IMEACHTAÍ AN CHOISTE

PROCEEDINGS OF THE COMMITTEE

Déardaoin, 24 Meitheamh, 1971.

1. Chruinnigh an Coiste ar 4 p.m.

2. Comhaltaí i Láthair.

Bhí na comhaltaí seo a leanas i láthair:—

An Teachta Pádraig Ó hÓgáin (i gCeannas), na Teachtaí R. de Búrca, Mac Gearailt, Céitinn, Mac Searraigh agus Ó Tonnaigh.

3. Bhí E. P. Sutail (An tArd-Reachtaire Cuntas agus Ciste) i láthair i gcáil chomhairleach.

4. Rinne an Coiste breithniú.

5. Ordaíodh: go ndéanfadh an Coiste, ag a chéad chruinniú eile, breithniú ar an tairiscint seo a leanas ar thug na Teachtaí Mac Searraigh agus Ó Tonnaigh fógra faoi le linn an chruinnithe:

“That the Committee should cease its inquiry and refer the matter back to the Dáil for the following reasons:—

(i)That part of the Act passed by Dáil Éireann to give it extra powers for this enquiry is found now to be repugnant to Article 38 of the Constitution,

(ii)That the Supreme Court feel that the Committee should have allowed witnesses to be legally represented and have the right to cross examination,

and that unless otherwise directed by the Dáil, the Committee should not proceed further.”
