Criminal Justice (Legal Aid) Regulations, 1965 [S.I. No. 12 of 1965].

I am directed by the Select Committee on Statutory Instruments to state that it has observed that the Third Schedule to the Criminal Justice (Legal Aid) Regulations, 1965 does not specify the fees payable to solicitors in cases other than murder cases in which 2 counsel are assigned. The Committee assumes that in such cases the fees payable would be the same as those payable in cases where 1 counsel only is assigned. If this is correct the Committee would have expected the Schedule to make the fact clear. It would be glad to be furnished with your Department’s comments on the point.

With reference to your minute of 9th September regarding the Third Schedule of the Criminal Justice (Legal Aid) Regulations, 1965, I am directed by the Minister for Justice to say that the Committee’s assumption in relation to the fees payable to solicitors for work done under the Act is correct. The point made by the Committee in this regard was, in fact, raised with the Parliamentary Draftsman when the draft of the Regulations was received and his view was accepted that the meaning was clear and that the Schedule did not require to be re-drafted.
