1. Content and Format of Report

This report has been prepared pursuant to Standing Order 84 (3), (4), (5) and (6) (Dáil Éireann) and Standing Order 69 (3), (4), (5) and (6) (Seanad Éireann) which provide for the Joint Committee to-


  • undertake a review of its procedure and its role generally
  • prepare an annual work programme
  • lay minutes of its proceedings before both Houses
  • make an annual report to both Houses .

At its meeting on 20th January 2005 , the Joint Committee agreed that all these items should be included in this annual report.


2. Functions and Powers

The Dáil Select Committee was established by Order of Dáil Éireann of 16 October 2002 to consider Bills, Estimates for Public Services and the terms of any international agreement involving a charge on public funds which come within the aegis of the Department of Health and Children.


The Dáil Select Committee under the same Order was enjoined with a Select Committee of Seanad Éireann, established by Order of Seanad Éireann of 17 October 2002, to form the Joint Committee on Health and Children. Among the principal functions of the Joint Committee are to consider –


  • public affairs administered by the Department of Health and Children;
  • matters of policy for which the Minister for Health and Children is responsible;
  • legislative and expenditure proposals of the Department;
  • scrutiny of EU legislative proposals;
  • certain matters relating to bodies under the aegis of the Department of Health & Children.
  • The Orders of Reference of the Dáil Select Committee and the Joint Committee are set out at Appendix 1.


3.Chairman, Vice-Chairman, Convenors and Membership

Deputy John Moloney was elected as Chairman of the Joint Committee on 17th November 2004. Deputy Jimmy Devins was elected as Vice-Chairman of the Joint Committee on Health & Children on the same day. The Chairman of the Joint Committee is also Chairman of the Dáil Select Committee.


Deputies Charlie O'Connor and Fergal Browne are the Convenors of the Committee whose function it is to ensure the availability and attendance of Members or their substitutes for meetings of the Committee and, in particular, to ensure Members' availability for divisions.


The Members of the Joint Committee are set out at Appendix 2.


4.Establishment of Sub-Committees.

Standing Order 81(3) (Dáil) and Standing Order 65(3) (Seanad) confer on Committees the power to appoint sub-Committees and to refer to such sub-Committees any matter covered by its orders of reference and to delegate any of its powers to such sub-Committees, including power to report directly to the Dáil and Seanad.


The Joint Committee agreed at its meeting on 3rd of March 2005 to create a sub-Committee to Review the Public Orthodontics Services. It was also agreed that the Sub-Committee would consist of 6 Members (4 from the Dáil and 2 from the Seanad). The Orders of Reference of the sub-Committee are set out in Appendix 3. The Members of the sub-Committee are set out in Appendix 4 . The sub Committee elected Fiona O' Malley TD as Chairperson.


The sub Committee produced a Report on the issue that was laid before both Houses on the 15th of June.


The Joint Committee agreed at its meeting on 29th of September 2005 to create a sub-Committee to consider The High Levels of Suicide in Irish Society. It was also agreed that the Sub-Committee would consist of 6 Members (4 from the Dáil and 2 from the Seanad). The Orders of Reference of the sub-Committee are set out in Appendix 5 . The Members of the sub-Committee are set out in Appendix 6. At its first meeting on the 4th of October 2005, the sub Committee elected John Moloney TD as the Chairman.


5.Meetings, Attendance and Recording

Meetings of the Joint Committee, Select Committee and sub-Committee took place in the Committee rooms in Leinster House 2000. Meetings were in public unless otherwise ordered by the Committee.


Televised coverage of public meetings of the Committee were broadcast live within the Leinster House complex and was available for subsequent public broadcasting by RTE and TV3.


An Official Report (Parliamentary Debates) of the public meetings of the Committees is published and may be purchased from the Government Publications Sales Office, Sun Alliance House, Molesworth Street, Dublin 2. 6. Number and Duration of Meetings

The Joint Committee met on 41 occasions in the year under report. The number of hours discussion involved in these meetings was in excess of 96 hours. The date and subject matter of each meeting is set out in paragraph 7 below and at Appendix 7.


The Dáil Select Committee met on 2 occasions in the year under report and the number of hours discussion involved in these meetings was in excess of 4 hours. The date and subject matter of each meeting is set out in paragraph 7 below and at Appendix 8.


The Sub-Committee on The Review of the Public Orthodontics Services met on 4 occasions during the year and the number of hours discussion involved in these meetings was in excess of 4 hours. The date and subject matter of the meetings is set out in paragraph 7 below and at Appendix 9.


The Sub-Committee on The High Level of Suicide in Irish Society met on 8 occasions during the year and the number of hours discussion involved in this meeting was in excess of 16 hours. The date and subject matter of the meetings is set out in paragraph 7 below and at Appendix 10.

7.2 Dáil Select Committee

On the 2 occasions the Dáil Select Committee met, it dealt with the following matters:

7.3 The Sub-Committee on The Review of the Public Orthodontics Service.

On the 4 occasions that it met, the Sub-Committee on The Review of the Public Orthodontics met in private sessions to discuss Orthodontic Treatment, Training needs and funding for specialist training places.


7.4 Sub-Committee on The High Level of Suicide in Irish Society.

On the 8 occasions that it met, the sub-Committee on The High Level of Suicide in Irish Society discussed with various experts the (underlying) issues relating to the high level of suicide in Irish society.

Orders of Reference

Dáil Éireann on 16 October 2002 ordered:

    1. That a Select Committee, which shall be called the Select Committee on Health and Children consisting of 11 members of Dáil Éireann (of whom 4 shall constitute a quorum), be appointed to consider -

The Chairman welcomed the following to the meeting:

and asked the representatives of AWARE to commence the presentation on


mental health issues.


Ms. Hogan commenced the presentation by outlining the role and work done by AWARE both to support those who suffer from depression and their families and to inform and educate the general public about mental illness.


The presentation was followed by a questions and answer session.


The Chairman thanked the witnesses for coming before the Committee and outlining for it the serious issues surrounding depression that affect a significant section of Irish society.


8. Presentation by the Schizophrenia Society of Ireland on Mental Health Issues.

The Chairman welcomed the following to the meeting:


  • Ms. John Saunders, Director;
  • Mr. Patrick Annesley, Chairperson;
  • Ms. Kahlil Thompson, Projects Officer of the Schizophrenia Society of Ireland.

and asked the witnesses to commence the presentation on mental health issues.


Mr. Saunders commenced the presentation by outlining the fundamental issues that effect the provision of the requisite mental health services and suggested possible reforms to enhance the existing services.


The presentation was followed by a questions and answer session.


The Chairman then thanked the Schizophrenia Society for enlightening the Committee as to what the fundamental issues regarding mental health in Ireland are today. The Chairman further stated that the meeting had been very informative and worthwhile and he assured both AWARE and the Schizophrenia Society that the Committee regarded mental health as a core priority issue.

The Tánaiste commenced the discussion by outlining the fundamental issues that effect the provision of the country's health services and spoke of her plans to enhance the existing services.


Deputies Liam Twomey (Fine Gael Spokesperson), Liz Mc Manus (Labour Spokesperson) John Gormley (Green Party/Technical Group Spokesperson), Jerry Cowley (Independent/ Technical Group Spokesperson), Jimmy Devins and Charlie O'Connor (Government Spokespersons) asked a number of questions to which the Tanaiste responded.


A question and answer session then ensued between the Tánaiste and all the members of the Committee.


It was agreed that the Department of Health and Children will send all the members a written response to the questions asked that weren't fully answered due to time constraints.


The Chairman thanked the Tánaiste for coming and outlining her proposals for such fundamentally important health issues.

The Chairman welcomed the following Officials to the meeting:

Mr. Pender outlined the main areas dealt with by the proposed Directive and Mr. Carey explained how it will be implemented in the health sector.


A questions and answers session ensued after which the Chairman thanked the officials for coming before the Committee and explaining what is proposed in COM (2004) 607 so comprehensively.


8. Presentation by the National Disability Authority on issues raised in it report ‘ Towards Best Practice in the Provision of Health Services for People with Disabilities in Ireland’.

The Chairman welcomed the following witnesses to the meeting:


  • Ms. Iris Elliott, Senior Policy and Public Affairs Adviser; National Disability Authority;
  • Ms. Marion Wilkinson, Policy and Public Affairs Adviser ; National Disability Authority;
  • Mr. Eric Koorneef, Senior Standards Officer, National Disability Authority

He then asked Ms. Elliott to commence the presentation on issues raised in the report ‘Towards Best Practice in the Provision of Health Services for People with Disabilities in Ireland’.


Ms. Elliott outlined the core findings of the Report with particular emphasis on the rights of people with disabilities to certain types of health services.


Deputy Jimmy Devins assumed the Chair at 11.56 am.

The Chairman then thanked the National Disability Authority representatives for attending the meeting and enlightening the Committee as to what the fundamental issues regarding the provision of disability services in Ireland are today. He also stated that it had been a very informative and worthwhile session and that the Committee regards disability issues as a core priority.

  • Report of a meeting with VIVAS Health Insurance Company held on 24th February 2005. VIVAS has indicated that it will write to the Joint Committee shortly requesting to come before it to discuss the Legal and Regulatory Structure of the Irish Health Insurance Market and Risk Equalisation. It was agreed that the meeting should be held on 12th May next.
  • The Committee noted the following correspondence:


  • Letter and current list of EU Scrutiny documents together with decisions taken by the Sub-Committee on EU Scrutiny at a meeting of the Sub-Committee held on 17th February last.
  • Scheduled meetings of the Committee up until May. Members should note that since that list was circulated another meeting has been organised where the Mayo Women's Support Services Group, the Rape Crisis Network and the National Network of Women's Refuges and Support Services will give a joint presentation on the present and future needs of Women's Support Services on Thursday, 9th June next. The Chairman welcomed Dr. Muiris MacCearthaigh and Mr. Philip Byrne of the IPA to the meeting. Dr. MacCearthaigh outlined some of the main issues that have emerged from the hearings to date as he perceives them such as the role of the Management Advisory Committee (MAC); the role of Special Advisers; the role of Minister of States and their relationship with Special Advisers and the relationship between the Minister and Secretary-General and their respective roles.


A discussion ensued following which the Committee agreed that the format of the Report could be agreed when the hearings had concluded.


4. Discussion with the former Special Advisers in the Department of Health & Children on the Report on Certain Issues of Management and Administration in the Department of Health & Children associated with the Practice of Charges for Persons in Long-Stay Care in Health Board Institutions and Related Matters.

The Chairman welcomed the former Special Advisers in the Department of Health & Children, Ms. Deirdre Gilhane and Mr. Christy Mannion, to the meeting. He then asked both Advisers to speak briefly on the findings and conclusions of the above Report.

A discussion ensued following which the Committee agreed to look at the matter further when the IPA had prepared the broad outline of their proposed approach to the draft Report for the meeting on 11th May next.

Statements by the Fine Gael and Labour Party Spokespersons on their proposed recommendations to the Report of the Committee on the Travers Report and Statements by Deputy Jerry Cowley on submissions by the Association of Higher Civil and Public Servants (AHCPS) and the Ombudsman on the Travers Report.

Deputy Jimmy Devins made a statement regarding a Press Conference held on 8th June by the Fine Gael and Labour Parties regarding their proposed recommendations that were not included in the Travers Report. In his statement he refuted that material had been surpressed from the Report.


Deputies Dan Neville, Liz McManus, John Gormley, Jerry Cowley and Senators Fergal Browne and Mary Henry then made individual statements raising concerns about the Committee Report and its lack of concensus.


The Chairman then asked the Fine Gael and Labour Spokespersons to make statements on their proposed recommendations for inclusion in the Joint Committee Report on the Travers Report.


Deputy Dan Neville and Senator Fergal Browne read the Fine Gael Party's proposed recommendations into the record and Deputy Liz McManus read the Labour Party's proposed recommendations into the record.


Deputy Jerry Cowley then read written submissions by the Association of Higher Civil and Public Servants (AHCPS) and Ombudsman on the Travers Report into the record.

It was agreed the submission would be sent to the DFI and IWA for their views prior to issuing and publishing the submission.

Deputy Fiona O'Malley table the following amendment to the Motion:


To delete all words after “That” and substitute the following:


“the Joint Committee on Health and Children commends the Tánaiste and Minister for Health and Children for moving swiftly to correct the nursing home charges issue and asks for immediate clarification as to why there is a delay in paying the charges.”

WORK PROGRAMME 2006


1. Introduction

In accordance with Standing Order 84(4) of Dáil Éireann and Standing Order 69(4) of Seanad Éireann the Oireachtas Committee on Health and Children hereby presents its Work Programme for 2006.


2. BACKGROUND

The Joint Committee on Health and Children was established following Orders of Dáil Éireann on 16 October 2002 and of Seanad Éireann on 17 October 2002. Standing Orders 84(4) (Dáil Éireann) and 69(4) (Seanad Éireann) require that –


“As soon as may be following its appointment and thereafter at annual intervals, each Select Committee shall prepare a work programme and shall lay such programme before [Dáil[Seanad] Éireann”.


3. Orders of Reference of the Joint Committee on Health and Children

The Orders of Reference of the Joint Committee empowers it to consider:


  1. such public affairs administered by the Department of Health and Children as it may select, including, in respect of Government policy, bodies under the aegis of that Department;
  2. such matters of policy for which the Minister for Health and Children is officially responsible as it may select;
  3. such related policy issues as it may select concerning bodies which are partly or wholly funded by the State or which are established or appointed by the members of the Government or by the Oireachtas;
  4. such Statutory Instruments made by the Minister for Health and Children and laid before the Houses as it may select;
  5. such proposals for EU legislation and related policy issues as may be referred to it from time to time, in accordance with Standing Order 91(4);
  6. the strategy statement laid before each House of the Oireachtas by the Minister in charge of that Department pursuant to section 5(2) of the Public Service Management Act, 1997, and
  7. shall be authorised for the purposes of section 10 of that Act; and;


  8. such Annual Reports or Annual Reports and Accounts, required by law and laid before either or both Houses of the Oireachtas, of bodies specified in paragraphs 2(a)(i) and (iii), and the overall operational results, statements of strategy and corporate plans of these bodies, as it may select;
  9. Provided that the Joint Committee shall not, at any time, consider any matter relating to such a body which is, which has been, or which is, at that time, proposed to be considered by the Committee of Public Accounts pursuant to the Orders of Reference of that Committee and/or the Comptroller and Auditor General (Amendment) Act, 1993;


    Provided further that the Joint Committee shall refrain from inquiring into in public session, or publishing confidential information regarding, any such matter if so requested either by the body concerned or by the Minister for Health and Children; and


  10. such other matters as may be jointly referred to it from time to time by both Houses of the Oireachtas,
    and shall report thereon to both Houses of the Oireachtas.

Accordingly, the items listed in this Work Programme will be considered by the Joint Committee within the parameters defined by it's Orders of Reference, as amended from time to time.


4. OVERSIGHT AND ACCOUNTABILITY

The Joint Committee on Health and Children is committed to making a constructive contribution to the committee system in the Houses of the Oireachtas and to continuing to assert the proper oversight and accountability role of the Legislature in respect of the Executive. It will endeavour to do this by properly exercising the functions and powers which have been conferred on it by both Dáil Éireann and Seanad Éireann.


5. FLUIDITY OF WORK PROGRAMME

The items listed for consideration in this Work Programme are not in any order of priority. The Joint Committee will decide on individual items for review in light of its assessment of a particular need during the year. The Joint Committee is of the opinion that to accord a strict priority and agree a timetable for consideration of the various items would impose too rigid a structure and would not enable the Joint Committee to respond to evolving events during the year. In response to a particular evolving event or an urgent unforeseen matter, it shall, if it deems it necessary to do so, amend this Work Programme to include further items or delete or revise existing items for consideration.


The Joint Committee has also agreed that, should it not have sufficient time during 2006 to consider an item detailed in this Work Programme, it may include it in next year's Work Programme should the issue continue to retain its importance and relevance.


6. JOINT COMMITTEE – GENERAL AREAS FOR CONSIDERATION

(a) EU Scrutiny

In light of the increasing importance and influence of the European Union (EU) on national affairs and legislative matters, the Joint Committee will give ongoing priority to EU issues and, in particular, will promptly examine any EU legislative proposal referred to the Joint Committee by the Sub-Committee on European Scrutiny.


The Joint Committee will endeavour to have ongoing meetings with the Minister for Health and Children in advance of EU Council meetings to enable the Joint Committee to enhance effective oversight of Government policy thinking and to have an input into, and an exchange of views on, topics arising on the agendas of those Council meetings.


(b) Statutory Instruments

The Joint Committee will endeavour to monitor Statutory Instruments (SIs) made by the Minister for Health and Children which are laid before both Houses of the Oireachtas and, where it considers it necessary, will discuss particular SIs and matters arising with the Minister at an appropriate time.


(c) Strategy Statement and Departmental Policy Documentation

The Joint Committee will endeavour to consider the ongoing progress made by the Department of Health and Children on its commitments in the strategy statement and other general related policy documentation (vis. Annual Reports, Corporate Plans, etc.) relating to the Department's remit in discussion with the Minister or appropriate Departmental officials.


(d) Oversight of bodies

The Joint Committee will endeavour during 2006 to consider, inter alia, policy matters, annual reports or annual reports and accounts, overall operational results, statements of strategy and corporate plans of certain bodies as it may select which are listed in the Addendum attached to this Work Programme.


(e) Referral of matters by Dáil Éireann and Seanad Éireann

In addition to those issues detailed in this Work Programme, the Joint Committee may be required, from time to time, to consider matters referred to it jointly by Dáil Éireann and Seanad Éireann (e.g. Motions re. International Agreements, Conventions, draft SIs, etc.).


7. JOINT COMMITTEE – SPECIFIC ITEMS FOR CONSIDERATION

The Joint Committee intends to review specific major areas of policy falling within the remit of the Minister for Health and Children as outlined below in this section and in section 5 above. As part of that process, the Minister (and Departmental officials) may be invited to appear before the Joint Committee to outline policy decisions/thinking and respond to detailed questions. Where necessary, the Joint Committee may also seek submissions from the public and may, if the need arises, engage persons with specialist or technical knowledge to advise and assist it in its work.


The Joint Committee will have ongoing periodic follow-up with the Minister (or Departmental officials as appropriate) on progress made on implementation of recommendations made in Reports published by the Joint Committee during the 29th Dáil.


It is also intended that the following specific items will be considered during 2006 by the Joint Committee:-

  • Ireland's National Diabetes Strategy especially Type 2 Diabetes
  • Significant rise in Obesity levels in Adults and Children

General Medical Service.

  • Specialist Training for GPs treating patients with mental illness, alcohol and/or drug addictions and those at risk of committing suicide.
  • Irish Medical Council briefing on issues of concern to the Committee

Skills shortages in the Health Services.

  • Recruitment and retention of qualified Medical Personnel to include Doctors, Nurses, Physiotherapists, Speech and Language Therapists and Occupational Therapists by Health Boards.

Treatment of Infectious Diseases.

  • Prevention and treatment of AIDS/HIV and Sexually Transmitted Diseases.
  • MRSA and families

Treatment of Addictions.

  • Availability of appropriate referral treatment for alcohol, drug and other substance abuse addictions.

Health Services for the Elderly.

  • Community Care Facilities available for Elderly People including the Travers Report

Disability Issues.

  • Present and future needs of the physically disabled, particularly wheelchair users.
  • Current operation of the Disabled Drivers and disabled Passengers (Tax concessions) Scheme
  • National Disability Strategy
  • Progress made in providing life-long health services to people with autism and related disorders

Men and Women's Health Issues.

  • Greater understanding and promotion of Men's Health Issues.
  • Screening and treatment available for Cervical, Prostrate and Breast Cancer to include a review of the national roll-out of the ‘Breast Check’ Programme.
  • Establishment of a National Cancer Screening Register.
  • Progress made in implementing the recommendations contained in the Report entitled ‘Development of Radiation Oncology Services in Ireland’.

Health Education and Promotion.

  • Education Programmes for young people on Alcohol and Drug Misuse and suicide prevention

Mental Health.

  • Present and Future needs of the Mental Health Services.
  • Suicide Rates among Irish Men.
  • Nature and understanding of Depression in Irish society.
  • Facilities available for patients with a Dual Diagnosis (a Mental Health problem and an addiction to alcohol or drugs)

Children.

  • Re-sourcing of a National Directory of Youth at Risk Service and the establishment of a Peer to Peer Support Programme
  • Health Services for Children including the National Children's Strategy.
  • Levels of Autism and related disorders among Irish Children.
  • Implementation of the UN Charter on the Rights of the Child.
  • Current vaccination policy and practice, poor take-up rates and public concerns regarding risks and adverse effects.
  • High levels of childhood obesity and the possible link with TV advertisements promoting nutritionally deficient, highly calorific foods.
  • Child protection issues.

Scrutiny of EU Business.

  • Scrutiny of EU legislative proposals pertaining to the Department of Health and Children.

Strategy Statement and the Strategic Management Initiative.

  • The Joint Committee will consider the S.M.I. documents relating to the Department of Health and Children in detail during the year and report annually on progress made by the Department.

8. TRAVEL

Subject to Standing Order 81(9) [Dáil Éireann] and Standing Order 65(9) [Seanad Éireann], the Joint Committee may decide, subject to financial, administrative and procedural constraints, to undertake travel as it considers necessary to further progress the Work Programme. Such travel may include fact finding visits, attendance at conferences or meetings, etc. within the remit under the Orders of Reference. Reports will be completed for all travel undertaken.


9. INCOMING PARLIAMENTARY DELEGATIONS

The Joint Committee will meet with incoming Parliamentary Delegations, as required.


10. Select Committee on Health and Children

Those members of Dáil Éireann who are members of the Joint Committee on Health and Children also constitute the membership of the Select Committee on Health and Children. In accordance with paragraph 1(a) of the Order of Dáil Éireann, the Select Committee is appointed to consider –


  1. such Bills the statute law in respect of which is dealt with by the Department of Health and Children
  2. such Estimates for Public Services within the aegis of the Department of Health and Children; and
  3. such proposals contained in any motion, including any motion within themeaning of Standing Order 157 concerning the approval by the Dáil of international agreements involving a charge on public funds,
    as shall be referred to it by Dáil Éireann from time to time.”

The matters referred to the Select Committee will be considered in tandem with the ongoing work of the Joint Committee but may have a practical effect on the capacity of the Joint Committee to complete its consideration of the items identified in the Work Programme.


11. NUMBER AND FREQUENCY OF MEETINGS

Taking account of the resources and facilities available and the commitments of members, it is anticipated that the Joint Committee will meet fortnightly in the course of 2006.


In view of the specific functions of the Select Committee, it is not possible to anticipate the number of meetings required during 2006. However, the Select Committee will convene as necessary to consider such matters as are referred to it (see above) within the prescribed timeframe.


12. AGREEMENT OF WORK PROGRAMME

This Work Programme for 2006 of the Joint Committee on Health and Children and the Select Committee on Health and Children was agreed by the Committee at its meeting on 2nd February, 2006. In accordance with Standing Orders of Dáil Éireann and Seanad Éireann, it was agreed that the Work Programme be laid before both Houses of the Oireachtas.
