IMEACHTAÍ AN CHOISTE SPEISIALTA.PROCEEDINGS OF THE SPECIAL COMMITTEE.Dé Céadaoin, 17 Nollaig, 1975.Wednesday, 17th December, 1975.1. The Committee met at 4.15 p.m. 2. Members Present. The following members were present:— Deputy Barry Desmond (in the Chair), the Minister for Health, Deputies Byrne, Esmonde, Hugh Gibbons, Haughey, Loughnane, O’Connell, Toal and Wyse. 3. Consideration of Bill. The Committee resumed consideration of the Bill. (i) New section. The following amendment had been proposed by Deputy Haughey on 3rd December: “In page 5 to insert the following new section before section 3. ‘3.—(1) Subject to section 4 (3) of this Act a person shall not have a Category I or Category II controlled drug or apparatus commonly used for its injection in his possession. (2) Subject to section 4 (3) of this Act a person shall not administer to himself or any other person a Category I or Category II controlled drug. (3) A person who contravenes the provisions of this section shall be guilty of an offence.’” Amendment, by leave, withdrawn. (ii) Section 3. Amendment proposed (Minister for Health): “In page 5, subsection (1), to insert ‘subsection (3) of this section and’ before ‘section 4 (3)’ in line 44.” Amendment agreed to. Amendment proposed (Minister for Health): “In page 5, between lines 48 and 49, to add to the section the following subsections: ‘(3) The Minister may by order declare that subsection (1) of this section shall not apply to a controlled drug specified in the order, and for so long as an order under this subsection is in force the prohibition contained in the said subsection (1) shall not apply to a drug which is a controlled drug specified in the order. (4) The Minister may amend or revoke an order under this section (including an order made under this subsection). (5) Subsection (6) of section 2 of this Act shall apply to an order under this section in like manner as it applies to an order under that section.’”. Amendment amended, by leave, by the deletion of subsection (5). Amendment, as amended, agreed to. Section, as amended, agreed to. Further consideration of the Bill adjourned. 4. Adjournment. The Committee adjourned at 6 p.m. until 3 p.m. on Tuesday, 20th January, 1976. |
