PROCEEDINGS OF THE COMMITTEE.

Dé Céadaoin, 25° Abrán, 1934.

Wednesday, 25th April, 1934.

1. The Committee met at 11 a.m.


2. Present: The Cathaoirleach (in the Chair), the Leas-Chathaoirleach, Senators Mrs. Wyse Power, Douglas, Johnson, Colonel Moore, O’Rourke and Wilson.


3. The Chairman’s Draft Report was considered.


Motion made (Senator Johnson):


“That sections 15 to 21, inclusive, be deleted.”


The Committee deliberated. It was decided to postpone consideration of sections 15 to 21, inclusive, and to consider the remainder of the report section by section.


(i) Section 1.


Amendment proposed (Senator Douglas):


“To delete the words ‘There is no doubt that”’.


Question put, and agreed to.


Section 1, as amended, agreed to.


(ii) Section 2 agreed to.


(iii) Section 3.


Amendment proposed (Senator Douglas):


“To delete sub-section (3).”

(iv) Sections 4 to 7, inclusive, agreed to.


(v) Section 8.


Amendment proposed (Senator Douglas):


To delete the section and to substitute the following new section therefor:—


“(8) On the 16th February the Clerk informed the Superintendent of the Oireachtas of the Cathaoirleach’s order. The Superintendent informed the Clerk of the Dáil, who directed him to await instructions from him before doing anything definite. The Superintendent stated in his evidence that the Clerk of the Dáil added that, where the Superintendent was concerned, the orders of the Clerk of the Dáil would override all others, whether from the Cathaoirleach or the Clerk of the Seanad (Qq. 280-284, 346, 347); but this part of the Superintendent’s evidence is questioned by the Clerk of the Dáil (see paragraphs 23 and 24 below).”

Amendment proposed (Senator Douglas):


To delete the second sentence of paragraph 1 and to substitute therefor the following:—


“That is to say, he admits that he instructed the Superintendent not to admit visitors wearing blue uniform shirts even though they had cards of admission to the Seanad and that, knowing that the Superintendent could not see his way to disobey the Cathaoirleach’s order, he instructed him to inform the Minister for Defence, who had no authority in the matter, of all the facts.”

(x) Section 25 agreed to.


(xi) Section 26.


Amendment proposed (Senator Douglas):


To delete the words “any Second Chamber” and to substitute therefor the words ‘an independent Second Chamber.”

To delete all after the words “present breach” down to the end of the section.

5. The Committee decided that the portion of the report on which agreement had been reached should be circulated to the members of the Committee for its next meeting.
