IMEACHTAÍ AN CHOISTEPROCEEDINGS OF THE COMMITTEEDéardaoin, 24 Meitheamh, 1971.Thursday, 24 June, 1971.1. The Committee met at 4 p.m. 2. Members Present. The following members were present:— Deputy Patrick Hogan (in the Chair), Deputies R. Burke, FitzGerald, Keating, MacSharry and Tunney. 3. Mr. E. F. Suttle (Comptroller and Auditor General) was in attendance in an advisory capacity. 4. The Committee deliberated. 5. Ordered: that at its next meeting, the Committee consider the following motion of which notice was given during the meeting by Deputies MacSharry and Tunney: “That the Committee should cease its inquiry and refer the matter back to the Dáil for the following reasons:— (i)That part of the Act passed by Dáil Éireann to give it extra powers for this enquiry is found now to be repugnant to Article 38 of the Constitution, (ii)That the Supreme Court feel that the Committee should have allowed witnesses to be legally represented and have the right to cross examination, and that unless otherwise directed by the Dáil, the Committee should not proceed further.” 6. Adjournment. The Committee adjourned at 6.15 p.m. until 4 p.m. on Tuesday next. |
