APPENDIX 10

MEMORANDUM FROM THE DEPARTMENT OF TRANSPORT

NATURE OF THE AGREEMENTS GOVERNING THE RIGHTS OF AER LINGUS AND AERLINTE TO FLY THE ROUTES ON THEIR PRESENT NETWORKS AND THE RECIPROCAL RIGHTS GIVEN TO FOREIGN AIRLINES.

1. Aer Lingus operates air services within Ireland and between Ireland and Britain and Europe.


Aerlinte operates air services between Ireland and the United States.


2. Scheduled air services to/from Ireland are operated on the basis of Air Transport Agreements which are negotiated bilaterally with other countries. These agreements may convey 3rd, 4th and 5th freedom rights.


Third Freedom rights are the rights to carry traffic from your own country to the country of the 2nd Party to the Agreement.


Fourth Freedom rights are the rights to carry traffic from the country of the 2nd Party to the Agreement to your own country.


Fifth Freedom rights are the rights to carry traffic from the country of the 2nd Party to the Agreement to a third country.


3. The following bilateral agreements have been negotiated with countries into which Aer Lingus and Aerlinte operate.


(a) US/Ireland Air Transport Agreement of 3rd February, 1945 as amended.


Airlines of Ireland under this agreement are accorded in the territory of the United States rights of transit, non-traffic stop and commercial entry for international traffic on scheduled services at Boston, New York, Chicago in both directions. Airlines of the US under this agreement are accorded rights of transit, non-traffic stop and commercial entry for international traffic on scheduled services on the routes: US to Ireland and countries beyond via intermediate stops in both directions with 5th freedom rights at Shannon for points beyond Ireland.


In addition one US airline is accorded in the territory of Ireland rights of transit, non-traffic stop and commercial entry for international traffic at Shannon and Dublin, on the following route: US to Ireland via intermediate points in both directions.


All scheduled flights by carriers of both countries in either direction must serve Shannon.


(b) Ireland/UK Air Transport Agreement of 5th April, 1946 as amended.


Airlines of Ireland, under this agreement are accorded in the territory of the UK rights of transit, non-traffic stop and commercial entry for international traffic on scheduled services on the routes outlined in the attached Schedules I, II and III which are annexed to the agreement, routes 1, 2 and 3 of Schedule II to be operated in parallel by one airline of each country. Airlines of the UK, authorised under the agreement are accorded, in the territory of Ireland rights of transit, non-traffic stop and commercial entry for international traffic on scheduled services on the routes outlined in the attached Schedule IV which is annexed to the agreement, routes 1, 2 and 3 of Schedule IV to be operated in parallel by one airline of each country. Under the Ireland/UK Agreement the Irish carrier has monopoly rights on the following routes


Dublin/Edinburgh


Dublin/Jersey


Shannon/Liverpool


Shannon/Manchester


UK carriers have monopoly rights on the following routes


London/Newcastle


London/Exeter


London/Newquay


London/Bournemouth


London/Middleton St. George


London/Havenford West


Except for the Shannon/North Atlantic route on which the UK carrier is given 5th freedom rights, traffic under the agreement is 3rd and 4th freedom.


(c) Ireland/France Air Transport Agreement of 16th May 1946, as amended.


Airlines of Ireland, under the agreement are accorded in the territory of France rights of transit, non-traffic stop and commercial entry for international traffic on scheduled services on the routes

Dublin—a point in France—points in Spain


Dublin—Paris—Geneva—


Rome—(5th freedom rights at Paris)

Airlines of France, under this agreement are accorded in the territory of Ireland rights of transit, non-traffic stop and commercial entry for international traffic on scheduled services on the routes:—

Paris via Shannon and intermediate points to Canada, the US and points beyond (5th freedom rights at Shannon)


Except where otherwise specified all traffic is 3rd and 4th freedom.


(d) Ireland/Denmark Air Transport Agreement of 18th November, 1947.


Airlines of Ireland under this Agreement are accorded in the territory of Denmark rights of transit, non-traffic stop and commercial entry for international traffic on scheduled services on the routes


Ireland to Denmark and countries beyond via intermediate points in both directions.


Fifth freedom rights from intermediate points to Copenhagen and from Copenhagen to points beyond.


Danish airlines under this agreement are accorded, in the territory of Ireland rights of transit, non-traffic stop and commercial entry for international traffic on scheduled services on the routes.


Denmark to Ireland and countries beyond, via intermediate points in both directions.


Fifth freedom rights from intermediate points to Ireland and countries beyond.


(e) Ireland/Italy Air Transport Agreement of 21st November, 1947 as amended.


An Irish airline, under this Agreement is accorded, in the territory of Italy rights of transit, non-traffic stop and commercial entry for international traffic on scheduled services on the routes


Points in Ireland—Lourdes or Zurich—Rome


Points in Ireland—Geneva—Milan


Fifth freedom rights at Lourdes, Zurich and Geneva.


An Italian airline, under this Agreement is accorded, in the territory of Ireland rights of transit, non-traffic stop and commercial entry for international traffic on scheduled services on the routes


Points in Italy—two points in Europe other than London/Dublin.


Points in Italy—one point in Europe other than London/Shannon.


Fifth freedom rights from points in Europe to Dublin and Shannon.


(f) Ireland/Switzerland Air Transport Agreement of 6th May, 1948.


Airlines of Ireland, under the Agreement are accorded, in the territory of Switzerland rights of transit, non-traffic stops and commercial entry for international traffic on scheduled services on the routes


Shannon and/or Dublin/Zurich (Geneva or Basle) and beyond with or without intermediate stops in both directions.


Fifth freedom rights from intermediate stops to Zurich, Geneva and Basle and countries beyond in both directions.


Swiss airlines, authorised under the Agreement are accorded, in the territory of Ireland rights of transit, non-traffic stops and commercial entry for international traffic on scheduled services on the routes


Switzerland (Zurich and/or Geneva and/or Basle)—Dublin with or without intermediate stops in both directions.


Switzerland/Shannon/Newfoundland and/or Canada and/or USA with or without intermediate stops, in both directions.


Fifth freedom rights from intermediate points to Dublin in both directions and from intermediate points to Shannon and Newfoundland and/or Canada and/or USA in both directions.


(g) Ireland/Netherlands Air Transport Agreement of 10th May, 1948.


Airlines of Ireland under this Agreement are accorded in the territory of the Netherlands rights of transit, non-traffic stops and commercial entry for international traffic on scheduled services on the routes


Dublin—a point in the Midlands of England—Amsterdam and points beyond in both directions.


5th freedom rights from a point in the Midlands of England to Amsterdam and points beyond in both directions.


Netherlands airlines under this Agreement are accorded, in the territory of Ireland rights of transit, non-traffic stop and commercial entry for international traffic on scheduled services on the routes


Amsterdam—a point in the Midlands of England—Dublin, in both directions.


Amsterdam/Shannon/Gander/points in North America and beyond in both directions with


5th freedom rights from a point in the Midlands of England to Dublin in both directions and at Shannon to Gander, points in North America and beyond in both directions.


(h) Ireland/Belgium Air Transport Agreement of 10th September, 1955, as amended.


Airlines of Ireland under this Agreement are accorded in the territory of Belgium rights of transit, non-traffic stops and commercial entry for international traffic on scheduled services on the routes


Dublin-Brussels, in both directions


Dublin-Manchester-Brussels-Dusseldorf and/or Frankfurt in both directions.


5th freedom rights at Dusseldorf and Frankfurt. All other traffic 3rd and 4th freedom.


Belgian Airlines, under this Agreement are accorded, in the territory of Ireland rights of transit, non-traffic stop and commercial entry for international traffic on scheduled services on the routes.


Brussels via intermediate points to Shannon and beyond in both directions Brussels-Dublin, in both directions.


5th freedom rights from intermediate points to Shannon and beyond in both directions. All other traffic 3rd and 4th freedom.


(i) Ireland/Germany Air Transport Agreement of 12th June, 1956, as amended.


Airlines of Ireland authorised under the Agreement are accorded in the territory of Germany rights of transit, non-traffic stop and commercial entry for international traffic on scheduled services on the routes


Points in Ireland-Manchester and/or Brussels and/or Amsterdam-Dusseldorf or Frankfurt or Munich.


Points in Ireland—Manchester and/or Amsterdam-Hamburg-Copenhagen

(4) Most of the above listed agreements contain tariff and capacity clauses. They relate to scheduled services only and not to charter operations.

Note:


As from 1 April, 1973 no airline of the Irish Republic will provide scheduled services between (a) Manchester and Brussels (b) Manchester and Rome (c) Manchester and Zurich.


As from 1 April, 1974 no airline of the Irish Republic will operate more than three scheduled services per week by aircraft of Boeing 737 or BAC 1-11 type between Manchester and any point in the Federal Republic of Germany. No extra sections may be operated without the permission of the UK aeronautical authorities.


As from 1 April, 1975 no airline of the Irish Republic will provide scheduled services between (a) Manchester and Dusseldorf and (b) Manchester and Frankfurt.


As from 1 April, 1977 no airline of the Irish Republic will provide scheduled services between Manchester and Amsterdam.


As from 1 April, 1978 no airline of the Irish Republic will provide scheduled services between Manchester and Copenhagen.
