LUNACY FEES AND PERCENTAGES.

The following is a note on the subject of the fees and percentages authorised by law to be taken in the Court Offices in Lunacy matters which, in the course of my examination before the Public Accounts Committee on the 25th October, 1951, I undertook to supply for the Committee’s information.


The fees and percentages taken in Lunacy matters in the Court offices are of two kinds, viz., the percentages authorised to be taken under the provisions of the Lunacy Regulation (Ireland) Act 1871 and the fees prescribed by the Court Fees (Supreme and High Court) Order 1926 in that part of the Order which is entitled Lunacy and Minor Matters.


The authorised percentages are:—


(1) The rate of two pounds ten shillings per centum for each annual income amounting to one hundred pounds and not amounting to five hundred pounds, but so that no larger sum be payable in any such case in any one year than ten pounds:


(2) The rate of three pounds per centum for each annual income amounting to five hundred pounds and not amounting to one thousand pounds, but so that no larger sum be payable in such case in any one year than twenty pounds:


(3) The rate of four pounds per centum for each annual income amounting to one thousand pounds or upwards, but so that no larger sum be payable in such case in any one year than one hundred and fifty pounds.

The foregoing fees and percentages are what the Exchequer receives (and all it receives) to meet the expenses incident to the administration of the estates of lunatics. The actual receipts amount in the aggregate at the present time to some £750 a year in the case of the fees and to some £2,500 a year in the case of the percentages.
