APPENDIX 26.FEES RECEIVED IN RESPECT OF THE VARIOUS COURTS.Cléireach, An Coiste um Chúntais Phoiblí. At the proceedings of the Committee on the 29th February in connection with the Appropriation Account of the Courts Vote 1966-67, I undertook to supply information in regard to Fees (stamps) received in respect of the various Courts. I attach an explanatory note.
Note. For the purpose of relieving the Exchequer of the cost of the upkeep of the various Courts and Court Offices, the Minister for Justice is empowered by section 65 of the Courts of Justice Act, 1936, to prescribe fees to be paid by parties availing themselves of the services of the Courts or of the Offices attached thereto. The fees are prescribed by Orders made from time to time by the Minister for Justice with the consent of the Minister for Finance. The Orders in force at present are as follows: (1) Supreme Court and High Court (Fees) Order, 1966 (S.I. No. 62 of 1966). (2) Circuit Court (Fees) Order, 1966 (S.I. No. 53 of 1966), Circuit Court (Fees) (No. 2) Order, 1966 (S.I. No. 142 of 1966), Circuit Courts (Fees) (Amendment) Order, 1967 (S.I. No. 153 of 1967). (3) District Court (Fees) Order, 1966 (S.I. No. 54 of 1966). The fees in the various Courts are taken by way of stamps which are affixed to the relevant Court document. The figures given in the table furnished with the Appropriation Account show the total amounts realised in the District Court and the Circuit Court. In the case of the Supreme Court and High Court the fees are classified under four headings, viz., Judicature fees Bankruptcy fees Judgment Registry fees Chief Justice fees. Details of the fees received, as shown in the Appropriation Account, are furnished to this Department by the Office of the Revenue Commissioners. |
