No. 52 of 1984) and the Mackerel (Prohibition on Fishing) Order, 1985 (S.I. No. 124 of 1985) and to enquire if these Orders were made to implement any secondary legislation of the European Economic Community and if so which. T. Cleireach an Chomhchoiste An Comhchoiste faoi Reachtaiocht I am directed by the Minister for Fisheries and Forestry to refer to your letter of 6th June, 1985 regarding the Control of Fishing for Mackerel Order, 1984 (S.I. No. 52 of 1984) and the Mackerel (Prohibition on Fishing) Order, 1985 (S.I. No. 124 of 1985) and to state that neither of these Orders were made to implement any secondary legislation of the European Economic Community. The purpose of these Orders was the management and utilisation of the mackerel quotas allocated to Ireland for 1984 and 1985 and the making of same is in accordance with the provisions of Article 5(2) of Council Regulation (EEC) 170/83 which states:- “Member States shall determine, in accordance with the applicable community provisions, the detailed rules for the utilisation of the quotas allocated to them….” F. No. 260 of 1984) I am to refer to your minute of 25th April, 1985 regarding the Control of Fishing for Mackerel (No. 2) Order, 1984 (S.I. No. 260 of 1984) and to say that the Order was made pursuant to Article 5.2 of Council Regulation (EEC) 170/83, (O.J. L24, Vol. 26 of 27 January, 1983) which reads as follows:- “Member States shall determine, in accordance with the applicable Community provisions, the detailed rules for the utilisation of the quota allocated to them.” B.
