PROCEEDINGS OF THE COMMITTEE

1. The Committee met at 4 p.m.


2. Members Present.


The following members were present:—


Deputy Patrick Hogan (in the Chair), Deputies R. Burke, E. Collins, Dowling, FitzGerald, MacSharry, Nolan and Tunney.


3. The Committee went into public session.


4. Mr. T. Smyth, B.L. and Mr. M. E. Marren, solicitor were present as advisors to the Committee during the cross-examination of Captain Kelly.


5. Mr. H. Hickey, S.C. with Mr. H. O’Flaherty, B.L. (instructed by the Chief State Solicitor) cross-examined Captain James J. Kelly on behalf of Chief Superintendent John P. Fleming, the latter being in attendance.


6. Mr. Hickey, Mr. O’Flaherty, Captain Kelly and Chief Superintendent Fleming withdrew.


7. The Committee went into private session.


8. The Committee were informed that the Minister for Agriculture and Fisheries had intimated that he could not agree to the passing to Colonel Hefferon of the note handed in to the Committee by him on 22 April 1971.


9. The Committee considered Colonel Hefferon’s letter* of 7 November in reply to the Committee’s letter* of 4 November informing him that he would be heard today.


Resolved: to approve form of reply.*


10. It was reported to the Committee that no communication had been received from Mr. H since last week’s report to the Committee.


11. Adjournment.


The Committee adjourned at 6 p.m. until 4 p.m. on Wednesday next.
