Control of Exports (No. 2) Order, 1961 (S.I. No. 54 of 1961).

I am directed by the Select Committee on Statutory Instruments to refer to the Control of Exports (No. 2) Order, 1961, which is stated to have been made by the Minister for Industry and Commerce on 6th March, 1961, under the powers conferred on him by subsection (2) of section 2 of the Control of Exports (Temporary Provisions) Act, 1956.


The Order purports to prohibit the export of fertilisers to all destinations for one year and it appears to the Select Committee that this object would have been more properly secured by an order under subsection (1) of section 2 of the parent statute. Furthermore the Committee notes that though orders under subsection (2) require prior consultation with the Minister for External Affairs there is nothing in the order under reference to indicate that such consultation took place.


The Select Committee wishes to be furnished with an explanatory memorandum in the matter.

I am directed by the Minister for Industry and Commerce to refer to your minute dated 12th April, 1962, regarding the Control of Exports (No. 2) Order, 1961, and to say that the reference, in the preamble to the Order, to subsection (2) of section 2 of the Control of Exports (Temporary Provisions) Act, 1956, was inadvertently inserted instead of a reference to subsection (1). I am to add that the Minister is advised that the validity of the Order is not affected by this drafting error.
