DUNDRUM ASYLUM: PATIENTS TREATED IN OUTSIDE HOSPITALS, APPLICATION OF HEALTH ACTS.

Dear Chairman,


You will recall that on the occasion of my attendance at the proceedings of the Committee on the 25th November, 1959, you asked me for a note about the position in relation to the Health Acts, of Asylum patients treated in outside hospitals. I regret to have to let you know that I am not yet in a position to furnish the necessary information as the matter is still being examined. I will communicate with you again immediately I have some definite information.

Dear Chairman,


Further to my note to you of the 9th instant, regarding the treatment of patients at Dundrum Asylum in outside hospitals, our legal opinion confirms the statement I made to the Committee that the State is responsible for the cost of such treatment and that a claim for services on a health authority under the Health Act cannot be made in respect of medical attention.
