PROCEEDINGS OF THE COMMITTEE.

1. The Committee met at 10.30 a.m.


2. Present:—Deputy P. S. Doyle (in the Chair); Deputies Beckett, Bennett, Sir J. Craig, Keogh, R. O’Connell, Moore, O’Dowd, O’Kelly and Tubridy.


3. The Committee took the Bill into consideration.


(i) Section 1.


Amendment proposed (Deputy O’Dowd):


“At the end of Section 1, sub-section (1), to add the following: ‘provided that such hospitals reserve for non-paying patients a monthly average of twenty-five per cent. of the total number of hospital beds in the institution and that no discrimination is exercised in the filling of these beds on the grounds of the religion of the applicants.


For the purposes of this Act a non-paying patient shall be deemed to be one who does not contribute more than ten shillings per week or on whose behalf there is not contributed more than ten shillings per week.’”

Amendment proposed (Deputy O’Dowd):


“To add to Section 1 a new sub-section as follows:—


‘No hospital or sanatorium shall be entitled to carry on and conduct sweepstakes or drawings of prizes under this Act if there be any provision in its charter, constitution or regulations debarring any person from election or appointment to the staff thereof solely because of his or her religious belief.’”

Amendment proposed (Deputy O’Dowd):


“Section 1, sub-section (2), to delete all the words in the sub-section after the word ‘to’ in line 26, and substitute ‘the Minister for Justice and which before being put into operation shall have received his approval.


The Committee on submitting a scheme must specify:—


(a) the amount of prize money or moneys to be awarded;


(b) how it is proposed to divide among the parties the amount of money subscribed;


(c) where the prize money is to be deposited;


(d) the manner and place in which the drawing will take place; and


(e) the name of the Accountant or Auditor.’”

Amendment proposed (Deputy O’Dowd):


“Section 1, sub-section (2), to add at the end of the subsection:—‘No member of any such Committee shall receive remuneration for his or her services on such Committee.’”

(ii) Section 2.


Amendment proposed (Deputy Sir James Craig):


“Section 2, line 39, to delete all after the word ‘amount’ and substitute:—


‘of the guaranteed prize money to be awarded in each sweepstake shall be deposited in a public bank in Saorstát Eireann in the name of at least three trustees appointed by the Committee; and where a scheme embodying a series of sweepstakes is submitted to the Minister for Justice he shall on giving his approval name a definite period before each drawing in which the amount of the guaranteed prize money must be deposited.’”

“Section 2, to add at the end:—


‘and it shall be the duty of the Committee to furnish to the Minister satisfactory evidence that the necessary sum has been so deposited.’”

(iii) Section 3.


Amendment proposed (Deputy Sir James Craig):


“To Section 3 add a new sub-section as follows:—


‘The amount to be deducted as expenses for the conducting of a sweepstake shall not exceed thirty per cent. of the money resulting from the sale of tickets.’”


Amendment postponed.


Amendment proposed (Deputy O’Dowd):


“To add to Section 3 a new sub-section as follows:—


‘The Committee of any sweepstake organised under this Act shall submit to the Minister for Justice within three months after the date fixed for the holding of such sweepstake or drawing of prizes a statement of accounts of each such sweepstake or drawing of prizes audited by a person, firm or corporation duly qualified in the profession of accountancy and approved for this purpose by the Minister, and the Committee shall at the same time cause to be furnished to each member of the Oireachtas such audited statement.’”

(iv) Section 4.


Amendment proposed (Deputy O’Dowd):


“To insert a new Section before Section 4, as follows:—


‘Each ticket issued in connection with a sweepstake or drawing of prizes conducted under this Act shall have clearly printed thereon the following particulars, that is to say:—


the name of the hospital or hospitals participating in such sweepstake and the proportion of the nett proceeds to be allocated to each.’”

Amendment proposed (Deputy O’Dowd):


“To insert a new Section before Section 4, as follows:—


‘Every hospital proposing to participate in the holding of a sweepstake or drawing of prizes shall furnish to the Minister an audited statement of accounts for the year ended the 31st December prior to the date of the application for approval of the holding of such sweepstake.’”

Amendment proposed (Deputy O’Dowd):


“To insert a new Section before Section 4, as follows:—


‘All printing in connection with every such sweepstake or drawing of prizes shall, where it is practicable to do so, be carried out in Saorstát Eireann and be of Irish materials.’”

(v) Section 5.


Amendment proposed (Deputy Sir James Craig):


“In Clause 5 (2), line 6, to delete the figures ‘1933’ and substitute therefor the figures ‘1934.’”
