Chairman’s Forward

2004 was a momentus year for the European Union. It was the year which saw the largest ever enlargement in which 10 new Member States acceded to the European Union. It also saw the conclusion of the intergovernmental negotiations on the Draft Treaty establishing a Constitutional treaty for the Europe Union and in June a new European Parliament was elected.


Ireland held the Presidency of the European Union from January to June 2004 and played a crucial role in progressing the negotiations on the draft Constitution as well as the enlargement.


The Joint Committee on European Affairs assumed the presidency of COSAC (Conférence des Organes Spécialisés dans les Affaires Communautaires et Européennes des Parlements de l’Union européenne) at the beginning of the year and continued to meet delegations from the Parliaments of the Acceding Countries, a process which had commenced in the latter half of 2003.


Throughout the period of the Presidency the Committee engaged with the Minister for Foreign Affairs and his officials to promote the Committee’s recommended priorities for Ireland’s Presidency Programme. Details of the Priorities are set out in the Committee’s report at appendix 11.


The Committee also approved a strong and business-like agenda for the Plenary Session of COSAC and succeeded in having the agenda approved by the Conference of Chairpersons of COSAC which was hosted in Dublin on 19th February 2004.


In keeping with the aims of COSAC, as set out in its orders of reference, the Committee sought to realise tangible achievements and the XXXI COSAC Plenary Meeting which was held in Dublin Castle on 19th and 20th May under the Chairmanship of Mr. Gay Mitchell TD was widely regarded as a significant success.


In brief, the XXXI COSAC welcomed the new Member States and agreed the following business (in summary);


  • called for the conclusion of the Intergovernmental Conference on the Draft Treaty establishing a Constitution for Europe and by the next European Council in June on the basis of the text adopted by the Convention;
  • welcomed the appointment of a Counter Terrorism Coordinator to co-ordinate the work of the Council in combating terrorism
  • called for a closer coordination between the Parliaments concerning scrutiny and implementation of the general budget of the European Union; noted the report tabled by the Presidency on the role of the European Court of Auditors, and complimented its authors for this work.
  • welcomed the first Biannual Report on developments in European Union procedures and practices relevant to parliamentary scrutiny
  • welcomed the document by the Presidency and reaffirms its commitment to the Lisbon Strategy and the second phase of the implementation of this strategic goal of the European Union.
  • call on all voters in the European Union to participate in the sixth direct elections to the European Parliament,

In the second half of year the Committee undertook a significant body of work across the spectrum of European Union issues, including, a report on the prospect of Turkish membership, an in-depth discussion of the EU PEACE Programme, and an exchange of views on the issue of comitology.

1. Content and Format of Report

This report has been prepared pursuant to paragraphs 3, 4, 5 and 6 of Standing Order 84, Dáil Éireann and paragraphs 3, 4, 5 and 6 of Standing Order 69, Seanad Éireann which provides for the Joint Committee reports and work programme as follows-


  • review its procedure and its role
  • annual work programme
  • lay minutes of proceedings
  • making an annual report.

At its meeting on 17th May 2006 the Joint Committee agreed that all these items be included in this annual report.


2. Functions and Powers

The Dáil Select Committee on European Affairs was established by Order of Dáil Éireann of 27th June 2002 to consider such Bills the statute law in respect of which is dealt with by the Department of Foreign Affairs; and such proposals contained in any motion, including any motion within the meaning of Standing Order 157 concerning the approval by the Dáil of international agreements involving a charge on public funds, as shall be referred to it by Dáil Éireann from time to time.


Under an Order of 11th November 2002 The Dáil Select Committee was enjoined with a Select Committee of Seanad Éireann, established by Order of Seanad Éireann of 17 October 2002, to form the Joint Committee on European Affairs. Among the principal functions of the Joint Committee are to consider


  • scrutinise, in the context of European Union issues and measures to be taken by the Council of Ministers of the European Union
  • consider such matters arising from Ireland’s membership of the European Communities and its adherence to the Treaty on European Union, as it may select;
  • consider such
  • - acts of the institutions of the European Communities, regulations under the European Communities Acts, 1972 to 1998


    - other instruments made under statute and necessitated by the obligations of membership of the European Communities,,


  • and it may select
  • - consider such other matters as may be referred to it from time to time by both Houses of the Oireachtas;


    - represent both Houses of the Oireachtas at the Conference of European Affairs Committees (COSAC);


    and shall report thereon to both Houses of the Oireachtas.


The Orders of Reference of the Dáil Select Committee and the Joint Committee are set out at Appendix 1.


3. Chairman, Vice-Chairman, Convenors and Membership

Deputy John Deasy – (replaced Gay Mitchell, by order of the Dáil on 20th October 2004) was elected as Chairman of the Joint Committee on 20th October 2004. Deputy Barry Andrews – was elected as Vice-Chairman of the Joint Committee on 25th November 2004. The Chairman of the Joint Committee is also Chairman of the Dáil Select Committee.


Deputies Dan Wallace – (replaced Michael Mulcahy by order of the Dáil on 16 November 2004) and Aengus O Snodaigh are the Convenors of the Committee whose function it is to ensure the availability and attendance of Members or their substitutes for meetings of the Committee and, in particular, to ensure Members’ availability for divisions.

4. Sub-Committee on European Scrutiny

Standing Order 81(3) (Dáil) and Standing Order 65(3) (Seanad) confer on Committees the power to appoint sub-Committees and to refer to such sub-Committees any matter covered by its orders of reference and to delegate any of its powers to such sub-Committees, including power to report directly to the Dáil and Seanad.


The Sub-Committee considers Scrutiny of EU Legislative Proposals. The Sub-Committee consists of 7 Members (5 Dáil and 2 Seanad). The Orders of Reference of the Sub-Committee are set out in Appendix 1. The Members of the Sub-Committee are set out in Appendix 4.


At its first meeting on 4th November 2004 Deputy Bernard Allen replaced Deputy Gay Mitchell as Chairman.


5. Meetings, Attendance and Recording

Meetings of the Joint Committee, Select Committee and Sub-Committee took place in the Committee rooms in Leinster House 2000. Meetings were in public unless otherwise ordered by the Committee.


Televised coverage of public meetings of the Committee were broadcast live within the Leinster House complex and was available for subsequent public broadcasting.


An Official Report (Parliamentary Debates) of the public meetings of the Committees is published and may be purchased from the Government Publications Sales Office, Sun Alliance House, Molesworth Street, Dublin 2. The Official Reports may also be viewed on the Houses of the Oireachtas website at www.irlgov.ie/oireachtas.

6. Number and Duration of Meetings

The Joint Committee met on 32 occasions in the year under report. The number of hours discussion involved in these meetings was in excess of 46 hours. The date and subject matter of each meeting is set out in paragraph 7 below and at Appendix 5.


The Dáil Select Committee met on 0 occasions in the year under report.


The Sub-Committee on European Scrutiny met on 18 occasions during the year and the number of hours discussion involved in these meetings was in excess of 13 hours. The date and subject matter of each meeting is set out in paragraph 7 below and at Appendix 7.


Minutes of proceedings of the Joint Committee and Sub-Committee meetings in public session are attached at Appendix 8 and Appendix 10 respectively.


7. Work of the Committee

APPENDIX 1
Orders of Reference

Joint Committee

Dáil Éireann on 16 October 2002 ordered:


That the Orders of Reference of the Select Committee on European Affairs established on 27th June 2002, be amended by the insertion of the following Orders of Reference in substitution thereof:


    1. That a Select Committee, which shall be called the Select Committee on European Affairs, consisting of 11 Members of Dáil Éireann (of whom four shall constitute a quorum), be appointed to consider—
      1. such Bills the statute law in respect of which is dealt with by the Department of Foreign Affairs;
      2. and


      3. such proposals contained in any motion, including any motion within the meaning of Standing Order 157 concerning the approval by the Dáil of international agreements involving a charge on public funds,

      as shall be referred to it by Dáil Éireann from time to time.


    2. For the purpose of its consideration of Bills and proposals under paragraphs (1)(a)(i) and (ii), the Select Committee shall have the powers defined in Standing Order 81(1), (2) and (3).
    3. For the avoidance of doubt, by virtue of his or her ex officio membership of the Select Committee in accordance with Standing Order 90(1), the Minister for Foreign Affairs (or a Minister or Minister of State nominated in his or her stead) shall be entitled to vote.
    1. The Select Committee shall be joined with a Select Committee to be appointed by Seanad Éireann to form the Joint Committee on European Affairs to-
      1. scrutinise, in the context of European Union issues and measures to be taken by the Council of Ministers of the European Union-
        1. any proposals under the Community treaties for legislation by the Council or the Council acting jointly with the European Parliament,
        2. any document which is published for submission to the European Council, the Council or the European Central Bank,
        3. any proposal for a common strategy, a joint action or a common position under Title V of the Treaty on European Union which is prepared for submission to the Council or to the European Council,
        4. any proposal for a common position, framework decision, decision or a convention under Title VI of the Treaty on European Union which is prepared for submission to the Council,
        5. any document (not falling within (II), (III), or (IV) above) which is published by one Union institution for or with a view to submission to another Union institution and which does not relate exclusively to the consideration of any proposal for legislation,
        6. and


        7. any other document relating to European Union matters deposited in both Houses of the Oireachtas by a Member of the Government or Minister of State,

        as it may select;


      2. consider such matters arising from Ireland’s membership of the European Communities and its adherence to the Treaty on European Union, as it may select;
      3. consider such -
        1. acts of the institutions of the European Communities,
        2. regulations under the European Communities Acts, 1972 to 1998,
        3. other instruments made under statute and necessitated by the obligations of membership of the European Communities,

        as it may select;


      4. consider such other matters as may be referred to it from time to time by both Houses of the Oireachtas;
      5. and


      6. represent both Houses of the Oireachtas at the Conference of European Affairs Committees (COSAC);

      and shall report thereon to both Houses of the Oireachtas.


    2. The Joint Committee shall have:
      1. the powers defined in Standing Order 81(1) to (9) inclusive;
      2. the power to refer a proposal for EU legislation which has been considered by it (and which has been concluded to be of sufficient national importance to require further scrutiny) to a Joint Committee on which has been conferred the power defined in Standing Order 81(4) to consider such proposals;
      3. and


      4. the power to request the presence of Members of the Government (or Ministers of State nominated in their stead) (or, in the case of the European Council, the Taoiseach or Minister for Foreign Affairs) to attend before the Joint Committee and provide, in private session if so desired by the Member of the Government or Minister of State, oral briefings in advance of Council meetings to enable the Joint Committee to make known its views.
    3. The following persons may attend meetings of the Joint Committee and of its sub-Committees and may take part in proceedings without having a right to vote or to move motions and amendments—
      1. Members of the European Parliament elected from constituencies in Ireland (including Northern Ireland);
      2. members of the Irish delegation to the Parliamentary Assembly of the Council of Europe;
      3. and


      4. at the invitation of the Joint Committee or of a sub-Committee, as appropriate, other Members of the European Parliament.
    4. The quorum of the Joint Committee shall be five, of whom at least one shall be a Member of Dáil Éireann and one a Member of Seanad Éireann.

        5. any document (not falling within (II), (III), or (IV) above) which is published by one Union institution for or with a view to submission to another Union institution and which does not relate exclusively to the consideration of any proposal for legislation,
        6. and


        7. any other document relating to European Union matters deposited in both Houses of the Oireachtas by a Member of the Government or Minister of State,

        as it may select;


      2. consider such matters arising from Ireland’s membership of the European Communities and its adherence to the Treaty on European Union,
      3. as it may select;


      4. consider such -
        1. acts of the institutions of the European Communities,
        2. regulations under the European Communities Acts, 1972 to 1998,
        3. other instruments made under statute and necessitated by the obligations of membership of the European Communities,

        as it may select;


      5. consider such other matters as may be referred to it from time to time by both Houses of the Oireachtas;
      6. and


      7. represent both Houses of the Oireachtas at the Conference of European Affairs Committees (COSAC);

      and shall report thereon to both Houses of the Oireachtas.


    2. The Joint Committee shall have:
      1. the powers defined in Standing Order 65 (1) to (9) inclusive;
      2. the power to refer a proposal for EU legislation which has been considered by it (and which has been concluded to be of sufficient national importance to require further scrutiny) to a Joint Committee on which has been conferred the power defined in Standing Order 65(4) to consider such proposals;
      3. and


      4. the power to request the presence of Members of the Government (or Ministers of State nominated in their stead) (or, in the case of the European Council, the Taoiseach or Minister for Foreign Affairs) to attend before the Joint Committee and provide, in private session if so desired by the Member of the Government or Minister of State, oral briefings in advance of Council meetings to enable the Joint Committee to make known its views.
    3. The following persons may attend meetings of the Joint Committee and of its sub-Committees and may take part in proceedings without having a right to vote or to move motions and amendments—
      1. members of the European Parliament elected from constituencies in Ireland (including Northern Ireland);
      2. members of the Irish delegation to the Parliamentary Assembly of the Council of Europe;
      3. and


      4. at the invitation of the Joint Committee or of a sub-Committee, as appropriate, other Members of the European Parliament.
    4. The quorum of the Joint Committee shall be five, of whom at least one shall be a Member of Dáil Éireann and one a Member of Seanad Éireann.
  1. The Chairman of the Joint Committee shall be a Member of Dáil Éireann.

1. Meeting with a delegation of Members from the Danish EU Affairs Committee.


The Chairman welcomed the delegation from the European Affairs Committee of the Danish Parliament, led by Mr. Claus Larsen-Jensen. The delegation was also accompanied by the Ambassador, Mr Erik Tygesen. Following a brief presentation by the Chairman, setting out the work of the Committee and arrangements for the Presidency, he invited the Danish Chairman to make his presentation.


The Chairman then opened the discussion to the floor.


During the discussion the Committee agreed that we should move towards the proposal which is set out in the protocol to the draft constitution in relation to scrutiny of the subsidiarity principle and that this should be discussed further at the forthcoming COSAC meeting.


Following the discussions the Chairman thanked the delegation.

In her opening remarks the Chairperson commented on the similarities between Ireland and Sweden and noted that the delegation would be interested in hearing how the Joint Committee on European Affairs operates within the Oireachtas and asked the Chairman to give the delegation a brief introduction to the activities of the committee.


The Chairman outlined for the delegation the kinds of work the Joint Committee is involved in, giving an outline of the scrutiny process, the regular meetings in advance of council meetings with the Minister Foreign Affairs, how the committee prepared for the presidency and other recent issues handled by the committee.


The Chairman invited comments from other members and there followed an exchange of views with the members of the delegation covering topics including;


  • the draft Constitutional Treaty
  • the need to strengthen the role of national parliaments, the role and future of COSAC
  • representation of women in political life
  • Priorities for the Irish presidency of the EU such as the Lisbon process, the accession of the ten new member states and HIV AIDS.

The Chairman thanked the delegation for the interesting discussion.

The Chairman welcomed Mr. Gerard de Graf, Head of Internal Marketing DG European Commission, Mr. Andrew Mc Dowell and Declan Hughes of Forfas and John Fingleton, Head of Competition Authority.


Following a brief introduction to the topic, the Chairman invited Mr de Graaf to commence. Mr. Fingleton then made a presentation and he was followed by both Mr. McDowell and Mr. Hughes.


There followed an exchange of questions and answers.

2. Correspondence.

Correspondence received from Mr. Povilas Andriukaitis Deputy Chairman of the Seimas of the Republic of Lithuania extending an invitation to attend an international conference entitled ‘European Union Enlargement and Eastern Dimension’ which will be held on the 30th of April in Lithuania. – This conference takes place on the day before accession. The Lithuanian delegation to COSAC last week proposed simultaneous debates in each Parliament for this particular week. They now propose to host this conference. It was agreed to send 2 Members.

The Chairman introduced the fourth in the series of meetings on the Lisbon Strategy. The specific topic was ensuring sustainable growth


The Chairman then welcomed Mr Maurice Coughlan, Principal Officer, Department of Environment Heritage and Local Government and Professor Frank J Convery, Heritage Trust Professor of Environmental Studies, Director of the Environmental Institute at University College Dublin


Mr. Coughlan commenced by making a brief presentation and he was followed by Mr. Convery. Following the presentations the witnesses responded to Members questions.

6. The Lisbon Strategy – Draft Report of the committee


The Chairman noted that this was the fifth in a series of meetings on the Lisbon Strategy and noted that each member had received a copy of the Draft Report and the Draft document for submission to the Conference of Chairmen of European Affairs Committees of the EU and the European Parliament. The Chairman recalled that the Committee had not only agreed to report to both Houses on progress of the Lisbon Strategy in the context of the Irish Presidency’s commitment to advance the strategy as a priority but that COSAC agreed to discuss the Lisbon Strategy at the next meeting in May.


The meeting was attended by Ms Katherine Meenan, consultant to the Joint Committee and before continuing the Chairman thanked Ms. Meenan for her work in preparing the reports.


The Chairman invited Ms Meenan to introduce both reports to members who outlined the contents of each. Following Ms Meenan’s comments the Chairman invited questions and comments from members.


At the end of the discussion the Joint Committee agreed that the report as circulated (incorporating minor changes to take into account the discussion held) should be re-circulated to members as soon as possible and that the committee would meet on 21st April to launch the report.

The Chairman welcomed the delegation to the meeting and to Dublin. Having introduced the members of the Joint Committee the Chairman outlined the work of the committee for the benefit of the delegation and invited Mr Yakis, Chairman EU Integration Commission to address the committee.


Following Mr Yakis’ presentation there was a question and answer session during which the delegation exchanged views with members of the Joint Committee mainly considering matters related to Turkey’s application to become a member of the European Union.


The Chairman thanked the delegation for attending and for the interesting exchange.

It was noted that Members had received a brief for the meeting and in addition the conclusions of the last GAERC council meeting as well as the A points discussed at that meeting.


At the invitation of the Chairman the Minister made a presentation to the committee on the agenda for the forthcoming meeting of the General Affairs and External Relations Council and updated the committee on the progress made with regard to progress on priorities the of the Irish Presidency of the European Union.


Following the Minister’s presentation the Minister of State Tom Kitt TD outlined for members the development matters on the agenda for the forthcoming Council and the development issues relating to Ireland’s presidency.


A questions and answer session on General Affairs during which the Minister and minister of state answered questions from members was followed by a session on External Relations.


The Chairman thanked the Minister and Minister of State for their ongoing cooperation with the Joint Committee.

1. Discussion with An Taoiseach, Mr. Bertie Ahern TD regarding the role of the Irish Presidency in advancing the Lisbon Strategy.


The Chairman commenced by thanking the Taoiseach for attending the meeting especially given his busy schedule during the period of the presidency.


The Chairman continued by outlining the work that the committee had done in preparation of its report on the Lisbon Agenda in holding a series of meetings during which contributions were heard from a variety of sources focussed on Competitiveness; More and Better Employment; Sound Economic Policies; and Sustainable Growth, areas identified by Government as priority areas.


The Chairman asked the Taoiseach to consider the Committee’s recommendations as set out in the report and to support them in future meetings of the European Council.


The Chairman invited the Taoiseach to address the committee on the Lisbon Agenda. The Taoiseach outlined the work done by the Irish Presidency in promoting progress on the goals contained in the Lisbon Agenda. The Taoiseach explained that much progress has been made in the European Union and that the Irish presidency has been successful in reinvesting momentum into the process.


Following the Taoiseach’s contribution the Chairman invited questions from members of the committee and a wide ranging discussion followed during which the Taoiseach answered questions on topics such as


  • competitiveness and social inclusion
  • family friendly policies and the cost of child care
  • demographics
  • research and development
  • better regulation by the EU and
  • the patents directive

The Chairman and members of the committee thanked the Taoiseach for taking time out from his schedule to meet with the committee and for the interesting exchange.

1. Motion on GM Foods


The Chairman introduced the motion as follows;


That this Committee:


    - notes that the proposal of the European Commission to authorize the placing on the E.U. market of BT11 maize (genetically modified), failed to reach a qualified majority at the Council of Agriculture Ministers held in Brussels on the 26th day of April 2004.


    - notes that the health and safety issues of BT11 maize had not been discussed in either Houses of the Oireachtas, or in any Joint or Select Committee of the Oireachtas, before the said Agriculture Council on 26th April 2004.


    - further notes that this matter now falls to be decided by the European Commission


    - expresses its concern that such an important decision should now be made by an unelected body, ie. the E.U. Commission.


    - requests that a legal opinion be obtained as to whether or not the power of the Commission to make such an important decision is either:


  1. consistent with Bunreacht na hÉireann or
  2. lawful under the terms of the Treaty of Rome (as amended).

It was noted that an amendment to the motion had been received from Deputy Aengus Ó’Snodaigh and that part two of the amendment had been withdrawn.


Amendment to the Motion


At the Chairman’s invitation Deputy Ferris (in substitution for Deputy O’Snodaigh) moved the following amendment to the motion;


“regrets the decision of Irish representatives to vote in favour of lifting the embargo on BT11.” – (to be inserted in line 7 after “ 26 April 2004”).


Motion


The Chairman invited Deputy Mulcahy to move the motion. In his remarks Deputy Mulcahy noted the legal advice obtained by the Joint Committee on the matter and discussed the process of comitology by which this proposal had come to the Joint Committee’s attention.


Following Deputy Mulcahy’s contribution the chairman opened the floor to the other members of the committee and as a result of the debate Deputy Mulcahy agreed to withdraw the Motion and to submit at a later date in order to allow members to consider the matter and the legal advice received more fully.


In light of the debate Deputy Ferris agreed to withdraw the amendment to the Motion.

3. Correspondence


  1. Letter from the Chief executive of Co-operation Ireland, in connection with the PEACE II Programme.

It was noted that Members had received an email from Mr. Brian Carty of the European Anti Poverty Network seeking the Committee’s intervention in relation to the composition and remit of the recently appointed High Level Group on the Lisbon Strategy and commenting that the principle concern is that the composition of the Group has ignored the social policy perspective.


It was agreed to forward the Committee’s report to the High Level Group and also to seek assurances that the Social Policy aspects of the Lisbon Strategy will receive suitable consideration.

1. Report by Ms Katherine Meenan on Comitology.


The Chairman welcomed Ms Meenan and made brief introductory remarks, following which he invited Ms Meenan to make a presentation on her report for the members.


In his introductory remarks the Chairman noted the following;


  • That the Committee (at the meeting of 26 May 2004), considered a motion in the name of Deputy Mulcahy. The motion was withdrawn following discussions to allow time to consider advice from the Parliamentary Legal Advisor which dealt with comitology rules.
  • That the Committee asked consultant Katherine Meenan to prepare a report explaining the complex comitology procedures. It was noted that Ms Meenan checked the position with some other National Parliaments and has found that none have arrangements to scrutinize decisions arrived at through the comitology procedure.

Following the presentation the Chairman opened the discussion to the Members and it was agreed to ask Ms Meehan to prepare a more detailed report on the matter for discussion by the committee in due course particularly as it relates to accountability and transparency.


It was noted that following a substantive discussion the committee might consider whether to bring the report to COSAC for the committees of the 25 member states together with the European Parliament for them to consider in due course.

  4. Correspondence received from the Lithuanian Parliament in relation to a visit from European Ombudsman Mr P. Nikiforos Diamandouros.
  5. A note for information on the proposal to amend the Arbitration Convention (convention on the elimination of double taxation in connection with the adjustment of profits of associated enterprises) – This proposal is aimed to extend the provisions of the Convention to the 10 new Member States.
  6. - It is proposed to refer this directly to the Sub-Committee on EU Scrutiny. [The Convention provides a mechanism for the resolution of disputes on double taxation between participating member states]


  7. A letter of thanks from H.E. Mr Yasar Yakis, in relation to the Turkish delegation’s visit to Ireland.
  8. - It was agreed to note this item.


  9. Letter from Mr. Henry Rogers, an Irish national, living and working in Italy. Mr. Rogers is involved in a long term dispute with the Italian authorities in connection with the equal treatment of foreign workers. This Committee has corresponded with Mr. Rogers in the past on this issue. Mr Rogers has requested our support for his request to Minister of State Roche to intervene on his behalf with the Commission which is taking an action against Italy in this case.
  10. - it is proposed to issue a letter of general support to the Minister of State.


3. Any other business: - Report on XXXI COSAC


The Chairman made a brief report to the committee as to the outcome of the XXXI Conference of Chairman of European Affairs Committees, COSAC which was held in Dublin Castle on 19 – 20 May 2004.


It was noted that the main issues addressed at the conference were;


  • the scrutiny of EU business in accordance with the protocol on the role of national parliaments,
  • the Lisbon Agenda, and the implementation of the EU budget, particularly the Court of Auditors report,
  • the involvement of European regional and legislative assemblies,
  • the language regime in COSAC and proposed amendments to the rules of procedure.

The Chairman reported that the Conference went extremely well and that it appeared that there was a general feeling among members that for the first time COSAC dealt with business rather than with procedures. The Chairman further noted the many complimentary comments since the meeting. The vice Chairman supported the Chairman’s comments and agreed that it was an excellent COSAC meeting.


4. Adjourn


The Chair noted that a provisional date has been set for a committee meeting the following week. However, it was agreed to allow the Chairman to set a time since the proposed date conflicts with questions to the Minister for Foreign Affairs. The Chairman noted that if there is not sufficient business for a meeting next week, it may be postponed to the following week.

1. Motion on compensation for EU citizens contracting Hepatitis C


Deputy O’Keeffe moved the following motion;


That this Committee seek a report in relation to the case of a person (details supplied) and others who might have similar difficulty who contracted Hepatitis C in France some years ago and is not eligible for any special arrangements that were made available to persons who contracted Hepatitis C in Ireland. The French Authorities do not appear to have any compensation scheme for victims and that person is left in a limbo situation. This committee therefore seeks a report from the Department of Health and Children on what initiative can be taken at European level to ensure that the person concerned, and others in a similar situation could become eligible for assistance in Ireland on the basis of the scheme made available to those who contracted the disease through contact with the Irish services, or by the French or European Authorities under some reciprocal cover.” – Gay Mitchell TD, Jim O’Keeffe TD

Following the presentation the Chairman thanked the Minister of State and his colleagues for the work done during Ireland’s Presidency and for the manner in which the committee was kept informed despite a very busy agenda.


The Chairman then opened the discussion to the Members.


Romanian Orphanages

Following the debate on the GAERC the Chairman raised an issue with Minister of State Roche in relation to correspondence received by the Chairman from an organisation called Focus on Romania regarding the situation of orphanages there and requested that the Minister of State investigate the matter and reply to the committee when possible.


The Minister of State agreed to respond to the Committee and to the Chairman.


In conclusion the Chairman thanked the Minister of State and his officials.

1. Beslan.


The Chairman proposed that the committee formally convey the committee’s heartfelt sorrow and outrage at the enormity of the tragedy which occurred at Beslan in the previous week. The committee agreed that a message of solidarity be extended to the Russian people. The Minister of State, Dick Roche TD added his voice to the sentiment expressed by the Committee.

The Chairman welcomed the Minister of State and made brief introductory remarks, following which he invited the Minister of State to make a presentation.


Following the Minister of State’s presentation the Chairman invited questions on the General Affairs issues followed by the External Relations issue.

3. Report on Comitology and Parliamentary scrutiny


The Chairman noted that at the meeting of the Committee on 16th June 2004 it was agreed that the Consultant to the Committee would be asked to produce a detailed report on Comitology to be discussed in September.


The Chairman welcomed Katherine Meenan and invited her to make a brief presentation of her report. Following Ms Meenan’s presentation the Chairman invited questions.


In conclusion the Chairman thanked Ms Meenan for her report and it was agreed to ask Ms Meenan to build on the report as presented to produce a draft document specifically for the members of COSAC with a view to stimulating a debate on this subject.

1. Discussion with officials of the Department of Finance and the Department of Agriculture and Food on the Draft Preliminary Budget of the European Communities for the financial year 2005.


The Chairman noted the particular documents referred by the Sub-committee on European scrutiny to be considered by the committee relevant to the discussion as follows;

    COM(2004)402: Financial assistance to Iraq


    COM(2004)465 & SEC(2004)910: Financial assistance to the Turkish Cypriot Community


The Chairman noted that background briefing was provided by the Departments concerned.


The Joint Committee was attended by Mr Dermot Nolan and Mr John Palmer from the Department of Finance and Mr Tony Burke from the Department of Agriculture and Food.


Mr Dermot Nolan made a brief presentation on behalf of the Department of Finance, the lead Department on the proposals.


A question and answer session followed Mr Nolan’s presentation during which all witnesses contributed to the discussion and answered questions posed by members.


The topics covered included Structural and Cohesion funds, Common Agricultural Policy, Stability and Growth Pact and the emergency aid fund.


The Chairman thanked the witnesses for attending and confirmed that the committee would seek a meeting with relevant Departments for a mid term discussion of the Budget.

It was agreed to defer the Motion in the name of Deputy Haughey until the next meeting. In further discussion, it was agreed that the Committee should visit Turkey as a matter of urgency and the Chairman asked that arrangements be made to facilitate the visit as soon as possible.

In view of the delayed arrival of the Bulgarian delegation, it was agreed to take other business first.


1. Draft Annual Report of the Sub-Committee on EU Scrutiny


The Chairman introduced the First Annual Report of the Sub-Committee on EU Scrutiny. After a brief discussion the report was agreed and it was agreed to lay it before the Houses.


2. Proposal to visit Turkey.


The Chairman announced progress on arrangements for the visit. He informed the Committee that the Irish Ambassador to Turkey, H. E. Sean Whelan had passed away on 10th October. It was agreed that the Committee should send a letter of condolence to the Ambassadors family and to the Secretary General of the Department of Foreign Affairs.


It was also agreed that a letter of condolence should issue to the family of Mr. Ken Bigley, who had been executed by kidnappers in Iraq the previous weekend.


3. Motion on Turkish Accession (proposed by Deputy Haughey)


The Chairman announced that the Committee’s consultant has commenced work on arranging two meetings to allow the Committee hear informed views on the implications of Turkey’s accession to the EU. It was agreed that the Turkish Ambassador be invited to a meeting of the Committee.


4. Correspondence


  1. An invitation to attend the XXXXII COSAC in The Hague on November 22nd and 23rd 2004. It was agreed to send 6 Members to this meeting
  2. Letter from Ms Valerie Hughes requesting a meeting with the Joint Committee on behalf of human rights activists Albin Kurti from Kosova and Sonja Biserka from Serbia who which to address the Committee during their visit to Ireland at the end of November – It was agreed that, in view of the fact that the group were already scheduled to meet the Foreign Affairs Committee, no useful purpose would be served by arranging a second meeting. The request was therefore refused.

5. Meeting with a delegation from the Parliament of Bulgaria.


The Chairman welcomed the delegation from the National Assembly of Bulgaria to the meeting and invited Professor Ognian Gerdjikov , President of the National Assembly to commence with a presentation.


Following the opening remarks there was an exchange of views, following which the Chairman thanked the Bulgarian delegation.

1. Announcement


The Chairman Sean haughey TD announced that in accordance with an order of the Dái, Deputies Gay Mitchell and Jim O’Keeffe were discharged from the Committee and Deputies John Deasy and Bernard Allen were appointed in their place. 2. Election of a Chairman.


The temporary Chairman asked for nominations for position of Chairman. Deputy Andrews nominated Deputy Deasy. There being no other nominations Deputy Deasy was elected Chairman and took the chair for the remainder of the meeting

Turkey


The proposed visit to Turkey was raised and members agreed that it was very important for this visit to go ahead as soon as possible. It was noted that the Turkish Ambassador had suggested 17 to 20 November 2004. The Chairman informed the committee that plans were being made but that there were some timetable conflicts to be managed before a final arrangement could be made.


Proposed meetings


It was agreed that the committee meet with the Croatian Minister for European Integration and separately with the European Anti Poverty Network in two separate sessions on November 3rd 2004

2. Motion on Israel/Palestine


The Chairman put the following Motion to the Committee as submitted by Deputies Mulcahy, Andrews, Carey and Haughey and Senator Ormonde;


That this Committee:


    - commends the Government for its balanced policy towards Israel/Palestine and requests that the Government use its position at the heart of the EU to ensure that this problem remains a priority area for the EU;


    - welcomes the stated intention of the Israeli Government to withdraw from the Gaza strip as part of its implementation of the Roadmap process;


    - notes with concern the escalation of violent acts emanating from both sides to the conflict, which said acts only serve to impede and frustrate peace efforts;


    - welcomes the clear decision of the International Court of Justice on the illegality of the wall separating and encircling the Palestinian population of the West Bank, and the subsequent UN General Assembly resolution to the same effect, backed unanimously by all 25 EU members, but notes with regret that construction of the wall has continued;


    - notes that the Euro-Mediterranean Association Agreement between the European Communities and Israel includes in its Article 2 a provision stating that the agreement is based on respect for human rights and democratic principles, and considers that this clause is an important demonstration of the weight the Union attaches to the respect of human rights, providing a mechanism to bring the Union’s influence to bear in cases of non-respect of human rights;


    - notes with regret that severe human rights violations have been and continue to be committed in the West Bank and Gaza Strip by the military forces of one of the parties to the agreement and that the European Union has repeatedly called for an end to these violations and has addressed the issue in meetings of the Euro-Mediterranean Council;


    - notes with regret that despite the positions taken and statements issued to date by the European Union these human rights violations have continued, and that a number of human rights associations have called for the use of Article 2 of the Association Agreement as a mechanism to bring about the end of these violations;


    - considers that the European Union has a moral obligation to use all diplomatic means at its disposal to bring an end to these violations and to promote a peaceful and negotiated settlement;


The Chairman invited Deputy Mulcahy to formally move the motion. Deputy Mulcahy moved the Motion.


The Chairman then noted that an amendment to the Motion had been submitted by Deputy Aengus O’Snodaigh and put the amendment to the motion to the committee as follows;


To delete the words after “to ensure that this problem remains a priority area for the EU:” and to substitute the following:


    - Deplores all human rights violations and other violations of international law perpetrated during the course of this conflict and calls for their end;


    - Considers that the European Union has a moral obligation to use all diplomatic means at its disposal to bring an end to these violations and to promote a peaceful and negotiated settlement;


    - Notes with regret that grave and systematic human rights violations by the Israeli Defence Forces in the West Bank and Gaza Strip continue despite the repeated calls on the Government of Israel by the European Union to end these violations, and the raising of this issue in meetings of the Euro-Mediterranean Council;


    - Welcomes the clear decision of the International Court of Justice on the illegality of the wall separating and encircling the Palestinian population of the West Bank, and the subsequent UN General Assembly resolution to the same effect backed unanimously by all 25 EU members, but notes with regret that construction of the wall has also continued regardless;


    - Notes that the Euro-Mediterranean Association Agreement between the European Communities and Israel includes in its Article 2 a provision stating that the agreement is based on respect for human rights and democratic principles, thus providing a mechanism to bring the EU’s influence to bear in cases of non-respect for human rights;


    - Notes that a number of human rights associations and parliamentarians in Ireland and throughout the EU have called for the use of Article 2 of the Association Agreement as a mechanism to bring about the end of these violations of human rights and international law by Israel;


    - Considers that the value of the inclusion of a human rights clause in the Union’s association agreements with third countries will be brought into disrepute if no action is taken on foot thereof given the lack of progress in addressing Israel’s human rights violations through other mechanisms;


    - Therefore requests that the Government ensure that the Minister and Minister of State for Foreign Affairs propose to the General Affairs and External Relations Council the suspension of the EU-Israel Association Agreement under Articles 2 and 79, until such time as there has been a significant and measurable improvement in compliance with international human rights standards and specifically until there is compliance with the International Court of Justice ruling and UN General Assembly resolution on the separation wall;


    - Considers that for these same reasons, the deepening of relations with Israel under the European Neighbourhood Policy by the extension of an ‘everything but institutions’ agreement with Israel sends the wrong signal, and is therefore inappropriate at this time;


    - Therefore requests that the Government ensure that the Minister and Minister of State for Foreign Affairs not agree to the extension of an ‘everything but institutions’ agreement with Israel until such time as human rights violations by Israel have effectively ceased and there is full compliance with the International Court of Justice ruling and the relevant UN resolutions.”


The Chairman invited Deputy O’Snodaigh to formally move the amendment to the Motion. Deputy O’Snodaigh moved the Amendment to the Motion.


The Committee adjourned the debate on the Motion to deal with the Presentation by the Minister of State on the forthcoming General Affairs and External Relations Council.

Before commencing his presentation the Minister of State congratulated the Chairman and Deputy Allen on their recent appointments and thanked Deputy Jim O’Keeffe and the previous Chairman, Deputy Gay Mitchell and for their work.


The Minister of state commenced his presentation regarding the agenda for the forthcoming Council meeting and also touched on matters relevant to the Motion before the committee.


Following the Minister of State’s presentation the Chairman invited questions from the members of the committee on the Council Agenda.


In conclusion the Chairman thanked the Minister of State for his attendance.

The Chairman welcomed the Ambassador and thanked him for making himself available to the committee. The Chairman invited the Ambassador to make his presentation.

Proposed meeting with the Minister for Foreign Affairs in advance of the General Affairs and External Relations Council


It was agreed to meet with the Minister for Foreign Affairs or the Minister of State on Thursday 18 November 2004 (either 11.00 or 3.00pm to be confirmed) in advance of the General Affairs and External Relations Council. It was agreed to meet if the clerk could secure a quorum and that the Vice Chair, Deputy Sean Haughey, would chair the meeting.


Meeting with Latvian Delegation


It was agreed to meet with a delegation from the committee on Human Rights and Social Affairs and the committee for the implementation of the Law on Citizenship of the Latvian Parliament. It was agreed to circulate a note on the topics for discussion. It was agreed to meet on Tuesday 30th November 2004 at 2.00pm.


8. Reports on Motions considered by the Joint Committee.


The report on the motion regarding Turkish membership of the EU and on the motion concerning the Middle East Peace Process were circulated.

It was noted that members had been circulated with briefing for the meeting received from the Department of Foreign Affairs and in addition conclusions from the previous General Affairs and External Relations Council along with the ‘A’ points discussed at that meeting.


The Chairman invited the Minister to make his presentation followed by a presentation from the Minister of State on the agenda items relevant to Development Aid.


A question and answer session with the members of the Committee followed both presentations. Finally the Chairman thanked both Ministers for their attendance and their interesting contribution.


3. Report on The EEA and EFTA in a new Europe Conference in Reykjavik, Iceland 21/22 October 2004


It was noted that a draft report on the “EEA and EFTA in a new Europe” conference in Reykjavik was circulated to members. It was noted that Senator Lydon attended this conference on behalf of the committee. The Chairman invited Senator Lydon to comment on the report.


Following Senator Lydon’s contribution it was agreed that the report as circulated should be laid before both Houses of the Oireachtas.

It was noted that the plenary session of COSAC will take place in the Hague from 21st to 23rd November 2004 and that the agenda for the meeting covers a range of issues from

  • A “declaration to raise national awareness” and
  • The Lisbon process

It was noted that some of the issues on the agenda have yet to be “fleshed out” by the Presidency.


The Chairman encouraged any member, who could attend to make themselves available and to contact the Secretariat who will make every effort to make the necessary travel arrangements.


AOB2: Berlin Conference


It was noted that arrangements for attendance at the conference “A Soul for Europe” in Berlin on 27 – 28 November must be finalized shortly.

It was proposed to invite embassies to a reception during the Christmas period in order to promote the close relationship between the Joint Committee and the diplomatic corps. It was agreed that the secretariat would prepare a proposal for consideration by the committee.

The Chairman thanked the Minister for coming in to discuss its report with the committee so soon after the Minister’s last appearance.


The chairman gave a summary of the report and how the committee had come to its conclusion. The chairman invited other members of the committee to add their comments. In the discussion members thanked the Turkish Ambassador for his assistance to the committee both through his presentation but also with the visit of the committee’s delegation to the Republic of Turkey. Members also thanked the consultant to the committee and Mr Brian Earls in the Irish Embassy in Ankara for their help.


The Chairman then invited the Minister to respond to the report presented to him.

3. The Social dimension of the Lisbon Strategy: Presentation by the European Anti Poverty Network.

Following a question and answer session the Chairman thanked Mr Hanan and the other witnesses for addressing the committee. The Joint Committee agreed that ways to strengthen the Social dimension of the Lisbon strategy should be further discussed by the committee in the New Year (prior to the Mid term review scheduled for early March 2005). The Chairman on behalf of the committee invited Mr Hanan and his colleagues to make a submission to the committee to inform that discussion and suggesting ways they see to achieve the aim.

APPENDIX 11
Priorities of the Irish Presidency 2004

Ireland ’s Presidency Priorities

  • We currently see a number of headline issues for our Presidency: Enlargement, the Lisbon Agenda, advancing the Area of Freedom, Security and Justice, and of course the role of the EU on the world stage.
  • Ireland is supportive of and agrees with the Italian Presidency’s wish to complete the IGC and provide the Union with a new draft constitutional Treaty by the end of the year. However, we are also prepared to take on this vital dossier if the negotiations continue into our Presidency. If this happens this will of course be a key priority for us.

Enlargement

  • In relation to enlargement our focus will be very much on the integration of the new Member States and the need to ensure that the Council continues to function effectively. SEQ CHAPTER \h \r 1 We are looking forward to welcoming the new Members into the Union on May 1st.
  • Ireland will continue work in relation to Romania, Bulgaria and Turkey in accordance with previous European Council conclusions. We also expect to receive the Commission’s opinion on Croatia’s application for membership during our Presidency.

Lisbon Strategy

  • The Lisbon strategy will be a major priority for our Presidency and will be the focus for the Spring European Council. We are seeking to re-inject momentum into the strategy in the context of the current economic situation and of enlargement.
  • We are currently in the process of refining our priorities in this regard. These are likely to include competitiveness where our focus will be on completing the internal market, particularly in the area of services and on promoting investment in research and development.
  • Our other priorities are likely to relate to employment, infrastructural investment, continuing the modernisation of social protection and promoting greater investment in clean technologies.

Justice and Home Affairs

  • The focus in the Irish Presidency will be on the completion of the area of justice, freedom and security as set out in the Amsterdam Treaty and the broader Tampere programme.

External Relations

  • Some key priorities which are likely to feature prominently on the external relations agenda during the Irish Presidency include the EU-UN relationship, EU-US relations, the Middle East Peace Process, EU-Africa relations, relations with Western Balkans and conflict prevention and crisis management.
  • We will also work to highlight development issues on the EU agenda, including, action to curb the spread of HIV/AIDS, giving a sharper focus to poverty reduction in the Union’s development cooperation policy, improving the management of the Union’s aid programme and increased attention to conflict prevention and resolution in Africa.
  • Conflict prevention and crisis management will be a core element of our Presidency programme. Our Presidency comes at a time when ESDP is becoming increasingly operational. The Union currently has crisis management operations in FYROM (Operation Concordia) and a police mission in Bosnia (EUPM). Coming into our Presidency, we are looking at a new police mission in FYROM which will commence in December 2003. A Garda officer is already serving on the planning team and the question of Garda participation in the mission itself is under consideration. It is possible that negotiations on an EU take over of the current NATO-led SFOR in Bosnia may also be progressed during our Presidency.
  • Civilian crisis management continues to be an area in which the Union has significant work to do; not just in policing but it terms of the rule of law and civilian administration; and this is work which we as Presidency would particularly wish to progress. We also will be involved in non-ESDP missions, in particular as members of the UN peace-keeping mission in Liberia and the UN authorised NATO-led KFOR and SFOR missions in Kosovo and Bosnia.
  • As regards the EU-UN relationship, we look forward to the enlarged EU of 25 as having an enhanced voice and weight in the United Nations. Our aim is to commit the EU’s weight and influence to contributing to “effective multilateralism” through a reinvigorated UN. UNSG Kofi Annan recently announced the establishment of a High Level Panel to examine the challenges facing the UN, including reform, which is expected to report in September 2004. This time line presents a unique opportunity for Ireland’s Presidency as the EU will have an opportunity to give a strong impetus to the reform process.
  • The promotion of EU-US relations, which are so important to a stable and prosperous international climate, will feature prominently on our agenda. Efforts are being made on both sides of the Atlantic to rebuild relations following the Iraq war, and for our part we will work strenuously to improve them. The Taoiseach will lead the European side for the EU-US Summit which we expect will take place in Dublin late in the Presidency.
  • The Middle East Peace Process will inevitably be at the top of the agenda throughout our Presidency. Ireland believes the Quartet Roadmap still offers the best hope of a peaceful settlement to this long – running conflict.
  • We will wish to highlight the EU’s relationship with Africa during our Presidency. U-Africa dialogue has been at an impasse since the postponement of the EU-Africa Summit in 2002 over the Mugabe issue. We need to use the opportunity of our Presidency to try and move things forward.
  • The situation in the Western Balkans will continue to be high on the EU’s priorities during our Presidency. We hope to advance as far as possible the negotiations and implementation of the Stabilisation and Association Agreements with the five countries in the region. 2004 will also see increased political dialogue with the countries concerned.
