ATTORNEY-GENERAL’S ADVICE AGAINST PROSECUTION IN MILITARY SERVICE PENSIONS CASE.

As regards the note by the Comptroller and Auditor-General, paragraph 91, Subhead I., Military Service Pensions, since the Committee’s adjournment on June 16th, we have asked the Attorney-General’s Office if they would have advised a prosecution under Section 19 of the Military Service Pensions Act, 1934, if that question had been put to them specifically. The Attorney-General’s Office stated that they would not have advised any such proceeding and pointed out that in a case tried in the Central Criminal Court six months previously and referred to in the Comptroller and Auditor-General’s report under the same paragraph, in which there was much more convincing evidence of perjury, the State failed to sustain the charge.
