Bord Iascaigh Mhara Staff Superannuation Scheme.

I am directed by the Select Committee on Statutory Instruments to state that it has had the Bord Iascaigh Mhara Staff Superannuation Scheme under consideration in connection with the requirement under section 3 of the Sea Fisheries Amendment Act, 1955 that it “shall be laid before each House of the Oireachtas as soon as may be after it is approved of.”


The Committee notes that the scheme was approved of on the 13th December, 1957 but was not laid before Seanad Éireann until the 15th January, 1958. In accordance with its terms of reference the Committee has to consider whether there was unjustifiable delay in the laying of this instrument before Seanad Éireann. It would, therefore, be glad to receive a memorandum on this matter. In this connection I am to invite your attention to paragraph 13 of the First Report (Pr. 3001) of the Select Committee on Statutory Instruments dated 5th May, 1955.


As the Committee wish to consider this matter at its next meeting it would appreciate a reply before the 28th instant.

In reply to your minute of 1 Aibreán, 1958, about the Bord Iascaigh Mhara Staff Superannuation Scheme, which was approved of on 13th December, 1957, but not laid before Seanad Éireann until 15th January, 1958, I am directed by the Minister for Lands to state that it is regretted that the urgency of laying it before the Houses of the Oireachtas was overlooked in the unusual circumstances that the scheme


(1) had been deemed to have come into operation on 1st July, 1953, under section 2 (2) of the Sea Fisheries (Amendment) Act, 1955, and


(2) had been exempted from the operation of section 3 (1) of the Statutor Instruments Act, 1957.
