I am directed by Mrs. Gemma Hussey, TD, Chairperson of the Joint Committee on the Secondary Legislation of the European Communities to refer to the European Communities (Road Transport) (Exemptions) Regulations, 1987 [S.I. No. 138 of 1987] and to request you to reply to the following questions in order to assist the Joint Committee in its examination of this instrument:-


(1)Is there legislation in force in Northern Ireland corresponding to Regulation 3?


(2)In relation to Regulation 3 (2) (g) what is the position relating to tractors used exclusively for agriculture and forestry in the period up to 1 January, 1990?

I am directed by the Minister for Tourism and Transport to refer to your minute of 26 July, 1988 regarding the European Communities (Road Transport) (Exemptions) Regulations, 1987 [S.I. No. 138 of 1987].


The position regarding the queries raised by you is as follows:-


1.The corresponding legislation in Northern Ireland is The European Communities Road Transport and Vehicles (The Communities Drivers’ Hours and Recording Equipment) (Exemptions and Supplementary Provisions) Regulations (Northern Ireland) 1987 (S.R. No. 218 of 1987). These regulations took effect on 8th June, 1987, the same date as S.I. No. 138 of 1987.


2.Tractors and other machines used solely for local agricultural and forestry work are exempt up to 31st December 1989 pursuant to Article 4.7 of Council Regulation (EEC) No. 543/69. This regulation was repealed by Council Regulation (EEC) No. 3820/85 with effect from 29th September, 1984 with the exception of three provisions, one of which was Article 4.7, which could remain in force until 31st December, 1989. This provision applied to all Member States and national legislation was not required to implement it in respect of cross-border traffic. From 1st January, 1990 this will be replaced by the slightly different provision under Regulation 3820/85 for tractors used exclusively for agricultural and forestry work.
