IMEACHTA AN CHOISTE SPEISIALTA.

PROCEEDINGS OF THE SPECIAL COMMITTEE.

Déardaoin, 21 Feabhra, 1957.

1. Chruinnigh an Coiste ar 3.30 p.m.

2. Comhaltaí i Láthair.

Bhi na comhaltaí seo a leanas i láthair:—

An Seanadóir Ó Buachalla (i gCeannas), na Seanadóirí Mac Coiligh, Mac Crosáin, Dubhglas, Mac Raith, Ó Ciosáin agus De Stanfort.

3. Breithniú an Bhille.

D’athchrom an Coiste ar an mBille a bhreithniú.

(i) Alt 12 a cuireadh siar.

Ceist—“Go bhanfaidh an t-alt mar chuid den Bhille”—curtha: Rinne an Coiste vótáil: Tá,4; Níl,2.

Tá:—Na Seanadóirí Mac Crosáin, Dubhglas, Mac Raith agus De Stanfort.

Níl:—Na Seanadóirí Mac Coiligh agus Ó Ciosáin.

Faisnéiseodh dá réir sin go rabhthas tar éis glacadh leis an gCeist.

(ii) Alt 26 a cuireadh siar.

Tairgeadh ón gCathaoir leasú ón Rialtas:

“In subsection (2), page 17, line 24, to delete ‘when’ and substitute ‘where’.”

D’aontaíodh an leasú.

Tairgeadh ón gCathaoir leasú ón Rialtas:

“To insert at the end of the section the following new sub-section:—

‘(3) Where any chattels held upon trust, including a trust for sale, are in the possession of a person entitled to a beneficial interest in the chattels or in the proceeds of sale, not being a person solely and absolutely entitled thereto, no right of action to recover the chattels shall be deemed for the purpose of this Act to accrue during such possession to any person in whom the chattels are vested as trustee or to any person entitled to a beneficial interest in the chattels or the proceeds of sale’.”

“In line 30, to delete ‘life’ and substitute ‘the life of any person or persons’.”

(v) Alt 55 a cuireadh siar.

Tairgeadh leasú (An Seanadóir Ó Ciosáin):

“In paragraph (a), line 26, to delete ‘life’ and substitute ‘the life of any person or persons’.”

(vi) Alt 56 a cuireadh siar.

“To delete subsection (2).”

4. Tuarascáil an Choiste.

Chuir an Cathaoirleach Dréacht-Thuarascáil faoi bhráid an Choiste agus léadh í mar leanas:

“The Special Committee has gone through the Bill and has made amendments thereto. The Bill, as amended, is reported to the Seanad.”
