PROCEEDINGS OF THE SPECIAL COMMITTEE.

1. The Committee met at 3.30 p.m.


2. Members Present.


The following members were present:


Senator O Buachalla (in the Chair), Senators Cox, Crosbie, Douglas, McCrea, Ó Ciosáin, and Stanford.


3. Consideration of the Bill.


The Committee resumed consideration of the Bill.


(i) Postponed section 12.


Question—“That the section stand part of the Bill”—put: The Committee divided: For, 4; Against, 2.


For:—Senators Crosbie, Douglas, McCrea and Stanford.


Against:—Senators Cox and Ó Ciosáin.


The Question was declared carried accordingly.


(ii) Postponed section 26.


Government amendment proposed from the Chair:


“In subsection (2), page 17, line 24, to delete ‘when’ and substitute ‘where’.”


Amendment agreed to.


Government amendment proposed from the Chair:


“To insert at the end of the section the following new subsection:—


‘(3) Where any chattels held upon trust, including a trust for sale, are in the possession of a person entitled to a beneficial interest in the chattels or in the proceeds of sale, not being a person solely and absolutely entitled thereto, no right of action to recover the chattels shall be deemed for the purpose of this Act to accrue during such possession to any person in whom the chattels are vested as trustee or to any person entitled to a beneficial interest in the chattels or the proceeds of sale’.”
