I am directed by the Select Committee on Statutory Instruments to state that it has had under consideration the Waterford North Wharf Bye-Laws, 1956 (Confirmation) Order, 1957 [S.I. No. 31 of 1957] in connection with the requirement under Section 22 (8) of the Transport Act, 1950, that it be laid before each House of the Oireachtas as soon as may be after it is made.


The Committee notes that this instrument, while made on the 15th February, 1957, was not laid before Seanad Éireann until the 26th February, 1957. In accordance with its terms of reference, the Committee has to consider whether there was unjustifiable delay in the laying of this instrument before Seanad Éireann particularly in view of the practicability of early laying implied in Section 3 (1) of the Statutory Instruments Act, 1947, which appears to apply to this instrument. It would, therefore, be glad to receive a memorandum on this matter. In this connection I am to invite your attention to paragraph 13 of the First Report (Pr. 3001) of the Select Committee on Statutory Instruments dated 5th May, 1955.


As the Committee wish to consider this matter at its next meeting it would appreciate a reply before the 31st October, 1957.

I am directed by the Minister for Industry and Commerce to refer to your minute of the 29th September regarding the Waterford North Wharf Bye-Laws, 1956 (Confirmation) Order, 1957 (S.I. No. 31 of 1957) and to apologise for the delay to which the Committee have drawn attention.


In the ordinary course, particular care is taken to ensure that presentation takes place immediately after the Order has been made. The circumstances in this case were somewhat complicated by the fact that the Transport Act of 1950 makes special provisions in regard to publication, and this involved consultation with Córas Iompair Éireann.


While not urging it by way of mitigation of the delay, the Minister feels that the Committee may derive some reassurance in the particular case from the fact that the Order was not to come into force until the 19th March, 1957.
