I am directed by Mr. Gerard Collins, T.D., Chairman of the Joint Committee on the Secondary Legislation of the European Communities to enquire the reason the above Regulations were not brought into force prior to the date of the implementation of the 1983 Regulations. (i.e. 1 January 1985).

European Communities (Cereal Seed) Regulations 1985 [S.I. No. 25 of 1985]


I refer to your letter of 11 March 1985 regarding the date on which the above Regulations were brought into force. The fact that there was a large carry-over of 2nd Generation (C2) seed to 1985 was not brought to the attention of this Department until towards the end of December when the Irish Seed Trade Association asked for the postponement of the operative date for implementation of the 1983 Regulations. The large carry-over of C2 seed was due mainly to unfavourable sowing conditions for winter cereals from early November. The request of the I.S.T.A. to postpone the operative date for implementation of the 1983 Regulation had then to be considered within the Department and a decision taken to make a new Regulation. The Attorney General’s Office were then asked to draft a new Regulation. The Christmas holiday period intervened so the new Regulation, postponing to 1 January 1986 the date from which the marketing of C2 seed would be prohibited, could not be brought into force before 1 January, 1985.
