3.Expressions of sympathy on the reported loss of the crew of the Pere Charles


Members expressed sympathy on the reported loss of the five crew members of the fishing vessel Pere Charles. A minutes silence was observed.

At the conclusion it was agreed that the Clerk should write to the Ombudsman to urge finalisation of the report of the investigation, if possible, before the Dáil was dissolved.

10.Scrutiny of COM (2006) 382 and COM (2006) 594


Members received a presentation on COM (2006) 382 - A proposal for a Regulation of the European Parliament and the Council on roaming on public mobile networks within the Community and amending Directive 2002/21/EC on a common regulatory framework for electronic communications networks and services. This was followed by a question and answer session. It was agreed to consider this matter further when Mr. Bartho Pronk met the Committee on the 7th March.


Members received a presentation on COM (2006) 594 — A proposal for a Directive of the European Parliament and of the Council amending Directive 97/67/EC concerning the full accomplishment of the internal market of Community postal services. This was followed by a question and answer session. It was agreed to consider this matter further when An Post next met the Committee.

5.Discussion with Mr. Bartho Pronk, a member of Commissioner Reding cabinet


Mr. Pronk addressed the members on the matter of mobile phone roaming charges within the context of the Joint Committee’s scrutiny of COM (2006) 382 - Proposal for a Regulation of the European Parliament and the Council on roaming on public mobile networks within the Community and amending Directive 2002/21/EC on a common regulatory framework for electronic communications networks and services. This was followed by a question and answer session.

10.Resolution to telecommunications issues in the Black Valley


The Chairman read into the record a letter from Eircom which detailed the solution to this issue. Eircom have undertaken to fund the cost in full of providing a full telecommunications service for the Black Valley. The Chairman and members led expressions of thanks to those involved in reaching a solution.


11.Discussion with Mr. Pat Curtin


Mr. Curtin made a presentation to the Joint Committee which corrected the record of the House in relation to errors and inaccuracies, which Mr. Curtin advised the Joint Committee had been made by the Secretary General and in correspondence from the Ombudsman which had been read into the record of the House.


It was agreed that Mr. Curtin would supply a copy of correspondence which he had to the Clerk. The Joint Committee agreed that the Clerk would write to the Ombudsman (enclosing a copy of the transcript of today’s meeting and the documentation supplied by Mr. Curtin) noting that the Members of the Joint Committee considered that, from the evidence available to the Joint Committee, there would appear to be evidence of a prima facia case of mal administration and that in this regard the Joint Committee would urge the Ombudsman, in the interest of justice, to expedite the Ombudsman’s report. It was also agreed that the Clerk would similarly write to the Secretary General of the Department of Communication, Marine and Natural Resources, enclose a copy of the transcript and request that that Secretary General answer the questions that had been posed.


11.Discussion on the Report of the Expert Group on Health Effects of Electromagnetic Fields with Department officials


The members received a briefing from Department Officials on the Report of the Expert Group on Health Effects of Electromagnetic Fields. The briefing given was in reference to the recommendations of the Joint Committee Report - Non-ionising radiation from mobile phone handsets and masts, published in March 2005. Following a question and answer session, Members welcomed the findings of the Report of the Expert Group on Health Effects of Electromagnetic Fields which took on board the recommendations of the report of the Joint Committee.


12.Any Other Business


The Chairman and members thanked the staff of the Houses of The Oireachtas for their work and assistance during the term of the Joint Committee.
