The Select Committee on Statutory Instruments have under consideration the Vocational Education Act, 1930 (Grants under Section 53) Regulations, 1954 [S.I. No. 139 of 1954].


They note that the date of the consent of the Minister for Finance is not stated on the instrument and they are not therefore in a position to determine the date of the instrument. They would accordingly be glad to have a memorandum, explaining the omission, before the 9th February, 1955.

With reference to your minute (Ref. No. 12/1/55) of the 21st ultimo regarding the Vocational Education Act, 1930 (Grants under Section 53) Regulations, 1954, I am directed by the Minister for Education to inform you that the form of the Regulations, as made, conforms with the draft prepared by the Parliamentary Draftsman, and is not different from that which has been used in making similar regulations each year for the past 20 years or more.

I am directed by the Select Committee on Statutory Instruments to refer to your Department’s minute, under reference 2689-54, of the 7th ultimo regarding the Vocational Education Act, 1930 (Grants under Section 53) Regulations, 1954 (S.I. No. 139 of 1954).


I have to state that the point raised by the Select Committee was not whether or not the order conformed with the draft prepared by the Parliamentary Draftsman, but that in the absence of the date of the consent of the Minister for Finance to the order, they were not in a position to determine its date.


I have to request, therefore, that you be good enough to state the date on which consent was given.

I am directed by the Select Committee on Statutory Instruments to refer to your Department’s minute under reference 2689/54 of the 24th ultimo regarding the Vocational Education Act, 1930 (Grants under Section 53) Regulations, 1954 (S.I. 139 of 1954).


The Select Committee note that your Department do not know the date on which the Minister for Finance consented to the regulations made by your Minister. They wish me to point out that unless they are furnished with this information it will be impossible for them to carry out the duty placed on them by Seanad Éireann of examining the Regulations with a view to reporting to Seanad Éireann whether unjustifiable delay in laying has occurred. This arises from the fact that if consent was not given until a date subsequent to the date of signature, the date of consent would be the date of the instrument.


The Select Committee have, therefore, instructed me to request that your Department take steps to furnish the required information before the 14th instant.

With reference to your minute (Ref. 12/1/’55) of the 1st April, 1955, and to previous correspondence regarding the Vocational Education Act, 1930 (Grants under Section 53) Regulations, 1954, I am to inform you that as already stated this Department does not know the exact date on which the Minister for Finance signed these Regulations. The instrument was, however, returned to this Department on the 4th June, 1954, with a covering minute which stated that it had been signed by the Minister for Finance.


Enquiries were made by telephone to the Department of Finance on receipt of your first letter of 21st January, 1955, but that Department was not in a position to give the exact date of signing. It was stated, however, that it was sent by them to the Minister’s Office on 29th May, 1954, and was received back signed on the 1st June, 1954.
