and Human Rights, hopes to focus its efforts on the following selected items –

• The humanitarian situation in Africa, with particular reference to Uganda and Ethiopia, and the development of the African Union and NEPAD;
• The ongoing situation in Iraq;
• The quest for a peaceful, secure and satisfactory political solution to the conflict between Israel and Palestine;
• Ireland's official policy towards Burma and Tibet;
• The plight of Irish Emigrants in the UK and the US;
• Monitoring of the Official Development Aid budget and the expansion of the Development Co-operation Ireland programme;
• Aid/Trade/Debt and the least developed countries;
• Irelands role in UN Peacekeeping;
• Reform of the UN;
• Human rights;
