IMEACHTAÍ AN CHOISTE SPEISIALTA.PROCEEDINGS OF THE SPECIAL COMMITTEE.Dé Céadaoin, 18 Feabhra, 1976.Wednesday, 18th February, 1976.1. The Committee met at 4 p.m. 2. Members Present. The following members were present:— Deputy Barry Desmond (in the Chair), the Minister for Health, Deputies Briscoe, Byrne, Esmonde, Hugh Gibbons, Fergus O’Brien and O’Connell. 3. Consideration of Bill. The Committee resumed consideration of the Bill. (i) Section 5. The following amendment had been proposed by Deputy Haughey on 4th February. “In page 7, subsection 2 (b), line 2, before ‘manufacture’ to insert ‘import, export, transport,’”. Amendment negatived. Amendment proposed (Deputy Byrne): “In page 7, after line 7, to insert a new subsection as follows: ‘A medical practitioner shall keep in relation to every prescription issued for controlled drugs a separate record specifying (i) the quantity of controlled drugs prescribed, and (ii) the name of the person for whom they are prescribed and shall permit such record only to be inspected by any person authorised by the Minister.’” Amendment, by leave, withdrawn. Section, as amended, agreed to. (ii) Section 6. Amendment proposed (Minister for Health): “In page 7, subsection (1), line 8, to delete ‘qualified person’ and substitute ‘practitioner or pharmacist’.” Amendment agreed to. Amendment proposed (Deputy Briscoe): “In page 7, line 13 to delete ‘may’ and substitute ‘shall’”. Amendment, by leave, withdrawn. Amendment proposed (Minister for Health): “In page 7, subsection (2), lines 16 and 17, to delete ‘qualified person is a registered medical practitioner, a registered dentist or a registered veterinary surgeon’ and substitute ‘direction relates to a practitioner’.” Amendment agreed to. Amendment proposed (Minister for Health): “In page 7, subsection (2), lines 23 and 24, to delete ‘any other case, be a direction prohibiting the qualified person’ and substitute ‘case the direction relates to a pharmacist, be a direction prohibiting him’.” Amendment agreed to. Amendment proposed (Deputy Briscoe): “In page 7, subsection (4), line 35, to add ‘and in at least two recognised medical journals’.” Amendment, by leave, withdrawn. Amendment proposed (Deputy Byrne): “In page 7, between lines 35 and 36 to insert the following subsection: ‘The Minister shall cause a copy of any direction under this section to be circulated to each qualified person, each health board and to the National Advisory Committee on the Misuse of Drugs and to each sub-committee of that Committee’.” Amendment, by leave, withdrawn. Section, as amended, agreed to. (iii) Section 7. Amendment proposed (Deputy Byrne): “In page 7, line 43, after ‘irresponsible manner’ to insert ‘or in any way which could facilitate the misuse of drugs’.” Amendment, by leave, withdrawn. Amendment proposed (Deputy Byrne): “In page 7, after line 53, to insert a new subsection as follows: ‘(3) The Minister shall cause notice of any special direction given by him under subsection (1) of this section to be published in the Iris Oifigiúil’.” Amendment, by leave, withdrawn. Amendment proposed (Minister for Health): “In page 12, subsection (1), to insert ‘direction under the said section 6 (2),’ before ‘special direction’ in line 8.” Amendment agreed to. Amendment proposed (Minister for Health): “In page 12, subsection (1), to insert ‘direction under the said section 6 (2),’ before ‘special direction’ both in line 11 and line 15.” Amendment agreed to. Amendment proposed (Minister for Health): “In page 12, subsections (2) and (3), to insert ‘direction under section 6 (2), of this Act,’ before ‘special direction’ both in line 17 and line 21’.” Amendment agreed to. Section, as amended, agreed to. (viii) Section 12 agreed to. (ix) New section. Amendment proposed (Deputy Byrne): “In page 12, before section 13, to insert a new section as follows: ‘(1) For the purpose of preventing the misuse of drugs, the Minister shall, as soon as may be after the passing of this Act, make provisions for the introduction of standard prescription forms which shall be used by every registered medical practitioner, registered dentist, registered veterinary surgeon and every person employed or engaged in dispensing medicines at any hospital or health clinic. (2) Standard prescription forms shall be in such form as the Minister shall prescribe by regulations. (3) Regulations shall also be made requiring that every prescription form be stamped with a prescribed stamp.’” Amendment, by leave, withdrawn. (x) Section 13. Amendment proposed (Minister for Health): “In page 12, subsection (1), line 39, to delete ‘qualified person’ and substitute ‘person who is either a practitioner or a pharmacist.’.” Amendment agreed to. Section, as amended, agreed to. (xi) Section 14 agreed to. Further consideration of the Bill adjourned. 4. Adjournment.
