European Communities (Weights and Measures of Length) Regulations, 1975 [S.I. No. 200 of 1975].

I am directed by the Chairman of the Joint Committee on the Secondary Legislation of the European Communities to refer to the European Communities (Weights and Measures of Length) Regulations, 1975 [S.I. No. 200 of 1975] which will be considered by the Joint Committee in the near future.


I am to enquire for the information of the Joint Committee whether there is any legal provision for affixing the pattern approval symbol and initial verification marks referred to in Regulation 3 of the instrument similar to that contained in Regulation 7 of the European Communities (Measuring Instruments) Regulations [S.I. No. 67 of 1973]. I am moreover to state that it would assist the Joint Committee in its deliberations if your Department would comment on the differences in form and purport between S.I. No. 67 of 1973 and S.I. No. 200 of 1975.

I am directed by the Minister for Industry and Commerce to refer to your minute of 16 September 1975 about the European Communities (Weights and Measures of Length) Regulations, 1975—S.I. No. 200 of 1975—and to say that there is no provision empowering the application of EEC initial verification marks as this is not required by the provisions of the two directives concerned. In the case of S.I. 67 of 1973, it was necessary to include such a provision, as that instrument, in addition to Directives on gas and liquid meters and on weights, also implemented the general Directive on methods of metrological control—71/316 EEC (See Schedules 1 to 3) which expressly requires member countries to apply marks when called upon.


In regard to differences in form between S.I. 67/1973 and S.I. 200/1975 I am to say that the drafting approach to regulations implementing these and other directives has in the intervening two years altered in such a way as to include only the essential minimum.
