Infectious Diseases (Maintenance) Regulations, 1963 (S.I. No. 200 of 1963).

I am directed by the Select Committee on Statutory Instruments to state that it observes that there is no definition of “infectious diseases” in the Infectious Diseases (Maintenance) Regulations, 1963 (S.I. No. 200 of 1963).


The Committee assumes that the Minister has in some other instrument exercised his power under section 29 (1) of the Health Act, 1947 to “specify the diseases which are infectious diseases” but it would have expected that in the interests of clarity either the diseases specified would be repeated in the Regulations under reference or at least a reference made therein to that other instrument. The Committee would welcome the observations of your Department on this point.

I am directed by the Minister for Health to refer to your minute of 9 September and to previous correspondence on the Committee’s request for observations on the Infectious Diseases (Maintenance) Regulations. 1963 (S.I. No. 200 of 1963). The Minister agrees that, for clarity, it would have been desirable to provide a list of the infectious diseases in respect of which maintenance allowances were payable. It will be observed that the explanatory note to the Infectious Diseases (Maintenance Allowances) Regulations, 1965, (S. I. No. 175 of 1965) gives such a list and this procedure will be followed in future. The diseases are specified in Article II of the Infectious Diseases Regulations, 1948 (S.I. No. 99 of 1948), as amended by Article 2 of the Infectious Diseases (Amendment) Regulations, 1948.


The 1963 Regulations are, of course, no longer in operation.
