DÁIL ÉIREANN

ORDERS OF REFERENCE

19th July, 1973:—Resolved: (1) that it is expedient that a Joint Committee of both Houses of the Oireachtas (which shall be called the Joint Committee on the Secondary Legislation of the European Communities) be established consisting of—


(a) those members of either such House who are for the time being delegates to the Assembly of the European Communities, and


(b) sixteen other persons of whom ten shall be members of Dáil Éireann and six shall be members of Seanad Éireann


to examine—


(i) such drafts, prepared by the Commission of the European Communities and submitted to the Council of those Communities, of regulations, directives, decisions, recommendations and opinions, of that Council,


(ii) such acts of the institutions of those Communities,


(iii) such regulations under the European Communities Act, 1972 (No. 27 of 1972), and


(iv) such other instruments made under statute and necessitated by the obligations of membership of those Communities,


as the Committee may select and to report thereon to both Houses of the Oireachtas.


(2) That five members of the Committee shall form a quorum of whom at least one shall be a member of Dáil Éireann and at least one shall be a member of Seanad Éireann [Parliamentary Secretary to the Taoiseach].


Ordered: That a message be sent to the Seanad requesting its concurrence in this Resolution.


26th July, 1973:—Message from the Seanad: “Seanad Éireann has passed the following Resolution:—


‘(1) That Seanad Éireann concurs with Dáil Éireann in its Resolution communicated to Seanad Éireann on the 19th day of July, 1973, that it is expedient that a Joint Committee of both Houses of the Oireachtas (which shall be called the Joint Committee on the Secondary Legislation of the European Communities) be established consisting of—


(a) those members of either such House who are for the time being delegates to the Assembly of the European Communities, and


(b) sixteen other persons of whom ten shall be members of Dáil Éireann and six shall be members of Seanad Éireann


to examine—


(i) such drafts, prepared by the Commission of the European Communities and submitted to the Council of those Communities, of regulations, directives, decisions, recommendations and opinions, of that Council,


(ii) such acts of the institutions of those Communities,


(iii) such regulations under the European Communities Act, 1972 (No. 27 of 1972), and

Ordered: (1) That a Select Committee consisting of those members of Dáil Éireann who are for the time being delegates to the Assembly of the European Communities and ten other members who shall be nominated by the Committee of Selection be appointed to be joined with a Select Committee to be appointed by Seanad Éireann to form the Joint Committee on the Secondary Legislation of the European Communities.


(2) That the Joint Committee shall examine—


(i) such drafts, prepared by the Commission of the European Communities and submitted to the Council of those Communities, of regulations, directives, decisions, recommendations and opinions, of that Council,


(ii) such acts of the institutions of those Communities,


(iii) such regulations under the European Communities Act, 1972 (No. 27 of 1972), and


(iv) such other instruments made under statute and necessitated by the obligations of membership of those Communities,


as it may select and shall report thereon to both Houses of the Oireachtas.


(3) That five members of the Joint Committee shall form a quorum of whom at least one shall be a member of Dáil Éireann and at least one shall be a member of Seanad Éireann [Parliamentary Secretary to the Taoiseach].


Message sent to the Seanad acquainting it accordingly.


27th July, 1973:—Members nominated to serve on the Joint Committee:


Edward Collins, Barry Desmond, Maurice Dockrell, John G. Esmonde, Jackie Fahey, Gene Fitzgerald, Seán Flanagan, Charles J. Haughey, Michael O’Kennedy and Myles Staunton.


Members who are for the time being delegates to the Assembly of the European Communities:


Donal Creed, Thomas Dunne, James Gibbons, Michael Herbert, Liam Kavanagh, Charles B. McDonald, Thomas Nolan and David Thornley.


20th February, 1974:—Ordered: That the Order of 26th July, 1973 relating to the Joint Committee on the Secondary Legislation of the European Communities be amended by the addition of the following paragraph:—


“(4) That every report which the Joint Committee proposes to make under this order shall on adoption by the Joint Committee be laid before the Dáil forthwith whereupon the Joint Committee shall be empowered to print and publish such report together with such related documents as it thinks fit.” [Parliamentary Secretary to the Taoiseach].

25th July, 1973:—Message from the Dáil: “Dáil Éireann has passed the following Resolution in which the concurrence of Seanad Éireann is desired:—

20th February, 1974:—Ordered: That the Order of 26th July, 1973 relating to the Joint Committee on the Secondary Legislation of the European Communities be amended by the addition of the following paragraph:—

15th May, 1974:—Senator Mark Killilea appointed in place of Senator Kevin O’Callaghan, deceased.


The Joint Committee at its meeting on 3rd August, 1973, elected Deputy Charles J. Haughey as Chairman and Deputy Maurice Dockrell as Vice-Chairman.
