European Communities (Seeds) Regulations, 1975 [S.I. No. 252 of 1975].

I am directed by the Chairman of the Joint Committee on the Secondary Legislation of the European Communities to refer to the European Communities (Seeds) Regulations, 1975 [S.I. No. 252 of 1975]. I am to request that you be good enough to supply information on the following points to assist the Joint Committee in its deliberations:—


(1) With reference to Regulation 2 (2) it is noted that it was not considered necessary to include anything in the nature of a definition of “market” in earlier Regulations made under the European Communities Act, 1972 and dealing with seeds, e.g. S.I. Nos. 173 and 174 of 1973. What are the circumstances in which a need for such a definition has come to be regarded as necessary?


(2) Why is Regulation 4 (2) of the instrument under reference restricted to seeds which are to be “sold”?


(3) Does Regulation 12 (1) of S.I. No. 200 of 1974 to which the Joint Committee made reference on pages 5 and 7 of its Twelfth Report (Prl. 4670) apply to the services performed by or on behalf of the Minister under S.I. No. 252 of 1975?

I am to refer to your letter of 26 January, 1976 (Ref. EC/4/3) about the European Communities (Seeds) Regulations, 1975 (S.I. No. 252 of 1975) and to reply as follows:—


(i) A definition of “market” was also included in the European Communities (Seeds) Regulations, 1974 (S.I. No. 200 of 1974). The earlier regulations mentioned by you viz. S.I. Nos. 173 and 174 of 1973 had to be made in circumstances of extreme urgency in order to comply with requirements to implement certain provisions of EEC directives on the marketing of seed by 1 July, 1973. At that time also official English versions of the relevant EEC directives had not yet been published by the EEC.


(ii) It is accepted that the word “marketed” could have been used in place of “sold”.


(iii) No fees at present charged by this Department in connection with seeds whether for the purposes of S.I. No. 252 of 1975 or otherwise are charged under the authority of S.I. No. 200 of 1974.
