Standard Specification (Men’s Heavy Boots) (No. 2) Order, 1953 (S.I. No. 317 of 1953).

The Select Committee on Statutory Instruments have under consideration the Standard Specification (Men’s Heavy Boots) (No. 2) Order, 1953 (S.I. 317/1953) in connection with the requirement under Section 20 (6) of the Industrial Research and Standards Act, 1946, that it be laid before each House as soon as may be after it is made.


They note that the instrument while made on the 14th October, 1953 was not laid before Seanad Éireann until the 11th June, 1954. In accordance with their terms of reference, the Committee have to consider whether there was unjustifiable delay in the laying of this instrument before Seanad Éireann, particularly in view of the practicability of early laying implied in Section 3 (1) of the Statutory Instruments Act, 1947, which appears to apply to this instrument. They would, therefore, be glad to have a memorandum on this point before the 9th February, 1955.

Memorandum from Department of Industry and Commerce.

1. This Order was sent for printing immediately after it was signed by the Minister for Industry and Commerce on the 14th October, 1953.


2. Printed copies of the Order were received from the Stationery Office in December, 1953, for presentation to both Houses of the Oireachtas prior to publication.


3. When arrangements for presentation were being made it was discovered that there was an error in the Order, as printed, and it was necessary to return the printed copies to the Stationery Office with a view to having the error rectified before the Order was presented and published.


4. Corrected copies of the Order were received from the Stationery Office in June, 1954, and these copies were laid before each House of the Oireachtas on 11th June, 1954.


5. The Stationery Office have explained that the delay in effecting the necessary correction was due—


(a) in the first place to the contractual problem which arose through the delivery of defective final prints, and


(b) subsequently to the difficulty which the printers were experiencing in completing work within a reasonable time schedule.


6. Orders made by the Minister for Industry and Commerce under Section 20 of the Industrial Research and Standards Act, 1946 are exempted from the operation of subsection (1) of Section 3 of the Statutory Instruments Act, 1947. by virtue of a direction made by the Attorney-General on 3rd March, 1948, pursuant to the provisions of subsection (4) of Section 2 of the Statutory Instruments Act, 1947.
