I am directed by the Chairman of the Joint Committee, Mr. Mervyn Taylor, T.D., to refer to the Oireachtas (Allowance to Members) (Travelling Facilities) (Amendment) Regulations, 1983 (S.I. No. 341 of 1983).

I am to invite your comments on the fact that those Regulations purport to have retrospective effect notwithstanding that section 5(1) of the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices Act, 1964 contains no specific authority to so provide.

I am directed by the Minister for the Public Service to refer to your minute of 25th April, 1985 regarding the Oireachtas (Allowance to Members) (Travelling Facilities) (Amendment) Regulations, 1983, and to say that it has been the practice over the years that regulations made under Section 5(1) of the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1964, provided that they should be deemed to have come into effect from dates somewhat earlier than the dates on which they were made. That practice was followed on this occasion also. The retrospection involved was slightly over two months.
