I am directed by the Select Committee on Statutory Instruments to state that it has been considering the following statutory instruments which were made by the Minister for Labour—

The Committee notes that the schedules which follow the main text of each of the instruments appear below the signature of the Minister. In this connection I am to direct your attention to Paragraph 10 of the First Report (T.152—Pr. 3001) of the Select Committee on Statutory Instruments dated 5th May, 1955, in which it was recommended that schedules to statutory instruments should be properly attested by appearing above the signature of the Minister. This recommendation has since been generally adopted.


The Committee would be glad to have the observations of your Department in the matter.

I am directed by the Minister for Labour to refer to your minute of 30 Aibreán, 1970 regarding the Mines (Managers and Officials) Regulations, 1970 (S.I. No. 74 of 1970) and the Mines and Quarries (Notification of Accidents) Regulations, 1970 (S.I. No. 77 of 1970) made under the Mines and Quarries Act, 1965.


Before the Mines and Quarries Act, 1965 could be brought into operation it was necessary to promulgate an extensive code of regulations. These had to be published in draft form for acceptance by employer and labour interests as provided for in the Second Schedule to the Act. Interminable objections raised by the newer mining interests, particularly foreign interests, made it necessary to draft and redraft these codes with the result that by 1970 the bringing into operation of the Act was long overdue. This Department was therefore under considerable pressure to have the necessary codes of regulations introduced as a matter of urgency. Unfortunately because of the pressure of work involved the Department did not advert to the need to comply with the recommendation in paragraph 10 of the First Report of the Select Committee on Statutory Instruments.


The Minister regrets the Department’s failure to comply with the relevant recommendation and has arranged that in future there should be strict compliance with the recommendation by all officers concerned in the preparation of statutory instruments sponsored by his Department.
