FIRST REPORT

1. The Committee has held seven meetings to date. At the first meeting, Senator Duffy was unanimously elected Chairman.


2. It was decided that although under its orders of reference the Committee has power to examine any relevant rule, order or regulation presented to Seanad Eireann at any time, it would for the present at least, confine itself to the examination of documents Tabled since the date of its appointment.


3. It was also decided that where printed copies of a document are not available owing either to delay in printing, or to the fact that the document is one that is not printed, stencilled copies would be considered, subject to their being checked by the Clerk against the copy in the Oireachtas Library which is accompanied by a signed presentation Form or where the document is printed in the Iris Oifigiúil against that copy.


4. The following documents coming within the Committee’s purview were considered and no reason was seen for drawing the special attention of the Seanad to any of them on any of the grounds set out in the Orders of Reference to the Committee.

5. The Cream Order, 1948, S. I., No. 272 of 1948, was also considered and it was decided to ask the Secretary, Department of Agriculture, to attend a meeting of the Committee in connection with it. The Minutes of his evidence are attached (Appendix I). Subsequent to the matter being taken up by the Committee, but before the attendance of the Secretary, Department of Agriculture, the Order was revoked by the Cream Order, 1948 (Revocation) Order, 1948, S. I., No. 428 of 1948. Arising out of the evidence given by this Officer the opinion of the Attorney-General was sought as to whether the Minister had power to make the provision contained in Article 7 of the Order and a copy of this letter and the Attorney-General’s reply are also attached (Appendix II). The Committee are of opinion that the special attention of the House should be drawn to the Cream Order, 1948, on ground (iii) of the Orders of Reference, viz., that it appeared to make unusual and unexpected use of the powers conferred by the Statute under which it was made.
