REASON FOR TREATMENT OF LUNACY PERCENTAGES AS EXTRA EXCHEQUER RECEIPTS.

Arising out of my examination before the Public Accounts Committee on the 22nd July last, I undertook to furnish further information about the grounds on which lunacy percentages were treated as extra exchequer receipts to the Vote for the Supreme and High Court of Justice. The matter is governed by statute, the Court Officers Act, 1926, section 55 (3), which provides that:—


“From and after the closing day the percentage charged on the estates of lunatics under Sections 109 to 114 of the Lunacy Regulation (Ireland) Act, 1871, shall be paid into the Exchequer in such manner and at such times as the Minister for Finance shall direct.”


The issue was raised previously and is referred to in Appendix XIII of the Report of the Committee of Public Accounts on the Appropriation Accounts, 1927-1928.
