APPENDIX XIII.

Customs Duties (Miscellaneous Suspensions) Order, 1955 (S.I. No. 217 of 1955).

The Select Committee on Statutory Instruments have had under consideration the Customs Duties (Miscellaneous Suspensions) Order, 1955 (S.I. No. 54 of 1955).


Article 2 of the Order reads as follows:—


“2 Article 2 of each of the following Orders:


(a) The Emergency Powers (No. 282) Order, 1943 (S.R. & O. No. 247 of 1943),


(b) The Emergency Powers (No. 320) Order, 1944 (S.R. & O. No. 156 of 1944),


(c) The Customs Duties (Miscellaneous Suspensions) (No. 3) Order, 1948 (S.I. No. 403 of 1948),


is hereby amended by the substitution of the ‘31st day of March, 1956’ for the ‘31st day of March, 1955.’”


The Committee note, however, that the actual dates specified in Article 2 of each of the three Orders concerned relate to the following “appointed Periods”


(a) 1/7/43 to 31/10/43,


(b) 1/5/44 to 31/10/44, and


(c) 29/11/48 to 31/3/49, and that the words “31st day of March, 1955” do not in fact occur in Article 2 of these Orders.


While the Committee are aware that the “appointed period” for the purposes of each of these Orders has been extended by amending Orders they are of opinion nevertheless that this fact should have beeh made clear in the Order itself. They would be glad therefore to receive a memorandum on this point, and would also like to know whether the validity of the Order is in any way affected.


As the Committee would like to discuss the matter at their next meeting they would be glad to receive a reply by the 4th October, 1955.

I am directed by the Minister for Industry and Commerce to refer to your minute of the 21st September addressed to the Department of the Taoiseach and transmitted to this Department relative to the Customs Duties (Miscellaneous Suspensions) Order, 1955 (S.I. No. 54 of 1955). The Minister agrees that the words “31st day of March 1955” do not appear on the Orders mentioned at (a), (b) and (c) of your minute, but he understands that by virtue of the Customs Duties (Miscellaneous Suspensions) Order, 1954 (S.I. No. 57 of 1954) the period of validity of the Orders in question was extended to the 31st March, 1955. He further understands that the fact that there is no specific reference in the Customs Duties (Miscellaneous Suspensions) Order, 1955, to previous amending Orders, does not, in any way, affect the validity of that Order.


The Minister has noted the opinion of your Committee that the 1955 Order should have made it clear that the “appointed period” of the Orders mentioned at (a), (b) and (c) of your minute had been extended by amending Orders and steps will be taken to meet the views of your Committee in this matter if it is necessary to make any further Customs Duties (Miscellaneous Suspensions) Orders.
