PART I.

Standing Order

Amendment

1.

Delete paragraph (1) and substitute:—

 

“(1) There shall be a Roll of Members of Dáil Éireann which shall be signed in the presence of the Clerk by each member before taking his seat.”

2.

In the penultimate line delete “reading” and substitute “who shall read”.

3.

In the seventh and eight lines delete “Constituencies” and substitute “Constituency”.

8.

In the last line delete “due”.

10.

In the fourth and fifth lines delete “,in the absence of any other nomination by the Dáil,”.

20.

In paragraph (2), seventh line, delete “an Order shall have been made” and substitute “a Resolution shall have been adopted”; and in the eleventh line delete “Order” and substitute “Resolution”.

PART II.

Standing Order

Amendment

2.

In page 5, first line, delete “at the Table”.

4.

In the third line delete “upon the Table” and substitute “before the Dáil”.

15.

Delete the Standing Order and substitute:—


“15. The Ceann Comhairle shall nominate, as soon as may be following the reassembly of the Dáil subsequent to a General Election, a panel of not less than two members, any one of whom may act as presiding member in the Dáil or in Committee of the whole Dáil, when requested so to act by the Ceann Comhairle.”

17.

Delete the Standing Order and insert before Standing Order 23 the following new Standing Order:—


“22 A. On the request of the Taoiseach, the Ceann Comhairle may summon the Dáil for an earlier date than that fixed on an adjournment. Such summons shall state the reason for the earlier reassembly.”

20.

In paragraph (1), first line, delete “While the Dáil is in Session, and”.

29.

In paragraph (2), third and fourth lines, delete “current Session” and substitute “following six months”.

47.

In the second and third lines delete “same Session” and substitute “preceding six months”.

72.

Delete the first two lines and substitute:—


“As soon as may be following the reassembly of the Dáil subsequent to a General Election there shall be appointed a committee to”.

Delete paragraph (1) and substitute:—


“(1) Any Bill, which lapses by reason of the dissolution of the Dáil, before it has reached its final stage, may be proceeded with on the reassembly of the Dáil at the stage it had reached prior to the dissolution, upon Resolution of the Dáil restoring it to the Order Paper.”

 

In paragraph (2) delete the last line and substitute “prior to the dissolution of the Dáil”.

In the third line delete “upon the Table of both Houses” and substitute “before each House”.

In paragraph (3), third line, delete “upon the Table” and substitute “before the Dáil”.

PART III.

Standing Order

Amendment

1.

In paragraph (2) delete “all the” in the first line and “all” in the third line.

10.

In the first and second lines delete “Whenever the Dáil shall be informed by the Clerk of” and substitute “In”.

11.

In the first line delete “If” and substitute “Whenever the Dáil shall be informed by the Clerk that”; and in the second line delete “be” and substitute “are”.

12.

In the first and second lines delete “If the Dáil be informed by the Clerk of the” and substitute “If there is a”.

20.

In paragraph (3), third line, delete “any” and substitute “a”.

24.

In the last line add after “Paper”:—


“and, by announcement at the commencement of public business, the order in which it shall be taken each day”.

29.

In the third, fourth and fifth lines, delete “at the commencement of public business rises in his place,” and substitute “, who has given notice to the Ceann Comhairle before the opening of the sitting, rises in his place at the commencement of public business”; and in the ninth and tenth lines delete“, and deliver to the Ceann Comhairle a written statement of the subject to be discussed”.

Delete paragraph (2) and substitute:—


“(2) Where a Question put down for oral answer is of such a nature as to require a lengthy reply, the Ceann Comhairle may, at the request of the member of the Government to whom the Question is addressed, direct that the answer be furnished in the Official Report of the Debates”.

In the first line before “shall” insert “or amendment”.

In the first line before “may” insert “or proposed an amendment”.

Insert at the beginning of the Standing Order the following new paragraph:—

 

“(1) Where a document is required to be laid before the Dáil the delivery of a copy of the document to the Clerk for that purpose shall be deemed to be the laying of it before the Dáil.”

PART IV.

Standing Order

Amendment

20.

In paragraph (3), fifth line, delete “8.30” and substitute “4.30”.

55A.

Before Standing Order 56 insert the following new Standing Order:—

 

“55 A. A Parliamentary Secretary who is a member of the Seanad may attend and be heard in the Dáil.”

70A.

Before Standing Order 71 insert the following new Standing Order:—

 

“70 A. A member of the Government in charge of a Bill which has been committed to a Select or Special Committee of which he is a member may nominate another member of the Government or a Parliamentary Secretary, who is not a member of the Committee, to act in his stead at any meeting of the Committee.”

72A.

Before Standing Order 73 insert the following new Standing Order:—

 

“72 A. As soon as may be following the reassembly of the Dáil subsequent to a General Election there shall be appointed a Select Committee, to be known as the Committee on Procedure and Privileges, to consider matters of procedure generally and to recommend any additions or amendments to the Standing Orders that may be deemed necessary, and also to consider and report, as and when requested so to do, as to the privileges attaching to members. The Committee may also consider, if it deems it advisable, any matter relating to the conditions or premises in which members carry out their duties and which are not specifically referred to any other committee. The Committee shall consist of the Ceann Comhairle, who shall be Chairman, and seventeen other members; and eight shall constitute a quorum. The Committee shall be otherwise constituted according to the provisions of Standing Orders Nos. 67 and 70, and so as to be impartially representative of the Dáil.”

78A.

Before Standing Order 79 insert the following new Standing Order:—

 

“78 A. If both the Clerk and the Clerk-Assistant be absent, the Ceann Comhairle may appoint, for the time being, a member of the joint staff of the Houses of the Oireachtas to perform the duties devolved upon, and exercise the powers conferred upon the Clerk by these Standing Orders.”

92.

Delete the Standing Order and substitute:—


“92. (1) It shall be an instruction to all Committees to which Bills may be committed that they have power to make such amendments therein as they shall think fit, provided that such amendments be relevant to the provisions of the Bill and are not in conflict with the principle of the Bill as read a second time.

 

(2) The Dáil may, on motion made by the member in charge of a Bill, give an instruction to a Committee to which a Bill has been committed empowering them to make amendments, the nature of which shall be specified, provided that the amendments be relevant to the general subject matter and not in conflict with the principle of the Bill.

 

(3) If any amendment made to a Bill be not within the Title of the Bill the Committee shall amend the Title accordingly and report the same specially to the Dáil.”

96.

In the fifth and sixth lines delete “which has been empowered to send for persons, papers and records,”.

136.

Delete the Standing Order and substitute:— “136. (1) Any Standing Order or Orders of the Dáil may be suspended or modified in effect for the day’s sitting, and for a particular purpose, upon motion made after notice.

 

(2) Provided that in cases of urgent necessity, of which the Ceann Comhairle shall be the judge, any Standing Order or Orders may be suspended upon motion made without notice. If any such motion be opposed the Ceann Comhairle shall permit an explanatory statement from the member who moves it and a statement from a member who opposes it before he puts the question thereon.”
