PROCEEDINGS OF THE SPECIAL COMMITTEE.

1. The Committee met at 3.45 p.m.


2. Members Present.


The following members were present:—


Deputy Barry Desmond (in the Chair), the Minister for Health, Deputies Briscoe, Byrne, Esmonde, Haughey, Ciarán Murphy, Fergus O’Brien and John O’Connell.


3. Consideration of Bill.


The Committee resumed consideration of the Bill.


(i) Section 19.


The following amendment had been proposed by Deputy Byrne on 3rd March:


“In page 14, subsection (1), between lines 13 and 14, to insert:


‘(f) the injection, application, oral intake, or inhalation of a controlled drug.’.”


Amendment, by leave, withdrawn.


Amendment proposed (Deputy Byrne):


“In page 14, subsection (2), line 22, after ‘offence’ to insert ‘the occupier of or present on, or’.”


Amendment amended, by leave, by the deletion of “present on, or”.


Amendment, as amended, agreed to.


Section, as amended, agreed to.


(ii) Section 20.


Amendment proposed (Deputy Byrne):


“In page 14, between lines 43 and 44, to insert the following:


‘(4) Where a country requests the surrender of a person who is being proceeded against in that country for an offence punishable under a corresponding law in force in that country or who is wanted in that country for the carrying out of a sentence, that person shall in accordance with the provisions of the Extradition Act, 1965 be surrendered to that country.’.”

Section agreed to.


(iii) New section.


Amendment proposed (Deputy Byrne):


“In page 14, before section 21, to insert a new section as follows:


‘Where an alien is convicted of any offence under this Act, or of attempting to commit any such offence, the Court shall by order provide for the deportation and exclusion of such alien from the State.’.”

(iv) Section 21.


Amendment proposed (Deputy Byrne):


“In page 14, between lines 47 and 48, to insert the following subsection:


‘Any person who supplies any plant, material or any aid to the cultivation of a controlled drug or who knowingly assists in the cultivation, harvesting or distribution of a controlled drug shall be guilty of an offence’.”

Amendment proposed (Deputy Byrne):


“In page 15, after line 27, to insert a new subsection as follows:


‘(8) Any person who, except under and in accordance with a licence, permit or authorisation under this Act, prints, sells or distributes literature containing drug formulae or details of preparation of any controlled drug shall be guilty of an offence’.”
