1. Content and Format of Report

This report has been prepared pursuant to paragraphs 3, 4, 5 and 6 of Standing Order 79A, Dáil Éireann and paragraphs 3, 4, 5 and 6 of Standing Order 63, Seanad Éireann which provides for Joint Committee reports and work programmes as follows–


review of its procedure and its role


annual work programme


laying minutes of proceedings


making an annual report.


The Committee approved the annual report at its meeting on 27th March, 2002


2. Functions and Powers of the Joint Committee

The Joint Committee on Agriculture, Food and the Marine was established by Order of Dáil Éireann of 13th November, 1997 and Order of Seanad Éireann of 19th November, 1997 as part of a programme of Oireachtas reform involving the refining of the Committee system to enable more detailed examination of Government Departments including–


public affairs administered by each Department


legislature and expenditure proposals of each Department


certain matters relating to bodies under the aegis of each Department.


The Orders of Reference of the Joint Committee were modified by further Orders of Dáil Éireann of 28th April, 1998 (new subparagraph (2)(a)(iv) added) and Seanad Éireann of 30th April, 1998 (new subparagraph (2)(a)(iv) added) and the Orders of Reference of the Joint Committee, as so modified, are set out at Appendix 1.


3. Chairman, Vice-Chairman, Convenors and Membership

Deputy John Ellis resigned from his position as Chairman of the Joint Committee on 9 November, 1999. Mr. Michael Collins, T.D., was appointed to the Committee on the 24 November, 1999. Deputy John Browne (Wexford) was elected as Chairman of the Joint Committee on 25 November, 1999. The Chairman of the Joint Committee is also Chairman of the Dail Select Committee.


Deputies John Brady and P.J. Sheehan are the Convenors of the Committee whose function it is to ensure the availability and attendance of Members or their substitutes for meetings of the Committee and, in particular, to ensure Members’ availability for divisions.


The Members of the Joint Committee are set out at Appendix 2.


4. Meetings, Attendance and Recording

Meetings of the Joint Committee took place in the Committee rooms in Kildare House. Meetings were in public unless otherwise ordered by the Joint Committee.


Televised coverage of public meetings of the Joint Committee was broadcast live within the Leinster House complex and was available for subsequent public broadcasting.


Copies of other reports published by the Joint Committee may be obtained from the Clerk, Joint Committee on Agriculture, Food and the Marine, Kildare House, Kildare Street, Dublin 2. A list of any such reports is set out at Section 8.


5. Number and Duration of Meetings

The Joint Committee met on 17 occasions in the period under report. The number of hours discussion involved in these meetings was in excess of 21 hours. The date and subject matter of each public meeting is set out at Appendix 3.


The Dáil Select Committee met on 8 occasions in the period under report and the number of hours discussion involved in these meetings was in excess of 11 hours. The date and subject matter of each meeting is set out at Appendix 4.


Records of attendance by Members of the Joint Committee and their duly nominated substitutes at meetings of the Joint Committee are set out at Appendix 5.


Records of attendance by Members of the Dáil Select Committee and their duly nominated substitutes at meetings of the Dáil Select Committee are set out at Appendix 6.

6. Work of the Committee

6.1 Joint Committee

On the 17 occasions the Committee met it dealt, inter alia, with the following matters:

9. Travel by the Joint Committee

The Joint Committee undertook three visits during the course of the year, as follows:


(i)Seoul, Korea, 19-25 February, 2000: A delegation of one Member, Deputy P.J. Sheehan, accompanied by the Clerk attended the inaugural Conference of the Inter-Parliamentary Association for Agriculture and Fisheries (IPAAF) from Monday to Thursday, 21 to 24 February 2000.


(ii)Paris 29-31 May 2000: A delegation of four Members led by the Chairman, Deputy John Browne (Wexford) and Deputies Paul Connaughton, Willie Penrose and Senator Peter Callanan accompanied by the Clerk visited the Rungis market in Paris The itinerary included a visit to a hypermarket to see the range of Irish and other agricultural products on display and meetings with An Bord Bia and BIM. Minister of State Deputy Ned O’Keeffe accompanied the delegation.


(iii)London/Grimsby: A delegation composed of six Members led by the Chairman Deputy John Browne (Wexford) and Deputies Paul Connaughton, John Brady and PJ Sheehan and Senators Rory Kiely and Francis O’Brien accompanied by the Clerk visited the UK to discuss Marine related matters with various groups. The itinerary included a meeting with the Select Committee of Agriculture of the House of Commons, the Tory Opposition spokesperson on the Marine and a visit to Grimsby for discussions with various fishing groups and viewing of processing facilities.


10. Function and Powers

The Committee remains content with its present procedures and its role but once again considers its general staff resources to be wholly inadequate. The Committee notes that it shares its Clerk and other staff member with another Committee. It considers that each Committee should have a full-time Clerk and appropriate full-time support staff. This is not the position at present due to the unnecessarily restrictive policy on staffing in the Houses of the Oireachtas. The key criterion for an effective committee system is adequate resourcing and staff resources in particular must be sufficient to permit all Joint Committees, as agents of both Houses, to efficiently and effectively discharge their obligations. The staffing situation should therefore be corrected as an imperative.

APPENDIX 1

Orders of Reference

Dáil Éireann

13th November, 1997, (*28th April, 1998)


(1) (a)That a Select Committee, which shall be called the Select Committee on agriculture, Food and the Marine, consisting of 14 members of Dáil Éireann (of whom 4 shall constitute a quorum), be appointed to consider such—


(i)Bills the statute law in respect of which is dealt with by the Department of Agriculture, Food and the Marine, and


(ii)Estimates for Public Services within the aegis of that Department,


as shall be referred to it by Dáil Éireann from time to time.


(b)For the purpose of its consideration of Bills under paragraph (1)(a)(i), the Select Committee shall have the powers defined in Standing Order 78A(1), (2) and (3).


(c)For the avoidance of doubt, by virtue of his or her ex officio membership of the Select Committee in accordance with Standing Order 84(1), the Minister for Agriculture, Food and the Marine (or a Minister or Minister of State nominated in his or her stead) shall be entitled to vote.


(2) (a)The Select Committee shall be joined with a Select Committee to be appointed by Seanad Éireann to form the Joint Committee on Agriculture, Food and the Marine to consider–


(i)such public affairs administered by the Department of Agriculture, Food and the Marine as it may select, including bodies under the aegis of that Department in respect of Government policy,


(ii)such matters of policy for which the Minister in charge of that Department is officially responsible as it may select,


(iii)the strategy statement laid before each House of the Oireachtas by the Minister in charge of that Department pursuant to section 5(2) of the Public Service Management Act, 1997, and shall be authorised for the purposes of section 10 of that Act,


*(iv)such Annual Reports or Annual Reports and Accounts, required by law and laid before either or both Houses of the Oireachtas, of bodies under the aegis of the Department(s) specified in operational results, statements of strategy and corporate plans of these bodies, as it may select.


Provided that the Joint Committee shall not, at any time, consider any matter relating to such a body which is, which has been, or which is, at that time, proposed to be considered by the Committee of Public Accounts pursuant to the Orders of Reference of that Committee and/or the Comptroller and Auditor General (Amendment) Act, 1993.


Provided further that the Joint Committee shall refrain from inquiring into in public session, or publishing confidential information regarding, any such matter if so requested either by the body or by the Minister in charge of that Department; and


(iv)such other matters as may be jointly referred to it from time to time by both Houses of the Oireachtas,


and shall report thereon to both Houses of the Oireachtas.


(b)The quorum of the Joint Committee shall be 5, of whom at least 1 shall be a member of Dáil Éireann and 1 a member of Seanad Éireann.


(c)The Joint Committee shall have the powers defined in Standing Order 78A(1) to (9) inclusive.


(3)The Chairman of the Joint Committee, who shall be a member of Dáil Éireann, shall also be Chairman of the Select Committee.

Report on the visit of a delegation from the Joint Committee to Norway, 6-9 September, 1999


Deputy Finucane presented his report on the visit of a delegation from the Joint Committee to Norway from 6-9 September. The Report was agreed to.


Invitation to the Inaugural Assembly of the International Parliamentarians’ Association for Agriculture and Fisheries (IPAAF)


It was agreed by the Joint Committee that Deputy PJ Sheehan and the Clerk to the Committee would attend the IPAAF in Seoul, Korea, 22 to 24 February, 2000. Draft costings were also agreed and it was further agreed that the Conference fell within the terms of reference and work programme of the Joint Committee.


Competition Authority


The Chairman advised the Committee that the Competition Authority had indicated their willingness to appear before the Joint Committee. It was agreed that representatives from the Competition Authority should be contacted by the Clerk to see if Wednesday, 1 March was suitable date for such a meeting.


Any Other Business


(i)Work Programme


The Chairman said the Clerk would draw up a provisional work programme up to the Easter recess.


(ii)Proposed Visit to House of Commons and Scotland


Deputy Michael Finucane proposed that representatives of the Committee visit Westminster in order to meet with their counterpart committees\s. He also proposed that, having regard to its marine brief, the Committee should visit Scotland so that it could study the management of off-shore oil facilities and the impact on ports or local communities where the oil came on-shore. This was agreed and the Clerk was asked to investigate the matter.


(iii)Proposed Visit to Beef Markets in Paris and Berlin


Deputy Penrose suggested that the Committee visit the beef markets in Paris (the Rungis market) and perhaps Berlin. This was agreed and the Clerk was asked to investigate the matter.


(iv)Northern Ireland


The Chairman suggested that the Committee should consider meeting the corresponding committee in Northern Ireland which was chaired by Dr. Paisley. Deputy Michael Kitt suggested that the Committee invite Ms. Bríd Rogers before it and that it find out if there was a section in the Department of Agriculture dealing with Northern Ireland. The Clerk was asked to enquire about both matters and report back.


(v)Food Safety and GMOs


It was suggested the Professor Michael Gibney and Dr. Pat Wall who had addressed a major conference in Trinity College Dublin on food safety be invited before the Committee. Senator Quinn also suggested that having regard to the agreement recently reached in Montreal on GMOs the Committee should consider the matter. The Chairman agreed that these topics were certainly of interest and should be considered in the context of the 2000 Work Programme.

(i)Introduction by Chairman


The Chairman welcomed the representatives from the Competition Authority to the meeting and informed them that the purpose of the meeting was, inter alia, to discuss recent allegations that a cartel was operating in the meat industry.


(ii)Presentation and Question and Answer Session.


Mr. Patrick Massey, Director of Competition Enforcement made a presentation to the Committee. This was followed by a lengthy and detailed question and answer session with the Members in which others of the witnesses present participated.


(iii)Decisions of the Joint Committee


The Committee agreed to a suggestion by the Chairman that he write to the Tánaiste and Minister for Enterprise, Trade and Employment, Ms Mary Harney, T.D. regarding the inadequate resourcing of the Competition Authority.


5.Any other Business


It was agreed that the Committee would, subject to room availability, hold a meeting at 10 a.m. on Wednesday 8 March in Room G.5, Kildare House, in order to meet with representatives of the Department of Agriculture and Food regarding the changes in the milk quota regime. It was also agreed that the Committee should invite representatives of the Concerned Milk Quota Holders Group to attend this meeting in order to discuss their concerns with the Committee.

Mr Tom O’Donnell, Principal Officer, outlined the changes in the milk quota regime. Mr. James Caverly, PRO for the Concerned Milk Quota Holders Group, then outlined the concerns of his group and presented a document to the Committee which detailed their viewpoint. A detailed question and answer session then ensued with the Members.


(iii)Decisions of the Joint Committee


The Committee agreed to a suggestion by the Chairman that he would write to the Minister for Agriculture with regard to the proposed regulations on milk quotas.


5.Any other Business


It was agreed that the Committee should invite both the officials from the Department of Agriculture and Food and representatives from the Concerned Milk Quota Holders Group to a further meeting of the Joint Committee so that the issue could be more fully discussed.

4.Presentation by Irish Wool Federation


The representatives of the Irish Wool Federation made a presentation during the course of which expressed deep concern at the decline in the value of wool and asked for the assistance of the Committee in determining if alternative uses existed for the product. The presentation was followed by a question and answer session with Members. The Committee undertook to consider the points made by the delegation.


The Committee suspended at 4.35 p.m. in order to attend simultaneous votes in the Dáil and Seanad. The Committee resumed at 4.48 p.m.


5.Presentation by the Department of Agriculture re Bovine T.B. and Brucellosis


Mr Healy from the Department of Agriculture and Food made a brief general presentation on bovine TB and brucellosis and provided the Committee with a handout. He also explained that representatives from the veterinary area of the Department could not attend due to an important prior engagement in Europe but would be happy to attend a later meeting if this was required. A question and answer session with Members took place following the conclusion of the presentation.


The Chairman thanked the representatives for coming before the Committee on short notice and for the excellence and conciseness of their presentation.


6.Authorisation for proposed visit to Rungis market, Paris (30 May - 31 May)


A costing for the proposed visit was agreed and the Committee certified that the visit fell within its terms of reference.


7.Any other Business


It was agreed that the Committee should meet the Minister before meeting the Milk Rights Group on 21 June.

4.Meeting with the Milk Rights Group


(i)Introduction by Chairman


The Chairman welcomed the representatives from the Milk Rights group to the meeting. He suggested that as the Committee were familiar with the general issues the Group might make a brief presentation which would be followed by a questions and answers session with Members.


(ii)Presentation and Question and Answer Session.


The representatives of the Milk Rights Group made a presentation and circulated the Committee with various documents. The presentation was followed by a question and answer session with Members. The Committee agreed that the group had a strong case for compensation and that the main issues to be determined were the potential numbers to be compensated and the nature of the compensation.


(iii)Decisions of the Joint Committee


The Committee agreed to write to the Minister and to state that:


In the opinion of the Committee the Milk Rights Group had a very strong case for compensation based on the determination of the Supreme Court in the Duff ?? case. Their case for compensation should not be denied on technical grounds such as the statute of limitations.


The Department should determine once and for all the precise numbers of farmers who would be entitled to compensation. This could be achieved by an examination of the Department’s files and\or advertising in the newspapers. It was noted that the Milk Right Group had already undertaken such an exercise, had a precise estimate of the numbers affected, and would be in a position to assist the Department by providing them with copies of documents such as farm plans which they had in their possession. In this regard the Committee agreed to seek a meeting with Departmental officials to discuss the quantification of numbers.


The Minister should immediately ‘ring-fence’ the 11.5 million gallons until the numbers of farmers entitled to compensation was determined.


Compensation could be in the form of an allocation of quota from the ring-fenced 11.5 million gallons or money or both.


It was agreed that the Clerk should draft a letter to the Minister outlining the Committee’s views and seeking a meeting with officials.


The representatives of the Milk Rights Group thanked the Committee for meeting them and for all their efforts to have their case settled. In turn the Chairman, on behalf of the Committee, thanked the group for coming before the Joint Committee and for making such a strong case.

It was also agreed that the delegation should visit a fishing port in the UK, perhaps Grimbsy or Hull, in order to see the fishing facilities and hold discussions with appropriate bodies.

4.Consideration of draft letter to Minister for Agriculture and Food re Milk Rights Group issue


The Committee considered and approved without amendment the draft letter brought forward by the Chairman in relation to the issues raised by the Milk Rights Group, the content of which had been agreed at the previous meeting. The Chairman also suggested that a delegation from the Committee might consider meeting the Minister in order to work out some type of equitable settlement.


5.Any other Business


It was agreed that the next meeting of the Committee should take place on Wednesday 19 July at 2 p.m. subject to room availability and that the subject matters should be a meeting with representatives of the Department of Agriculture and Food re Agri-Food 2010 and followed by discussions with some of their colleagues regarding the mechanism for establishing the numbers of farmers entitled to compensation who were not covered by the judgement of the Supreme Court and whose cases the Department was now treating as statute-barred. It was also agreed that the meeting should conclude by 3.30 p.m. at the latest.

The Vice-Chairman formally welcomed Mr. Jan Fencl, Czech Minister for Agriculture, his colleagues and H.E. Mr Petr Kolar to the meeting. He then invited the Minister to make a presentation to be followed by a question and answer session with Members.


(ii)Presentation and Question and Answer Session.


In his speech Mr. Fencl outlined, inter alia, the Czech Republic’s application for EU Membership and emphasised that accession was their number one priority. He stressed that their country was looking for equal treatment with other Member States. At the conclusion of his speech a detailed question and answer session then followed with Members.


6.Correspondence Received


(iiRequest for Meeting from Mr. Bernard Lambert, Beet Grower


The Committee considered correspondence dated July 18, 2000, concerning a request for a meeting which was received from the above person. It was decided not to accede to the request as it was the view of Members that the matter reflected a dispute of a contractual nature and was not appropriate to the Committee.


(iiSea Fishing Boat Licences


The Committee considered correspondence dated 28 July, 2000 which had been received from Mr. Mark Lochrin, Irish Fish Producers’ Organisation. Mr Lochrin sought the intervention of the Committee in examining the merits of the case for an appeals mechanism for persons aggrieved by decisions of the Ministers for Marine and Natural Resources in respect of the issue or renewal of sea licences. The Committee agreed that in the first instance the Clerk should write to the Department of Marine and Natural Resources on the matter and also that the Clerk should write to the Department of Agriculture and Food seeking information on the appeals mechanism being established by the Minister in respect of disallowals of direct payments by that Department to farmers.

(i)Animal Vaccines


Deputy Dukes raised the matter of alleged proposals made by the Irish Medicines Board (IMB) to the Minister for Agriculture about the regulation of animal ruminant vaccines. He suggested that the Committee should meet with the relevant parties as soon as possible. This was agreed.


(ii)Organic Farming


Deputy Dukes raised the matter of the proposals by the Minister to replace the three existing bodies regulating this area with one body. He suggested that the Committee meet the Department and the three existing regulatory bodies who were strongly opposed to the move. This was agreed.


(iiThirty Day Compulsory Pre-Movement Test


Deputy Dukes said that he understood that the Department of Agriculture and Food proposed to introduce a thirty day compulsory pre-movement test. He stated that this had been tried before and had not worked and suggested that the Committee should talk to the Department on the matter.


Deputy Dukes also stated that the Committee should receive the same level of consultation as the farm organisations and this was not the case at the moment.


(iiMilk Quotas


Senator Kiely asked for a list of dairy farmer\milk producers who were awarded quota under restructuring. He wished to know what their quota was before the award and what their quota was after the award as concerns had been raised about the manner of allocation. This was agreed.

At the request of Deputy Dukes it was also agreed that the Committee should invite to the same meeting representatives from the three existing regulatory bodies in the organic farming sector to discuss the recent proposals by the Minister to replace the three existing bodies regulating this area with one body. The Department could be invited in at a later stage on the latter matter.


(iiFuture of Agricultural Colleges


At the request of Deputy Penrose it was agreed to invite the Director of Teagasc before the Committee to discuss proposals contained in the Kennedy report to close several agricultural colleges. It was agreed that this meeting should take place in four weeks time.

A detailed question and answer session followed with the discussion focusing on the manner in which the ESRI Report had been compiled, the future funding of private agricultural colleges and the role of agricultural colleges in encouraging rural redevelopment.

5.Committee Travel

It was also agreed that all travel undertaken would be in the context of the Work Programme of the Committee for the forthcoming year.


6.IFA Family Farm Group


Further to its Meeting on 25 October where a submission was heard form the IFA Family Farm Group on the treatment of women under the tax and social welfare codes, it was agreed that an informal subgroup of the Joint Committee be established (consisting of the Convenors and the Spokespersons) to draft a recommendation for transmission to the Minister for Finance. It was further agreed that this draft recommendation be circulated to all Members of the Committee and, if no objections to same are notified to the Clerk, the recommendation shall be forwarded to the Minister for Finance without further referral to the Joint Committee.


7.Milk Quotas


At the request of Senator Kiely, it was agreed that the Clerk to the Committee review the Minutes of the Meeting of 20 September, 2000 at which this matter was initially raised and review also the correspondence that was to issue following that Meeting.


8.Crisis in the Beef Industry


Deputy Stanton proposed that, notwithstanding the decision of the Committee to next meet on 20th December, an urgent Meeting be convened to discuss the crisis in the beef industry. This proposal was agreed to and it was further agreed that the Meeting take place on Wednesday, 29th November at 10.00 a.m.


The Committee went in to Public Session at 4.19 p.m.

The Chairman welcomed Mr. Joe Walsh, T.D., Minister for Agriculture, Food and Rural Development, together with his officials to the meeting and thanked the Minister for attending at such short notice.


The Minister made a statement in relation to the main issues facing the Beef Industry following the increase in the incidence of BSE across Europe. The statement outlined the provisions of the control system of surveillance operating in Ireland; details of the export subsidy available to farmers and the alternative market intervention practices available to the European Commission if this export subsidy is insufficient in meeting the needs of the producers.


A question and answer session followed with the discussion focusing on the need to maintain consumer confidence and to support the producers and processors in the industry. In addition the disposal of rendered material was highlighted as a problem requiring resolution.


On the conclusion of the question and answer session, the Chairman thanked the Minister and his officials for attending and the visitors withdrew.


The Committee went in to Private Session at 11.43 a.m.


5.Report on the Role of Women in Agriculture and related matters.


Deputy Dukes advised that, in accordance with the decision of the Committee at its Meeting on 22 November, the sub-Group met on 23 November and considered the recommendations to be made to the Minister for Finance regarding measures to be implemented to ensure the continued participation of women in Agriculture. The Committee was informed that Deputies Brady, Dukes, Penrose and Sheehan attended this meeting of the sub-Group and Deputy Dukes was elected Chairman.


Deputy Dukes advised also that rather than proceeding with making recommendations directly to the Minister for Finance, the sub-Group agreed to draft a Report on the matter and to bring same to the Committee for consideration.


The draft Report (Appendix A) was brought forward by Deputy Dukes, was read and agreed to. It was further agreed that, as a matter of urgency, the Report be laid before both Houses of the Oireachtas and be printed and published.


Deputy Dukes requested that the Chairman seek to have the matter debated in both Houses prior to 6th December, 2000.


6.Date and Time of next Meeting.


It was agreed that the next Meeting of the Committee be held on 20th December, 2000, and that the draft Annual Report of the Committee be for consideration on that day.


The Joint Committee adjourned at 11 50 a.m. until Wednesday, 20th December, at 11.30 a.m.

1. Introduction

1.1The Joint Committee on Agriculture, Food and the Marine was established following an order of Dáil Éireann of 13th November 1997 (as amended) and of Seanad Éireann of 19th November 1997 (as amended).


Standing Order 79A(4) of the Standing Orders relative to Public Business of Dáil Éireann and Standing Order 63(4) of the Standing Orders relative to Public Business of Seanad Éireann require that -


As soon as may be following its appointment and thereafter at annual intervals, each Select Committee shall prepare a work programme and shall lay such programme before Dáil Éireann.


Pursuant to this requirement the work programme detailed at section 5 below was agreed by the Joint Committee at its meeting on 14 July, 1998, and laid before both Houses of the Oireachtas on the same date.


2. Orders of Reference of the Dáil Select Committee on Agriculture, Food and the Marine

2.1In addition to the remit of the Joint Committee (detailed at 3 below), paragraph (1) (a) of the Order of Dáil Éireann (as amended on 28 April 1998), empowers the Select Committee of Dáil Éireann to consider—


(i)Bills the statute law in respect of which is dealt with by the Department of Agriculture and Food and the Department of the Marine and Natural Resources, and


(ii)Estimates for Public Services within the aegis of those Departments,


as shall be referred to it by Dáil Éireann from time to time.


3. Orders of Reference of the Joint Committee on Agriculture, Food and the Marine

3.1Paragraph (2) (a) of the Order of Dáil Éireann (as amended on 28 April 1998) and paragraph (1) (a) of the Order of Seanad Éireann (as amended on 30 April 1998) empowers the Joint Committee to consider—


“(i)such public affairs administered by the Department of Agriculture and Food and the Department of the Marine and Natural Resources as it may select, including bodies under the aegis of those Departments in respect of Government policy,


(ii)such matters of policy for which the Ministers in charge of those Departments are officially responsible as it may select,


(iii)the strategy statement laid before each House of the Oireachtas by the Ministers in charge of those Departments pursuant to section 5(2) of the Public Service Management Act, 1997, and shall be authorised for the purposes of section 10 of that Act,


(iv)such Annual Reports or Annual Reports and Accounts, required by law and laid before either or both Houses of the Oireachtas, of bodies under the aegis of the Department(s) specified in paragraph 2(a)(i), and the overall operational results, statements of strategy and corporate plans of these bodies, as it may select.


Provided that the Joint Committee shall not, at any time, consider any matter relating to such a body which is, which has been, or which is, at that time, proposed to be considered by the Committee of Public Accounts pursuant to the Orders of Reference of that Committee and/or the Comptroller and Auditor General (Amendment) Act, 1993.


Provided further that the Joint Committee shall refrain from inquiring into in public session, or publishing confidential information regarding, any such matter if so requested either by the body or by the Minister in charge of that Department; and


(v)such other matters as may be jointly referred to it from time to time by both Houses of the Oireachtas,


and shall report thereon to both Houses of the Oireachtas.”.


Accordingly, the items listed in this Work Programme will be considered by the Joint Committee within the parameters defined by the Orders of Reference of the Joint Committee, as amended from time to time.


4. Order of consideration of items and amendment of Work Programme of Joint Committee on Agriculture, Food and the Marine

4.1The items detailed in the Work Programme at 5 below are not listed in order of priority. It is the opinion of the Joint Committee that to accord priority and agree a timetable for consideration of the various items would impose a structure that would not enable the Joint Committee to respond to events in a sufficiently flexible fashion. The staff resources available to the Committee are, unfortunately, very limited, and as the Committee is only guaranteed a meeting slot once a fortnight, it would therefore not be practical or prudent to adopt a more rigid timescale at the stage. This position can be reconsidered as and when additional resources become available.


4.2The Joint Committee has therefore agreed that on the conclusion of its consideration of an item it will then decide the next item(s) for consideration. Similarly, as the Committee could not be expected to anticipate all developments falling within its remit, it has agreed that, in response to a particular event, it shall, if it deems it necessary to do so, amend this Work Programme to include further items or delete or revise existing items for consideration. Any such amendment of this Work Programme shall be laid before both Houses of the Oireachtas as soon as may be following such amendment.

5.3Agricultural Reform and the Future of Farming


5.3.1Following the adoption of our key report on the Future of Irish Agriculture, the Committee shall continue to monitor agricultural reform with particular reference to the implementation of Agenda 2000 and the impact of ongoing trade liberalisation and other relevant factors on the future of Irish agriculture, in the following way:


(i)Meet with representative organisations as considered necessary.


(ii)Meet with other interested parties or persons\ groups as considered necessary.


(iii)Undertake visits or fact finding missions in connection with its consideration of any matters relevant to this topic.


5.4Marine Reform and the Future of the Fishing Industry


5.4.1The Committee may, subject to time and resource constraints, monitor the reform of the Common Fisheries Policy and other relevant policies \ factors with a view to assessing their impact on the future of the Irish fishing industry. The Committee may


(i)Meet with representative organisations as considered necessary.


(ii)Meet with other interested parties or persons\ groups as considered necessary.


(iii)Undertake visits or fact finding missions in connection with its consideration of any matters relevant to this topic.


5.5Bovine Tuberculosis and Brucellosis


5.5.1The Committee has determined that it shall, subject to time and resource constraints, consider the areas of Bovine Tuberculosis and Brucellosis with a view to preparing a Report. The Committee may:


(i)Engage consultants to assist it in the preparation of the Report.


(ii)Invite submissions from appropriate representative organisations and following consideration of these submissions subsequently meet with those organisations if it deems this to be desirable


(iii)Meet as it sees fit with other interested parties or persons\groups who may inform its views.


(iv)Undertake visits or fact finding missions in connection with its consideration of any matters relevant to the Report.


(v)Lay the Report before both Houses of the Oireachtas following adoption by the Committee.


5.6Food Safety


5.6.1The Committee may, subject to time and resource restraints, consider the vital issue of food safety. The Committee may:


(i)Meet with representative organisations as considered necessary.


(ii)Meet with other interested parties or persons\ groups as considered necessary.


(iii)Undertake visits or fact finding missions in connection with its consideration of any matters relevant to this topic.


5.7Organic Farming


5.7.1The Committee may, subject to time and resource constraints, consider organic farming with a view to furthering the Committee’s understanding of the nature and viability of organic farming and assessing its role within Irish agriculture. The Committee may:


(i)Meet with representative organisations as considered necessary.


(ii)Meet with other interested parties or persons\ groups as considered necessary.


(iii)Undertake visits or fact finding missions in connection with its consideration of any matters relevant to this topic.


5.8Genetically Modified Organisms (GMOs)


5.8.1The Committee may, time and resources permitting, consider the areas of GMOs including transgenic organisms. The Committee may:


(i)Meet with representative organisations as considered necessary.


(ii)Meet with other interested parties or persons\ groups as considered necessary.


(iii)Undertake visits or fact finding missions in connection with its consideration of any matters relevant to this topic.


5.9Off-Shore Oil and Gas Industry


5.9.1The Committee may, time and resources permitting, consider the policy issues surrounding the Irish off-shore oil and gas industry. The Committee may:


(i)Meet with representative organisations as considered necessary.


(ii)Meet with other interested parties or persons\ groups as considered necessary.


(iii)Undertake visits or fact finding missions in connection with its consideration of any matters relevant to this topic.


5.10Animal Breeding


5.10.1The Committee remains interested in keeping itself abreast of developments in this vital area of the agricultural sector which it has previously visited. The Committee may:


(i)Meet with representative organisations as considered necessary.


(ii)Meet with other interested parties or persons\ groups as considered necessary.


(iii)Undertake visits or fact finding missions in connection with its consideration of any matters relevant to this topic.


5.11Consideration of Statements of Strategy under Public Service Management Act


5.11.1The Committee is required under its Orders of Reference to consider the Strategy Statement of both the Department of Agriculture and Food and the Department of the Marine and Natural Resources. The Committee may select aspects of these statements on an ongoing basis and may report on the progress made by both Departments in relation to the achievement of their aims and objectives.


5.12Consideration of Annual Reports and\or Accounts


5.12.1The Committee may consider such Annual Reports or Annual Reports and Accounts, required by law and laid before either or both Houses of the Oireachtas, of bodies under the aegis of the Department of Agriculture and Food or the Department of the Marine and Natural Resources and the overall operational results, statements of strategy and corporate plans of these bodies, as it may select, within the limitations specified in its Orders of Reference.


5.13Conferences and Fact Finding Missions


5.13.1The Committee may participate in Conferences and undertake fact finding missions relevant to subject matters, falling within the terms of reference of the Committee, as it sees fit.


5.14International Parliamentary Association for Agriculture, Fisheries and Forestry


5.14.1The Committee may take part in such Conferences or other meeting necessitated by its membership of the International Parliamentary Association for Agriculture, Fisheries and Forestry.


5.15Delegations


5.15.1The Committee may meet delegations from counterpart committees of other Parliaments.


5.16Meeting with Representative Organisations


5.16.1The Committee intends to continue meeting with representative organisations as time, limited resources and its other work commitments permit, as part of the ongoing process of informing itself.


5.17Other Matters


5.17.1The Committee may consider such other matters relevant to its Orders of Reference as it may decide and such matters as may be referred to the Joint Committee by the Houses of the Oireachtas from time to time; and such hold such meetings or conduct such fact finding missions as it considers necessary in connection with the aforementioned.
