I am directed by the Chairman of the Joint Committee, Gerard Collins, T.D., to refer to the above regulations and to make the following enquiries thereon:-


1.Why was Regulation 5 considered necessary in view of the direct applicability of Council Regulation (EEC) No. 2727/75 (as amended by Council Regulation (EEC) No. 1579/86) and Commission Regulation No. 2040/86?


2.In making Regulations 6 and 7 was any consideration given to the views of the Joint Committee expressed in reports over the years that obligations of the public should be made clear especially when the creation of a public offence is involved?

European Communities (Co-Responsibility Levy on Cereals) Regulations, 1986.

I am to refer to your letter of 28th July 1987, Your Ref. EC4/220 addressed to the Secretary of this Department regarding the above.


The delay in replying to your letter of 2nd December 1986 is regretted. The position is that, as the Regulations in question were drawn up in consultation with the Office of Attorney General, it was necessary to seek the observations of that Office on the points raised by the Joint Committee. These observations have not yet come to hand and a further reminder has now been sent to the Office of the Attorney General.


It is hoped that the Department will be in a position to reply to the points in question in the near future.
