PROCEEDINGS OF THE SPECIAL COMMITTEE.

1. The Committee met at 4.30 p.m.


2. Members Present.


The following members were present:—


Deputy Barry Desmond (in the Chair), the Minister for Health, Byrne, Esmonde, Hugh Gibbons, Haughey, Hogan-O’Higgins, Fergus O’Brien, O’Connell, Toal and Wyse.


3. Consideration of Bill.


The Committee resumed consideration of the Bill.


(i) Section 2.


The following amendment had been proposed by Deputy Haughey on 26th November:


“To delete subsection (6).”


Amendment agreed to.


Amendment proposed (Deputy Byrne):


“In page 5, after line 43, to insert the following subsection:


‘Where the Government consider that there are grounds for making an order under this section and that the circumstances require that the order be made as a matter of urgency, the Government shall make a temporary order and such order shall remain in force for a period of ninety days unless before the expiration of that period, a resolution approving of the order has been passed by each House of the Oireachtas.’”


Amendment, by leave, withdrawn.


Section, as amended, agreed to.


(ii) New section.


Amendment proposed (Deputy Haughey):


“In page 5 to insert the following new section before section 3.


‘3.—(1) Subject to section 4 (3) of this Act a person shall not have a Category I or Category II controlled drug or apparatus commonly used for its injection in his possession.


(2) Subject to section 4 (3) of this Act a person shall not administer to himself or any other person a Category I or Category II controlled drug.


(3) A person who contravenes the provisions of this section shall be guilty of an offence.’”


Debate ensued.


Further consideration of the Bill adjourned.
