The following members were present:— Deputy V. de Valera (in the Chair), the Minister for Defence, Deputies Brennan, Carter, Colley, S. Collins, Cowan, Davern, Hilliard and MacBride. 3. Consideration of Bill. The Committee resumed consideration of the Bill. (i) Section 105. Amendment proposed (Deputy S. Collins): “In paragraph (b) to delete all words after ‘Force’ in line 19 to the end of the paragraph and substitute ‘and’.” Amendment, by leave, withdrawn. Section agreed to. (ii) Sections 106 and 107 agreed to. (iii) Section 108. Amendment proposed (Deputy Cowan): “In subsection (3) to delete paragraph (a).” Question put, and agreed to. Amendment proposed (Deputy Cowan): “To delete subsection (4).” Amendment, by leave, withdrawn. Amendment proposed (Deputy Cowan): “In subsection (4) to delete all words after ‘thereof’ in line 37, to end of subsection and substitute ‘to a fine of five pounds’.” Amendment, by leave, withdrawn. Section, as amended, agreed to (iv) New section. Amendment proposed (Deputy Cowan): “Before section 109 to insert a new section as follows:— ‘Where a person is convicted or acquitted by a court-martial in pursuance of this Act for an offence such person shall not be subsequently tried by a civil court for the same offence.’” Amendment, by leave, withdrawn. (v) Sections 109 to 112 inclusive, agreed to. (vi) Section 113. Amendment proposed (Deputy Cowan): “In subsection (1), line 4, before ‘he’ to insert ‘or by the Minister or any official of the Department of Defence.’” Debate ensued.
