PROCEEDINGS OF THE COMMITTEE

1. The Committee met at 7.30 p.m.


2. Members Present.


The following members were present:—


Deputy Patrick Hogan (in the Chair), Deputies Barrett, R. Burke, E. Collins, Dowling, FitzGerald, H. Gibbons, Nolan and Treacy.


3. Mr. E. F. Suttle (Comptroller and Auditor General) was in attendance in an advisory capacity.


4. The Committee considered counsel’s opinion on form of reply to Colonel Hefferon’s letters* of 11 and 14 November 1971.


Ordered: (i) that the Minister for Agriculture and Fisheries be asked whether the note handed in by him on 22 April during his evidence was specifically protected by the Official Secrets Act (ii) that


a similar inquiry be made to the Garda Commissioner Mr. Wymes* and Assistant Commissioner Mr. Malone in relation to the evidence given by them in private and (iii) that Colonel Hefferon be informed that he had been granted permission to cross-examine the Minister for Agriculture and Fisheries.


5. Consideration of the form of a draft Final Report was resumed.


6. Ordered: that Aer Lingus be requested to furnish the invoice related to the payment of £166.12.0. for return Dublin-London air fares.††


7. Adjournment.


The Committee adjourned at 10 p.m. until 4 p.m. tomorrow.
